Got my LLC and just starting my FBA journey. Been watching hundreds of youtube videos for tips & tricks from people like DVas, and while they make for great motivation, their strategies are questionable. This video is GOLD! Nobody talks about this! The fact that a non brand listing looks like garbage (I personally didnt buy stuff from plain listings before I knew about AFBA), I was concerned I'd have thousands of dollars just sitting in an amazon warehouse for a year while I wait on a trademark because my listing wouldnt be competitive. You've reignited my drive with this video and will be doing the IP Accelerator program no matter the cost. This program should be the first thing on the budget for someone getting into private labeling FBA. Subscribed!

Hello. You're welcome! That listing and those sellers are doing arbitrage and wholesale. That is perfectly normal to see. If you're doing private label, you don't want to have anyone else on your listing.

Your listings rank is based on the daily sales velocity and has nothing to do with Brand Registry or trademarks. If you want to protect your brand and have access to these marketing tools, then yes, apply for a trademark and Brand Registry.

Hello! Yes, brand registry applies to your entire brand. Reviews are separated by variation now, so if they have the same ASIN, they should share the reviews left for that ASIN.

You're welcome! I'm not sure what you mean. A trademark is typically registered under a specific category. You'd have to speak to a professional if you want protection under multiple categories.

Hi Crescent. I thought in order for someone to not copy your product a patent was required. Isn't a trademark for the business name or logo? Why trademark and brand register if someone can copy your product?
Hello. For unique functionality or design, you can file a patent for. For brands and logos, you can file a trademark. The purpose of registering a trademark is to protect your brand and have access to additional brand marketing and advertising tools that Amazon offers to those that have a registered trademark. You also get better protection against people infringing on your brand.

If you have brand registry, it gives you the ability to protect your brand and stop hijackers. If you allow other people to resell your branded products, then you can do that too.

I understand that many sellers have an overall business operations name, which may be the only name they use when selling products. But, if there were, say, two-to-three independent product lines under that operations name, that each have their own name, what is the recommended way to protect multiple branding sub-names, trademark registration, and brand registry? I am aware that to be brand registered with Amazon, you must first obtain a trademark for any given name. Would one trademark and register the overall operations name with Amazon or each sub-name? or all of them? Does trademarking the operations name 'cover' the sub-names? Is there a level of sales that one might want to reach before trademarking and registering the brand names makes financial sense? I realize this may be difficult to address in this format, and I appreciate your time and thoughtfulness in helping me. Hopefully, it will help others, as well.
Good morning! If you are selling private label, you'd be selling all your products under that one private label. If you're doing wholesale or arbitrage, then it doesn't matter what your store or registered business name is.

Like I said in the video, once you start the process with one of the vetted firms in the IP Accelerator program, you get access to Brand Registry right away. The process only takes a few days.

I showed my product to people and they like it and small business owners can sell my products in their stores for small cut. I think it would be a good way to make some extra money and invest back in the business. What do you think? I may need a business license for that right?
Yes. If you have a retail space to do so, give it a try. If you want to make it a legitimate business, you can register one or you can just operate as a sole proprietor. I'd speak to a professional to figure out what your best option is.

This is bad information. IP Accelerator only gets you into brand registry quickly. Brand registry does not protect your listing from hijackers or counterfeiters. It will still take up to a year plus even after gaining access to brand registry since Amazon will not remove hijackers from your listing until you have a full registered trademark and like I said before, it could take a year plus before that happens, if it happens. This youtuber clearly doesn't know the difference between registered trademark and and application for a trademark.
I'm sorry but you're sorely mistaken. It clearly states on the home page of IP Accelerator and on the FAQ that you get brand protection. brandservices.amazon.com/ipaccelerator "Faster access to brand protections Amazon provides businesses using IP Accelerator with access to brand protections and brand building features in Amazon’s stores, to better protect and grow their brand months, or even years, before their trademark registration officially issues." "Proactive brand protections: Amazon will use information that you provide about your brand to implement protections that attempt to proactively identify and remove potentially bad listings that could harm your brand and our customers."
@@CrescentKao yes it does state that, but it is misleading. I have personal experience with trying to file and infringement report and they specifically say you can not do anything until the trademark is fully registered and no longer pending which can take up to a year or more assuming the trademark doesn't get denied. You do get access to the tools in about ten days to two weeks but in regards to hijackers or counterfeiters, Amazon brand registry doesn't provide any options to remove them until you are a fully completed registered trademark. IP accelerator doesn't expedite that, they just expedite your access to brand registry. You are providing bad info to people to people who may drop a $1000 dollars plus while fully expecting to have brand protection immediately upon gaining access to brand registry, they won't.
I’m sorry hear that it hasn’t been working for you, however, there’s a plenty of cases that you can find online of sellers having hijackers removed within hours after being accepted in the IP Accelerator program. Im in the same position as you. I filed a trademark through the IP Accelerator, I now have access to brand registry but am unable to remove hijackers on my listings because my trademark is pending. Did you find a solution to this?

They can but if you can prove that you’ve been using it first, you can file an IP dispute.

Because this is how Amazon works. They want identical products listed under one listing unlike eBay where every seller gets their own listing.

Some brands have resellers, that's how their businesses operate. Hijackers is an issue when it comes to private labeling.

You need to choose the class that fits your business. I suggest using a UPC not GTIN exemption. Yes, you can use your brand for everything.

Yes. If you have a retail space to do so, give it a try. If you want to make it a legitimate business, you can register one or you can just operate as a sole proprietor. I'd speak to a professional to figure out what your best option is.

This is bad information. IP Accelerator only gets you into brand registry quickly. Brand registry does not protect your listing from hijackers or counterfeiters. It will still take up to a year plus even after gaining access to brand registry since Amazon will not remove hijackers from your listing until you have a full registered trademark and like I said before, it could take a year plus before that happens, if it happens.
This youtuber clearly doesn't know the difference between registered trademark and and application for a trademark.

@@CrescentKao yes it does state that, but it is misleading. I have personal experience with trying to file and infringement report and they specifically say you can not do anything until the trademark is fully registered and no longer pending which can take up to a year or more assuming the trademark doesn't get denied.
You do get access to the tools in about ten days to two weeks but in regards to hijackers or counterfeiters, Amazon brand registry doesn't provide any options to remove them until you are a fully completed registered trademark. IP accelerator doesn't expedite that, they just expedite your access to brand registry.
You are providing bad info to people to people who may drop a $1000 dollars plus while fully expecting to have brand protection immediately upon gaining access to brand registry, they won't.
I’m sorry hear that it hasn’t been working for you, however, there’s a plenty of cases that you can find online of sellers having hijackers removed within hours after being accepted in the IP Accelerator program. Im in the same position as you. I filed a trademark through the IP Accelerator, I now have access to brand registry but am unable to remove hijackers on my listings because my trademark is pending. Did you find a solution to this?
@@CrescentKao This link doesn't contain any useful info about how to remove hijackers. If you read at the bottom of the post there are also people in the same situation as us. It won't let me remove hijackers due to counterfeit goods because I have used the IP accelerator.
