Can I Use Copyrighted Music In My Podcast?

  • Before jumping into this topic, I should note that you shouldn’t take this video as any type of legal advice. You should consult with your own attorney when it comes down to using licensed music.
    Maybe you’re a brand new podcaster and you’re looking to step up your production game. Or maybe you’re a podcaster who’s been doing this for a while and you just want to feature a couple of clips of music in your podcast to really drive home a point.
    This video may give you a perspective that will have you rethink whether you should be using licensed music inside of your podcast.
    THE LICENSING GIANTS - ASCAP AND BMI
    Most podcasters consider their podcast as another piece of media that can be consumed by the general public. But what they don’t realize is that what they’re hearing on TV and on radio has been licensed or a license has been purchased to use that music within their program.
    Over the course of my 18 years in radio, I have learned that there are two major entities that you need to consider if you’re trying to license your music. One of those entities being ASCAP and BMI. Both of those entities give you the opportunity to purchase the rights to use music within your own piece of media.
    However, when it comes down to licensing, those license cost can be really, really expensive.
    You might be saying to yourself, “No one’s really gonna know that I’m using a piece of copyright material within my podcast. I'm a small timer!”
    DON'T COMPARE YOURSELF TO WHAT OTHER PODCASTERS MAY BE DOING ILLEGALLY
    You might be saying to yourself, “I have listened to podcast where copyrighted music has been played on those particular podcasts. How are they getting away with it?”
    There are a couple of reasons:
    1.) Maybe that podcaster is using some type of copyrighted music but they don’t realize that they are violating some type of copyright infringement. They could potentially be in trouble if they have not bought some type of license for ASCAP or BMI.
    2.) The podcaster has actually purchased a license through ASCAP or BMI and you jus don't know it.
    3.) That the podcaster that is featuring the music on their podcast may already have struck a deal with the musical label to play that music on a podcast. In other words, that particular podcaster has gone to a music label and asked for permission to play that music on their podcast. It could have come in the form of some type of written permission.
    You will always see this or hear this on TV and radio that you can’t use a particular piece of music or a particular clip from TV without getting express written consent. So if you're looking for that permission, you should be reaching out to the label.

    Another amazing video! Almost made this mistake once. Checking the license type is absolutely necessary. Some of the free music isn't usually meant for commercial purposes. So if you are planning to use music for your podcast which you are planning to monetize, make sure the license allows commercial usage. There may be some restrictions on modifying and editing as well. The safest thing is to either pay for the license or create music on your own. There are some apps like SoundTrap that let you create some type of music using prebuilt loops. Better safe than sorry :) Thanks again for this video. This channel is becoming a podcasters Wiki.

      You can still review it, but I wouldn't play the music in the podcast.

      You can review music under fair use, just dont play the whole song and don't make the show about playing the songs to the audience, make sure the focus is on the review

    Hello,
    This is great and extremely helpful. Thank you very much for putting this out. Are you familiar or have any ideas on how it would apply to this scenario. We want to do a podcast where we listen to a song or album for review and commentary on a podcast? So, we'd play like a one hit winder and discuss why that one song made it big, but the rest of that artist's music never went anywhere. But, ultimately, we'd be playing the music for criticism and commentary.

    Hey Shannon. I have a question regarding audio clips and if I can put them into the intro of my podcast . I'm planning on taking 5-10 second clips of people talking about an event or an ideology that's relevant to the podcast episode and string them together while music is in the background.These audio clips are coming from youtube videos like the news, entertainment channels, and channels that have reuploaded what public figures said in interviews. Do you think this is considered to be a form of fair use? Thanks!

      Hey Drew-- Honestly, I don't want to recommend that anyone take anything where someone else has created the content and it is being used for their own content. If it's something that is uploaded to RUclips, there are controls when you upload asking whether the content you're sharing has been aired anywhere else. You can also mark whether those videos can be used for others to reuse. I honestly just stay away from taking anything from anyone. But I understand where you're coming from. If it's entertainment and news, I think it's OK, but you can't quote me on that. I'd strongly recommend against it. When it comes to sports teams, those are absolute no-nos because the leagues get real picky about what they want out there. Some leagues are OK while leagues like the NFL get picky.
      As for the answer to music being played in the background, you're really have to be careful with what you're placing in the podcast itself. Even though there isn't software right now that regulates what music is being played, it can certainly be tagged by someone and you end up paying the cost.
      Most of my answers are going to be against taking anything from a previous source that has already broadcast it. I like to keep things original in my podcast.
      I know this answer isn't much help, but I just want you to be safe.

    Audio Jungle has different license agreements. How do I know which one is related to podcasting? I'm assuming The Music Broadcast License (1 Million), but I'm not really sure!

    Hi Shannon. Was thinking of starting a podcast about music. There are a ton out there and most I listen to use A LOT of music. Do you think they’ve all attained permission or could they be operating under the fair use doctrine? As most of the podcasts play music in which they are commenting on or critiquing....thanks

      Hi Bill. I"m thinking most of those podcasts haven't attained a license and are just doing it. But there are some podcasts that only play music on their podcast because they are part of the label--and the music that is played is only music that is part of the label. Even if your'e taking a small portion, you could get dinged. I did come across a website for people who create RUclips videos with licensed music and how to attain those licenses, but it's typically when the content creator is doing a cover song. For podcasting, you still need to attain a license.

      Hi there. I doubt you can use it because the label still owns the music. Just because he died doesn't mean his music can be used because the music has probably been copyrighted by the label. Here's a blog on when you can use music:

    Hi Shannon...great advice. Ascap/BMI was one of the questions I had in mind. So my podcasts will include local musicians who, a good portion of them, are cover bands and if I were to use video clips or live recordings of their performances...would that mean I need to acquire the license to air?

      I certainly can't answer this with confidence, but I would get permission from the band first. Although most local bands are OK with any exposure whatsoever. It typically gets muddy when they're signed to a label and there are rights. It would be best to consult with them or their lawyer for a clearer answer.

    What about "Royalty-Free" music from the You Tube Library that's disclaimer states its free to use? Can I use them on my Podcast then?

      This answer isn't "official" but I would give a general "yes" to this since I have heard podcasts using RUclips's royalty-free music. I'd still follow the rules RUclips provides even if I was making an audio podcast.

    What if you directly asked them original creator of the said music and tell you that you can ?

      I know that independent artists have done this in the past with podcasters. You see it all of the time on Soundcloud. But if the artist is signed (even if you know them) you should still get consent. I can't give you a straight answer because I'm not an attorney, but I recommend checking out this site to read more on copyright infringement:

      Thanks for waiting for my reply. I promise that I do get back more prompt, but last week was super busy for me that I didn't get a chance to hop into the comments section of RUclips.
      So I can't give you a straight answer on this other than saying that if the music is licensed, don't share any form of the music in your podcast at all. I'd just stay away from playing any licensed music on your podcast. Unless you have permission and a license, I'd just stay away. It's more of a PITA than anything else.
      Better to stay out of the crosshairs than deal with the consequences later.

      I know that RUclips states that you can use the audio only in their videos, but I don't see a reason as to whether you can use them in a podcast. I have used some of the audio found in the RUclips Creator section. I just make sure that it is free to use without attribution.

      I'd say "no" in this case only because I have had music playing in the background of my RUclips lives and I'll get a copyright strike for it. I'd say stay away from anything that is licensed.

      I would just stay away. I has this question pop up by a colleague the other day wanting to do the same. It's just best to stay away. I mentioned to him that if he wanted to risk a few seconds for a fine that could potentially cost thousands. It's not worth it to me. Plus, including music (even for a few seconds) violates the terms and agreement for some hosting services. If you ever plan on putting your podcast on Spotify, the will remove your podcast from their directory.

    Hey Shannon, not sure why, but the videos isn’t playing for me. So I guess I’ll just ask my question here. I want to do a music podcast where I actually play a playlist of full songs. How do I go about that? Do I have to buy the rights to every song we play? How do regular broadcast music radio stations go about it?

      I thought I got back to this comment, but I guess I didn't! I'm sorry I'm so late on this. If you want to do a music podcast, you have to make sure you get permission from the artist. As I mention in the video, radio stations purchase a license per station that gives them the rights to play songs for commercial use. You'd have to look into BMI and ASCAP to make sure you have the rights to do that--even for podcasts.
      If you are playing music from independent artists who haven't been signed to a label and aren't licensed, it's at the discretion of the artist. Typically these are local bands that don't care.
      If you're looking for an option to create something that is like a podcast but can play music, I would look into www.live365.com to play music. They have already purchased the rights to the music and will charge you a fee to be able to use those songs. You'll have to look on their plans in order to see if it makes sense for you. I did Live365 years ago and it was fun, but that was years ago. IDK what the platform is up to now.

    I'm wanting to create a Podcast that features and promotes more underground music. I don't want to just mix the music like I have done in the past and uploaded to Mixcloud but rather talk about and share the latest tunes coming from my favorite bands.
    What are the steps I should go through to obtain licenses to do this? Most of these bands are on smalltime labels. Should I contact the labels?

      I would stay away from anything that has a license around it--even if it is a cover. I'd stick to royalty-free music only.

      You don't need to get the expensive license. The lowest license will do just fine. I've never had someone come back to me asking me to show the license.
      Most licenses should be in the $10-20 range.
      I wouldn't overthink it--especially if you're just starting out.

      For this one I think it was the Logitech C270, but I now use the C920. They're hard to get now. They are in high demand right now and retailers are gouging customers. The 920 usually costs about 100 bucks but your'e now seeing that price doubled.

    What about music from indie artist? I wanna start a review show for indie artist specifically in the horrorcore genre and there is no outlet like this from what ive seen...essentially people would send us music too review we would play it for the listeners too help people get heard and review it on the podcast

      I can't give a complete answer on this, but I do know that there are indie shows out there. Just as long as you get written consent from them. If you do a show like that, I think putting it on Live365 would be a better answer other than the fact that you're paying for that service--which covers licensing. One way around it could be doing a talk show and directing people to a curated Spotify list. Again, I'm not a lawyer so I can't give you a straight answer. Sorry man.

      Of course you can. It's just not recommended to utilize music that is licensed. Your music would be considered "independent". So you're in the clear.

      I mean, I can't speak to whether this is OK or not, but I know that when there has been music in the background, it has been inaudible. I've still published podcasts like that but at the end of the day, I just try to keep music out of any of it if it is licensed. Just be very careful about licensed music. People can get picky.

    Question. If you broadcast a show on FM radio that includes music and are covered by licenses on-air but then upload the show to RUclips for listeners to hear anytime they want, is it then not covered?

      Great question! When I made this video I wanted to answer that question, but it would have been too "industry" for most people. The answer to this question is no. The music that was recorded in the original broadcast is only licensed for the airwaves it was originally captured. From what I have understood through reading the terms and conditions of licensed music, you need to purchase a new license if you are looking to re-broadcast anything that has licensed music. Keep in mind, what I'm talking about is for podcasting.
      When it comes to RUclips, the system RUclips is using has music-match AI and unless you have written consent to use the music, RUclips will flag your content and pull it down. Sometimes you can get away with it and other times RUclips flags it immediately.

    This was an informative video!
    I have a question for you:
    I have this clip from a talk show where an actor was making a comment about working with his partner in a movie, and I wanted to use it as a jump-off to start a discussion about working with a partner and could you do it.
    As much as I have read in regards to Fair Use, I feel like I might be in the clear there but I’m not sure.
    My second idea is to tell people where I got the quote from (me reading it isn't as funny, but I'd rather be safe than sorry), read off the quote and leave the video in the show notes.
    Can you please let me know what you think, I really don’t want to launch my show and end up with a DMCA takedown notice.

      Thank you for watching it! I appreciate it! To answer your question the best I can...
      I would go the route of your second idea just because it stays out of the legal realm. But I do understand why you would want to take that clip and put it in your podcast, but I just try to stay away all together even if I feel like it's Fair Use. In this instance, I'm sure it is fair use and I don't really think you would get hit with a DMCA takedown at all, but I'm not a lawyer and couldn't give you a straight answer. You'd have to consult one.
      So that's why I would just recommend sticking with quoting what the actor said, post the video on the blog and just talk about it in your podcast.
      PLUS, when you get people to listen to your podcast, your goal as a podcaster should be to get people on your website anyway. So use both of the platforms as tools for promotion.

      Milly Monroe no you cannot. You still need licensing. They already get promotion from a management team. I'd stay away from it regardless. It just causes problems.

    If I'm not mistaken, if you publish your podcast on MixCloud, it's all legal, because they are copyright all covered. Everybody is now creating accounts on MixCloud, due to mix live and we can broadcast licensed material.

      Unless I'm missing something, but Mixcloud has a whole section in their Terms of Service that talk about Copyright infringement. I'm sure this is a great platform to put mixes and podcasts, but it seems to me they still follow copyright infringement laws based on their ToS. I don't know enough about Mixcloud to make an assessment. It's a platform that might work for some content creators, but it's not really talked about in podcast circles I'm in.

    Good one Shannon. I am a member of ASCAP and own a couple of businesses so its great to hear you give some advice about integrity. If you're a podcaster, artist, musician, content creator, etc. and someone "borrowed" you'r work with out paying you, how would you feel?

      roknrexstudio I think it's only right to talk a out the integrity of a podcast. It kinda grinds my gears when podcasters want to use someone else's work. It makes me think they can go beyond someone else's creativity. All of the music I use is royalty free and I k ow how make it sound original. I wish more people did the same!       As you can see, you can fall down a rabbit hole and it gets complicated. That's why I don't even deal with it. I'd much rather just pay for royalty free music or have someone else make it. Good luck, my friend! :)

      I will try to come up with a video on this. Even though there are free resources for music, a lot of it isn't as high quality as you would get through something like AudioJungle or NeoSounds. It's my goal to share a platform that is easy to navigate and save people time from researching for hours. Even though I like platforms like CCMixter, it sometimes takes me far too long to get something from their platform. At least with paid royalty free music I know that I have certain permissions to use it and it doesn't take me as long. I try to respect those who make music to make side money with platforms like Audiojungle. 🤓

If this is the way you want to go, by all means, do what you think is right but if you get caught, I hope you have lots of time and money on your hands because it’s going to cost you one of the two or both.

    What if it is music that has been manipulated. For example i started a trivia podcast and was going to to include a quiz that was about music/ songs that have been showed down to 33rpm.
    I assume that i would still need to license it even though it had been changed.
    Please help me shine some light on this.

      Nick Allred yeah, without a license, you cannot reproduce or modify the art. I think this still falls within the boundaries of licensing.

    Just sharing a resource I found that I’ve been using... Soundstripe.com. You pay an affordable monthly subscription and get access to music and songs that you can license for specific projects. I’ve been using it mainly for background music for my RUclips slideshows on my photography channel, but you could easily use it for podcast audio also.

      Shannon Hernandez Yeah it’s just so hot - I’m sure in AZ also - we are on an island, almost all weddings are outdoors, so you just can’t subject guests to that. Which is kind of a blessing for us vendors - often all of us wearing black - and even moreso for photographers as we’re the only vendor with the couple the whole day start to finish so it makes for grueling work. So the break is nice and that’s when most of us head to the mainland to see family and relax.

      Hi John, I haven't heard of Radionomy up until you shared this post. I would check with Radionomy's platform to see if there are any rules to uploading your podcast. Based on the brief look I had on their site, it looks like you can add only music, but you'd have to to check their FAQ to see what you can and can't add. I'm sorry I'm not much help in this area. 😔

      @@ShannonHernandez Yep I might be wrong but I think they came out in 08', its a free internet radio station where you can create and broadcast your own internet radio for free, like you said though the catch here is that they take care of all the licenses but you must get and maintain lots of listeners, and Radionomy is able to do this through commercial advertising, and once they removed live on air broadcasting but they put it back, you get 41mins of broadcasting per hour and 19 mins of commercial time whether you go live or pre recorded, oh yah when you get so many listeners they pay you, not much but hey.

      That's interesting. MANY years ago I was using Live365, but it was too expensive and took a lot of time to maintain. Plus, there were too many limitations on how much you could play based on the megabytes they offered. I do know they restarted and have a different business model, but it's not enough for me to go back and do something. Sounds to me that Radionomy has some limitations. It sounds somewhat similar to what we do in traditional radio. IDK, I'd have to check it out. I'd definitely check or email their support to see if you can add your own podcast on there. That would be cool to have it go live at a specific time to have listeners tune in.
