I've been following her since 1983 when I first heard her on the radio, her voice just stood out, her tunes were catchy and danceable. When I first saw her on MTV I thought that girl has got something and yet girlfriends of mine at the time were not impressed, as were many of the general public and the church in Ireland. I loved her boldness, her rebellious streak and her ability to shock, I could see what she was doing, tongue in cheek, sassy, sexy, gorgeous and talented, with a huge drive and determination. Every boyfriend I dated hated her, bar one. I would argue her case and tell them that they were being prudish and boring, even belting out her tunes to further annoy them hee hee. Madonna is a soul sister to women all over the world, women who have had to put up with abuse, women who were made to feel like second class citizens, women who were without a voice. Madonna was that voice and she still is that voice. She is a true artist, very emotionally intelligent and is here to make her point, through her art and leave her mark. Lola, I am not a lawyer and definitely not a US copyright law expert but I had to read Canada Copyright law and the leading Canadian Supreme Court case (again) to fight an unfair copyright claim against three of my news report videos which I ultimately prevailed and my video reports were bought back to live by RUclips. Allow me to make a few brief guesses/observations: 1) The original video has a good chance (I am not a gambler but I am willing to bet US$1) to stand as "Fair Use" under US Copyright Law protection for it likely qualified as "news reporting" and non=commercial. (Note: There is a detail page re "Fair Use" on Wikipedia that can give you some idea and I think it links to some leading court cases like Lenz v. Universal Music Corp.(the "dancing baby" case) 2) Having said the above, I remember you telling me this is not your video thus not really your video and making it an one step removed use. But, in this case, I am still willing to bet a penny that you can probably still "Fair Use" it. And I will definitely recommend you give the video proper credit/attribution here as best as you can. Lola, I am not a lawyer and definitely not a US copyright law expert but I had to read Canada Copyright law and the leading Canadian Supreme Court case (again) to fight an unfair copyright claim against three of my news report videos which I ultimately prevailed and my video reports were bought back to live by RUclips.
Allow me to make a few brief guesses/observations:
1) The original video has a good chance (I am not a gambler but I am willing to bet US$1) to stand as "Fair Use" under US Copyright Law protection for it likely qualified as "news reporting" and non=commercial. (Note: There is a detail page re "Fair Use" on Wikipedia that can give you some idea and I think it links to some leading court cases like Lenz v. Universal Music Corp.(the "dancing baby" case)
2) Having said the above, I remember you telling me this is not your video thus not really your video and making it an one step removed use. But, in this case, I am still willing to bet a penny that you can probably still "Fair Use" it. And I will definitely recommend you give the video proper credit/attribution here as best as you can.
