    It is *ABSOLUTELY* ludicrous for Disney to try and block that lawsuit like this. Imagine if one of your family members died at Nintendo World and you try to sue Nintendo for it, only for them to basically say "Sorry, you bought Nintendo Online once in 2018 and thus agreed to never sue us for anything, ever." This is downright near dystopian levels of corrupt corporation.

      So, Disney says "You agreed to have all disputes go through arbitration.
      In Disney's book, that strongly suggests that "I used a Disney product and it KILLED my wife." is something within the realm of acceptable possibilities when engaging in consumption of Disney products.

      The thing is they will probably win on the arbitration part because it was agreed upon when buying the tickets. now will they get away scot free no they will likely have to pay him a good amount of money in the pain and suffering category but sadly the allergy part will fall into the the " coffee is hot" column in the well known fact the no dish is ever allergy free from a commercial kitchen unless you've cleaned down your kitchen and sanitized EVERYTHING between each and every dish which no kitchen can or will do.

    Law student here. Arbitration is such a huge cancer in consumer and employment contexts. It’s never truly neutral, because the more powerful party is a repeat player with advantages like prior experience with an arbitrator, getting to pick the arbitrator, and, of course, way more money for lawyers in the arbitration. People often don’t know what arbitration even is when they sign these agreements, let alone have a strong comprehension of how agreeing to arbitrate would affect them.

    I’ve mentioned this quite a few times now in previous comments but I’ve worked as a chef for nearly 10 years now. You absolutely can not take the risk with allergens. We are responsible for our food and clearly the proper precautions weren’t taken. The idea that you can’t sue a company that killed your wife, one of the largest companies on earth, is so mind numbingly idiotic I don’t even have words for it. The chefs and Disney itself should be held responsible. Even if it was a horrific mistake, that needs to be known. Fuck Disney

      The strange thing to me is that the restaurant isn't being sued?
      Technically Disney is just the landlord and Raglan Road rents space at their shopping district.
      It's absolutely insane their lawyers are choosing this argument vs the simple one that they are a landlord and not owners or operators of the restaurant. Mind-blowing stuff.

      @@janelliz I don’t know too much about the specifics and how the law works in America but from what I can see they’re still considered Disney employees hence why Disney is being sued. I could be wrong on that tho. I imagine they’re going for this argument to try and set an extremely fucked up legal precedent and I imagine if it does actually go before a jury they’ll use the “we’re just the landlords” argument. However I think because the restaurant is in a Disney park and because of the PR damage that their current argument has caused, they won’t win that. And I suspect their lawyers know that. I personally think no matter how you cut it, this whole situation is an absolute nightmare for Disney. But, you don’t get to be a multi-billion dollar company by being ethical. This is far from the most fucked up thing Disney has done

      My friend’s daughter has those same allergies and this is absolutely terrifying. It’s no joke. We can’t touch her if we’ve touched dairy unless we wash our hands thoroughly with soap and water first. The fact that they asked multiple times and informed them she was allergic and it wasn’t just a preference is grossly negligent.

      @@shaesmith2831they’ll settle out of court if this tactic doesn’t work (and I sure as hell hope it doesn’t!). We likely won’t hear of the case again if this gets struck down. I hope the husband doesn’t settle and takes them all the way to a jury, but at the same time, legal cases are exhausting so I hope if he settles he gets millions and millions because nothing will bring his wife back. 😔

      ​@@shaesmith2831They aren't Disney employees but 3rd party partners. They are owned by Paul Nolan and John Cooke and operated by Great Irish Pubs Florida. Their employees aren't employeed or hired by Disney. Now Disney does have stricter than usual lease terms giving them a higher level of control over their tenants but ultimately the businesses are in charge of hiring and training their staff. Attempting to use this clause to arbitrate the case is ridiculous but I don't think they should be the focus of the suit.

    Disney sued my small-town high school because our mascot kind of looked like one of their characters. They won, and we lost our art program. Horrible company and I feel awful for the husband. Disney's response to that lawsuit is so absurd.

    My partner was in a terrifyingly similar situation at Disney with a waiter who didn’t BELIEVE in food allergies. My partner and his family explained to the waiter about his allergies, he said it’d be fine but didn’t write anything down. Food came out and they asked again. He assured them it was fine, even though they could SEE one of his allergens on his plate. Afterwards, they went to the manager and explained, “that guy is going to kill somebody.”
    A couple years later, they went to a different Disney restaurant and saw the same waiter working the floor. Immediately walked out.
    There is no reason for this to have happened and I cannot image the pain and absolute rage the poor family is feeling right now.

      Coming across one of those “I don’t believe in allergies” waiters is my worst nightmare. Thankfully my allergy isn’t fatal (technically an intolerance) but the symptoms will last for hours and are extremely debilitating. The fear of food being contaminated with an allergen is something everyone with a food allergy understands, and it’s why many of us rarely eat out. It’s not something to play around with. Especially when nut allergies are known to be extremely life threatening.

      Looking at the earlier drafts to the film, it becomes clear that Justin had a very different idea for the film. It appeared to be much more grounded and centred around the issues of DV. It is possible the divide has come from the intervention from Blake pushing the more aesthetic look we now have for the film

It seems like from conception the book has had controversy since Colleen markets her books like romance novels, when It Ends With Us is more about DV from what I understand (I confess I haven't read it and don't plan to.), she even got heat for attempting to release a coloring book based on the book (about DV). From what I've seen all of Baldoni's press has been about wanting to do such a serious topic justice, meanwhile Blake has been about girl movie summer and wearing florals and not mentioning DV at all (which I mean, fair-ish? DV probably doesn't sell movies, but then why make and/or star in a movie about that book if you don't want to be in movies about serious topics?). Blake has only just now levied some accusations at Justin, and so far they still make him seem like a pretty stand up guy imo. I think the instinct to assume the guy is at fault is a prejudiced but not completely unfair one given celebrity men's general track record, but in this case unless some bombshell news comes out it seems like they're throwing Justin under the bus here when he didn't do anything that should require all the cast ghosting him.

    Citizen of India and specifically West Bengal (the state where the r*pe & murder happened) and I'm so grateful this is getting some international coverage. Doctors have been asking for protection for decades now. Maybe international shaming will move the needle. But I also want to add that in this specific case, the violence was very personal and utterly gruesome. There are details coming out now that points to gng r*p and violent beating of her body post death. It also looks like an active cover up is going on which is stoking the protests. I really hope the murdered doctor gets justice, but most of all I hope we get strong laws to protect doctors now.

      I want to say that it will change; but corrupt police, corrupt doctors, corrupt lawyers; corrupt judges; corrupt ministers - who is going to do anything? The average Indian citizen (being uneducated, culturally backwards and care more about their family status) will most likely say it’s the doctor’s fault; so no help there! This is the second internationally reported ‘gang r!!p’ and since then, what has changed? Nothing! Until the civil systems are repaired there will be no justice. I am scared for India and its ppl.

      Hi there, I'm very curious on the matter. I wonder if there's security in hospitals in india. because people are much less likely to make a report if there isn't someone in the immediate area to report to or ask for help in the moment. And it's preventative too, maybe it wouldn't happen in the first place if there was always someone on hand to hold people accountable. By no means does having security or not justify people being harmful, i'm just asking the question.

Mere days after the rpe, the hospital tore down the walls of the room where it happened under the guise of "renovation". The police claimed it a suicide, and the Minister of the area is victim blaming. The local govt keeps trying to cover it up for some reason...

    Maybe a hot take but men should absolutely be involved in conversations about DV, and they should be allowed to tastefully and consciously make movies discussing the topic. Men too are not only victims of DV, but they are also related to or have relationships with women who have in some way experienced abuse. Our conversations about relational abuse mean nothing if men are not in the room.
    And maybe the director didn’t agree with the PR, which is why he’s not getting involved with it… I feel like people are too quick to assumptions based on preset narratives.

      DV relationships often go both ways, men get abused too. I understand that current culture makes a lot of men somewhat immature and ignorant on how bad DV is (even when they are experiencing it) but how do we expect people to understand things better if we lock them out of the conversations.
      I know most men do not like DV and would genuinely help anyone in that kind of situation but when they are only allowed superficial knowledge on it because their voices are shut down in these areas it only makes the men who want to help not notice when someone needs help and then men who've been a DV victim feel like their story is not only worth less but it doesn't matter either

There are a number of interviews from the press junket for the film where Blake just glossed over anything relating to the serious undertone for the film. From what I’ve seen of Blake (could not care any less for any of her films) she’s not a nice person and very self centred making everything about her

    Im from India. Women's safety is questionable here.Almost all women I've met here, including myself have faced harrasment and sexual abuse, some face it on a daily basis. What happened to the female doctor is horrific, the hospital administration & police are trying to hide evidence. It's frustrating this political hypocrisy, 50% voter's are women, yet the clutch hold of patriarchy is so strong at grassroot levels. I hope the doc receives justice ASAP

Ive seen Indian boys as young as 5-6 pin a female classmate against the wall and try to start tearing clothes off.. very strange and sickening behavior. Ive never seen it so young with any other group of people. I live and work in a very diverse area, only about 40 of my 200 students are white. They all come from different backgrounds, some immigrant parents some native, some ghetto some rich- Ive seen it all. You start to notice certain patterns and behaviors.

    With It Ends With Us, the main problem is the book itself and Colleen Hoover. Honestly just Colleen in general, almost all of her books romanticize toxic relationships but she advertises them as romcoms. I read it a few years ago and was shocked because I had no idea it dealt with such a serious subject. I really worry that people who are survivors or victims of dv might go into the movie thinking it’s a fun lighthearted movie and could end up being triggered and re-traumatized because of this carelessness. Idk what happened between Justin and the rest of the cast but at least he is accurately promoting the movie for what it is.

    The Disney restaurant was insane. I worked in Florida restaurants for years and we would NEVER EVER give allergen assurances. We could say "here are the ingredients" and sometimes "we can make your salad without tomatoes" but unless you've cleaned down your kitchen and sanitized EVERYTHING there is no way to guarantee no allergen contamination whatsoever. Even if *your* recipe doesn't include peanuts or milk, do you know for sure that every one of your ingredients doesn't and never came in contact before they reached you? This thing sounds like not only negligence, but gross negligence to make so many assurances. If I knew not to do that as a drive-thru robo person, I can't imagine how a fancy tourist restaurant wouldn't. They're trying to claim arbitration by bullshit because they KNOW they will lose the suit.

    The thing that really bothers me about the Imane Khelif story is how both sides are conflating intersex with trans. The IOC is literally saying, either she is trans, or not, and that there's no possibility she is intersex (and hence could be disqualified without any wrongdoing).
    Just goes to show you, if you're part of a small enough group of people, who don't fit into anyone's narrative, you can be completely erased.

    I worked in a Disney kitchen for a while in 2018. They always walked this line where they'd say their food was allergen free, but they couldn't guarantee it hadn't been contaminated. The kitchen I worked out of had three restaurants running out of the same kitchen that served wildly different menus, so there was always a chance there could be at least trace amounts of allergens in the food. For example: the ice cream station that served peanuts was right next to the steamwell. The steamwell stations didn't have peanuts technically, but there were peanuts less than ten feet away from the production area. I'm genuinely surprised the employees were so adamant that the food was clear.

What she ordered doesn’t seem to have nuts in it ordinarily, so for her to have “high levels” in her system seems weird. Trace amounts from cross-contamination is one thing, but it seems like there was just full-on dairy and nuts in her food. Just wondering if they found out if it was in the food (ie. they never attempted to make it allergen-free), if it was from cross-contamination (ie. an accident happened in the kitchen somehow), or some other way entirely. She was also in another location/store when she had the reaction, could she have come into contact with something there? I’m just wondering if they knew exactly how she came into contact with the allergens, or how they had gotten into the food 🤷🏼‍♀️

      @@MommyOfMutants I have the same allergy, so let me clear this up. She absolutely ate food that contained her allergens at that restaurant. The timing checks out, and all the epipens in the world will (most likely) not save you if you ingest enough of the allergen to override the epipens/antihistamines. Cross-contamination? Chances of survival are good-ish, but it's still enough to kill if ingested. Even a spoonful of an allergen can be deadly. Depending on the dish she was served, she might not have been able to smell or taste the nuts or dairy. The dish might have been cooked in nut oils, which would account for the high (but difficult to notice) nut content in the dish. And dairy is especially hard to detect through taste and smell when mixed with something else.

      Because it hasn't been tested in any court and current law is often insufficient not keeping up though it's not like that's not been known. I'd heard there's been alot of this going on in the US. I note when I see 'updated TOS' in emails for whatever product I use there's either a separate US clause or a clause similar to 'X applies unless your country's laws don't allow for it' which they usually don't.

    I'm from Kolkata and we had a huge turnout for "girls, reclaim the night" marches that we had at 12 am at many location points tonight. Just my location easily had thousands of people and other locations had even higher number of people all marching together. Everyone just walking together with signs or candles and shouting "we want justice". Tens of thousands of people walking and not a single person stepped out of line at any point. This was mainly for girls and groups of other marginalised orientations to "reclaim the night" as we've always been taught to avoid staying out or doing anything late at night, but people of all genders pretty much came out to march together in support. In my 30 years of life I have NEVER seen SUCH HUGE crowd of everyday people coming down to the streets for an issue. We're sick and tired. And we're also fucking done with this state govt clearly trying to hide the many more participants of this horrific crime one of whom is supposedly a powerful individual. They only arrested one individual and called it a night and also showed immense lack of transparency and competence at every step. A group of people also pretended to be a part of this protest march tonight and vandalised the R.G.Kar Hospital while all these marches were happening but it's laughable how they tried to frame the protesting crowd. There's high chances of things escalating further.

      I'd really like to see someone take Disney all the way. That senior accountant who worked 20 years at the parks sued for unfair dismissal when she brought dodgy park bookkeeping to Disney's attention which they ignored so she took it to the feds who said they'd investigate yet we heard nothing. She settled due to the stress of her husband taking his life ending that one. Now there's Carano's case and another entity going after them for DEI discrimination so I hope at least one gets to the courts or we'll never find out what they get up to.     As a healthcare worker i hate that the story about the doctor being killed on the job doesnt surprise me considering how american patients have treated me as just a lab assistant. Ive been kicked, hit, spat on, patients try to bite me, stick me with my needles, so much and thats with decent security i cannot imagine how horrific working in a hospital without strong security would be.

    For the Blake Lively controversy, supposedly you left out that Baldoni’s cut of the movie did better with test audiences but apparently Blake and Ryan strong armed the studio into using her cut instead, and it seems like Blake is using her connections to become the lead producer for the movie.
    I’m honestly leaning towards Baldoni being in the right because he’s actually talking about the themes of the movie, while Blake is trying to shill her own companies instead of the movie. And she looks like trying to force a barbenheimer moment with deadpool by having Ryan and Hugh Jackman show up at the red carpet.

      Yup! PubMed has some articles about stuff like this. Their studies found a 14% regret rate across all surgeries and 8%-17% regret rate for having children. So a 5% regret rate for abortion isn't that bad.

    CORRECTION: The below is for if police access geofencing data generally, but Phil said that geofencing WARRANTS are illegal, so police will likely have a much more difficult time accessing that data in the first place.
    ORIGINAL COMMENT:
    Lawyer here. For context on the Fourth Amendment issue. If the Supreme Court were to rule that police using geofencing data was barred by the 4th Amendment, that doesn't necessarily mean that they will stop using it to locate suspects. It does mean that they will not be able to use that evidence in court, which is still a huge win for protecting our rights.
    I did lots of research into the 4th Amendment in law school, and it is scary what police can get away with, despite it being unconstitutional. For example, if the police broke into your home without a warrant and found evidence of someone else committing a crime, the police could use that evidence in court against the other person (but not you), and you may have no remedy under the law for the violation of your rights.
    EDITS as of 8/15/2024:
    Fruit of the poisonous tree (Wong Sun doctrine):
    Some are bringing up the Wong Sun doctrine regarding fruit of the poisonous tree (i.e., evidence resulting from an illegal search is inadmissible). This does not rebut my illustration above. In the Wong Sun case (simplified), the police found drugs as a result of an unlawful search of Toy's laundromat. The drugs were inadmissible with respect to Toy because Toy's 4th Amendment rights were violated, and the drugs were found as a result of that violation (i.e., Toy was the victim). However, those same drugs were admissible against Wong Sun. To quote, "The seizure of this heroin invaded no right of privacy of person or premises which would entitle Wong Sun to object to its use at his trial." (371 U.S. 492) In other words, drugs were admissible in court against Wong Sun despite being a result of an illegal search against Toy because Wong Sun's rights were not violated in the illegal search.
    Clarification:
    When I say the police find evidence of someone else committing a crime in your home, I mean they search your home and find evidence that someone else committed a crime generally. Not necessarily that they found someone actively committing a crime in your home. However, either way, if that person has no reasonable expectation of privacy in your home (e.g., they are not living there), then their rights are not violated, and the evidence would likely be admissible.
    Remedy:
    When I say there is no remedy, I am talking specifically about vindicating your right not to be searched illegally. You may have a remedy for damage caused to the home (may depend on jurisdiction), but as far as vindicating your rights not to be illegally searched, there really is nothing beyond making any evidence against you inadmissible. This should give police no reason to search your home illegally as it would be useless for doing their job. However, if they did search your house illegally and find nothing on you, then there's really nothing you can do. So for the geofencing issue, police could still use it outside of court if they wanted to, but they would not be able to use it or anything that is a "fruit" of the geofencing issue in court. You would have no remedy for them knowing you were near the crime scene aside from having it dismissed in court if it got to that point.
    Note:
    I'm happy to engage in conversation, but I am not interested in engaging those who mistake ad hominem for legal analysis.

    Things i will add to the india case: is the state government and local authorities are actually doing absolutely everything to sweep this under the rug and cover up as much as possible. Its been suspected that the principal of the medical college was involved in the crime and its part of the larger R-'culture' at this college. the government, initially put him on a paid leave and then, simply transferred him to another college and the Chief minister Praised him?!
    Forensic reports say She was treated in a horrifying manner (her pelvis was broken, her spectacles crushed INTO her eyes) in her last moments and there were definitely multiple perpetrators. Yet when one man casually accepted charges and proclaimed he was the only perpetrator, the police happily accepted and tried to close case. This is after they initially tried to claim it as suicide!!! Suddenly, after it was announced that the CBI (indian equivalentof FBI) will take over the case from state police, thd college started "renovations" in the building, destroying the scene of crime.
    I just hope this can bring large scale reforms in the country. Doctors and women deserve to feel safe in their workplace.

    I suspect a lot of people critiquing Justin directing the movie do not know the work he has done challenging toxic masculinity. As a woman, I very much appreciate the important conversations he has on his podcast "Man Enough."
    I was incredibly excited when I found out he was directing the movie exactly because of his emphasis on needing to focus on why men behave in certain ways and understanding cultural norms rather than blaming women. With all the terrible rhetorical toxic masculinity stemming from the Red Pill movement, feminism needs men like Justin.
    Maybe there was drama on the set, I don't know. I will wait to judge until its more than speculation. I just don't like the idea of people trying to throw Justin under the bus after all the work he has been doing. I fear that type of response risks driving men to the Red Pill Movement rather than inviting them to participate in the feminist movement.

      Pregnancy centers don’t normally offer D&C procedures as that is an actual procedure that uses general anesthesia most states only offer those at hospitals so I’m sorry your niece thought she could go there… I’ve had two miscarriages and I’ve always had to go through a doctors office that has you go to a consultation before they will even do the D&C and never have I ever had any pregnancy center ever offer those services and just to clarify so you know better in general the best option for miscarrying is to miscarry naturally(speaking from my own infertility journey) D&cs also carry risks and can also leave scarring in your uterus that can make future pregnancies harder so it’s unfortunately almost always doctors recommended to naturally miscarry if you can

    The It Ends With Us situation is ridiculous. Colleen Hoover books always romanticize the worse types of relationships. I was a fan in highschool and once I grew up realized they were terrible because of that. To me it feels like Justin tried to use the book and movie to tell a good story and Blake wanted to make another girl romance movie. Justin had been trying to make the movie for a while and fought for it now it been taken by other people. Obviously we will never know what happened behind the scenes but criticizing the person talking about DV as serious as it is while defending the people making light of it is insane.

      When people who love this book attack survivors because we don't call abuse love, we ask about what kind of therapy or aftercare the characters received in this story of healing, or explain that the trauma doesn't just go away but becomes a permanent part of us, there is something very wrong with the message.

    I used to work at Raglan Road and they were always extremely cautious about allergies, having many trainings solely dedicated to allergy management. I’m shocked hearing about this news and really wonder what went wrong in their procedure. This situation is heartbreaking, even more so that Disney’s legal army got involved to add insult to fatal injury. My heart goes out to the family.

    So when I chose to have one I expected a serious depression to hit me, but all I felt afterwards was the absolute certainty that I made the right choice.
    Now, years later, I still feel good about my choice.

    When I was little, I went to Disneyworld with my family. One of my family members has serious dietary restrictions, so they asked the waiter about having their food prepared a certain way. He stopped them dead in their tracks and left to get the head chef of the restaurant. My family member shared their dietary restrictions with HIM, and everyone's food was prepared exactly as needed. There were no issues.
    The restaurant Piccolo and his family went to should have done this for him and his wife, but I guess the waiter hadn't been working there long enough to know any better.
    Take care of YOURSELVES people! You got dietary restrictions? Don't talk to the wait staff, talk to the Head Chef.

      Dude. You should ALWAYS have your allergy medication on you if you're that allergic. No server nor cook is equipped to handle that high-risk of a customer. I'm not saying that it's in any way her fault, sounds like gross negligence, but the reality is the server is hired because of their affability and organisational skills. The cook is hired for their efficiency and capability to work under pressure. Nowhere are ordinary restaurants equipped to deal with extremely allergic people (hell, even Kraft aren't capable of making their ready to eat products allergen-free).

      Going by another comment in the section for context. Disney restaurants have one kitchen for multiple restaurants. This practice creates much greater risks and is implying that the kitchen does not have allergens present in the kitchen that are not on the menu, when in fact there are likely many present in the kitchen that the foods prepared in. Besides if any restaurant doesn’t want to be held responsible it is as easy as saying that they can’t promise that the food is allergen free.

    We'll find out what Judge is bought by Disney if they allow the company to win the case for the reason related to Disney+ terms. The insanity to follow if they do is beyond reason. That judge would indirectly be saying that a contract (e.g. terms of service) can literally be used to justify the killing of someone. Both "intentionally" and unintentionally, as intent is not necessary to look at. It's illegal to kill someone, but it's NOT illegal to avoid consequences doing so as long as said person accepted some arbitrary terms of service agreement to something completely unrelated. "Someone died partaking something in your establishment. Oh they agreed to a terms of service point that states they can't sue you because they bought a keychain at a Walmart 20 years ago that was made by your company? Checks out that they can't hold you liable then."

Both Disney+ and the service used for the tickets purchased point to the same arbitration clause, since it's all encompassing. Because it's the same clause, it ultimately doesn't matter what was used as Disney's defense, as they're all literally the same. I'd imagine purchasing something from the Disney store online points to the same clause. Assuming that's the case, signing up to buy a Winnie the Pooh doll for a kid will (in this hypothetical) apparently waive the ability to take Disney to court if the same kid dies at one of their parks, even if the corporation is at fault. That's just absurd lol. I get arbitration is to prevent absurd lawsuits, but being at fault for wrongful death is very different from being at fault for getting the color wrong on a toy.

    My fiancée did take the first dose and changed her mind afterwards. The baby did survive and is doing alright now.
    We went for a scan before she took the drug and she was 8 weeks along. So far we have not seen any side effects and any tests show she’s healthy. She’s our bundle of joy.
    I’m not saying it is always reversible but in my case she didn’t take the second pill and we pulled through alright.

    As a woman who was in an abusive relationship and has read the book in question, I can tell you that the book is a romanticized version of such a relationship. The author wrote it from the view of a child whose parents were in such a relationship and it is clear that she romanticized her father and saw the good in him. I find the book naive and offensive. I cannot tell you if the movie is the same, but I can tell you that the initial marketing implied the abuse and seemed to have that in the forefront, but later the marketing turned and seems to focus on the romance of the central couple. That I find offensive. This isn't supposed to be a story if love that faded it's supposed to be about an abusive relationship and the true implications of such, otherwise, what is the point?

    is the same thing physicists say about time travel.
