    MST victim PTSd, not suicidal…only 50 however, My C& P examiner kept saying that I was diagnosed with mild Sleep apnea My VA records says obstructive sleep apnea, VA conducted the sleep study while in my home, they gave me the diagnosis. This is a result of fighting in my sleep stop breathing, falling asleep at work, So why is the doctor (nurse practitioner) saying I see mild Sleep Apnea in your records. I only sleep 3-4 hours a day. Must use a CPAP machine.B/p was 197/153, 187/136, 179/119 on lisinopril 10 mg. The C&P exam was supposed to last 75 minutes, I peed in the examination chair because I couldn’t hold it. I apologize but she wanted to terminate the appointment and call 911 due to my high b/p. I told her I fight all night in my sleep sometimes I get to the parking lot at work and have to takeoff, haven’t been to work in 15 months due to another injury but had to take 3-4 hours a day because I needed naps and had diarrhea 3 to 4 days a week . Stomach cramps and I submitted negative hours of work Time and attendance to the VA and the C&p contractor. I will see what they say and give an update in 60-90 days

    I'm diagnosed with OSA, prescribed and using a CPAP, and want to file for secondary to PTSD MST. However my PTSD claim has been in the system since May. No C&P yet. I'm hesitant to file my Sleep Apnea claim until my PTSD claim is adjudicated. Should i continue to wait, or file now and hope I have my PTSD claim approved before I'm called to a C&P exam for Sleep Apnea?

      At the very least you can file an Intent to File. You have 1 year from the date of submission of the ITF to file a new claim and preserve your effective date. This will give you time to either wait for a decision from the VA and then submit your secondary claim, or proceed with filing your sleep apnea as secondary to PTSD. In most cases similar to yours, there would not be an issue with filing your claim now.
      Download an Intent to File here: www.va.gov/find-forms/about-form-21-0966/

    Would sleep apnea be related to a pact act?

    • @VADisabilityGroup
      @VADisabilityGroup  2 месяца назад +2

      Yes, it can be related to the PACT Act. The law expanded eligibility for veterans exposed to burn pits and other toxins during service. It presumes that certain conditions, included respiratory issues like sleep apnea, were caused by exposure.

    Has the new rating for sleep apnea gone into effect yet?

    • @VADisabilityGroup
      @VADisabilityGroup  14 дней назад

      There are only proposed changes to the sleep apnea ratings at this time. The current ratings are still in place.

    What if you’ve been on a sleep apnea machine for over 10 years, does the VA require you to use their machine? The people I work for pay for the machine and the monitoring, I’ve done two sleep studies in 10 years and I have terrible sleep apnea because of a near lightning strike back on active duty.

    • @VADisabilityGroup
      @VADisabilityGroup  2 месяца назад

      No, you do not need to use a machine provided by the VA specifically. They are mainly concerned with if the condition is service-connected. Although I have never heard of a lightning strike causing sleep apnea, if you can connect an in-service event to your condition, and have documentation of a diagnosis and ongoing treatment, then you have a good chance of receiving a compensable rating.

      @ at the same time the close Lightning Strike happened, I got knocked off a ladder which is in my medical record and injured my hip, and had to have surgery years later to repair my hip. I’m 10% service connected with tinnitus working on the flight line

    I've had sleep apnea since 2018 while a reservist... Activated in 2020 for COVID and caught COVID.. would I be able to claim OSA aggravated by COVID while on active duty? And get service connected due to aggravation?

    • @VADisabilityGroup
      @VADisabilityGroup  Месяц назад

      Possibly. From what you shared about your fact pattern, it sounds like you have a service connected condition that caused further COVID residuals than you would have experienced had that disability not been present.
      Here is a blog post from our website that goes into more detail about COVID benefits: vadisabilitygroup.com/covid-information/

    For some strange reason the VA added an unbeknownst to me an additional claim to my sleep apnea 1 week after being granted the 30%

      Thanks for the comment. Hopefully this "additional claim" leads to an increase for you.
