Greetings, I submitted a 256EZ for 8 conditions, VA just denied 6. Can I file an HLR for 3 and a 0995 for the other 3 simultaneously and keep my Effective Date? Also, VA requested that I submit an 8940 & 4192... I'm in my 60s sitting at 90% and haven't worked in 1.5 years. Your Insight Please? Thank You!
Regardless of the type of appeal form you use, as long as you are within your appeal date you will maintain your effective date. From the information you provided, the VA is requesting you submit an application for individual unemployability. You have not worked in over a year and you have service-connected conditions that cause you to be unemployable. Also, your condition percentage breakdown must meet the requirements to qualify for IU. This could be a reason they are requesting the application. Or perhaps you applied in the past and they want current employment information before they make a decision. IU is a great option for veterans that are unable to work because of their disabilities. If this is you, you should consider applying.

Thanks for the comment! We will definitely work on improving this. Sometimes it is hard to fit all the information into the short format and speeding it up helps with this. That being said, it can get a little out of hand.
Please check the latest changes to the VA Automobile program. If you are new to the program you can get a new car every 10 year but if you got the benefit before this new change you will have to wait 30 year before being available to get a replacement. I am blind with service dog and 100 percent disable.

2015 received service-connected ratings for 0% rating for left hip trochanteric pain syndrome (also claimed as bilateral hip condition) 0% rating for right hip trochanteric pain syndrome (also claimed as bilateral hip condition) 0% rating for left wrist strain, non-dominant (also claimed as bilateral wrist condition) 0% rating for left knee strain (also claimed as left knee condition) 10% rating for right shoulder strain, dominant Would that mean each of these because ratings, even if I have full range of motion, because the hurt and have pain, they should receive the minimum ratings in each join of 10% and 20% for the shoulder?
A lot forget to mention that just being diagnosed with a condition while serving can be direct connection
Establishing an in-service event is key. Having documentation that diagnosis took place while serving certainly helps.

AS A flight zDeck Director I was to take. Charge of any emergency like a fire if AFfpFF was to be huffed I was to apply it and now I'm told that causes cancer I have used this but I am lucky no cancer

I have served in the navy for 4 years I made three westpacs as a Flo Ight Deck director on the U SS Ranger I do have ptsd I have the same dream of loosing a F 14 over the side and the pilots waving by as they fall to there death and in their dream I am at fault again this was a nightmare I had in the navy I never lost a plane but I still have this dream night mare still I have suffered a brain anuresium I am disabled because of this I problem have hearing loss and I have acted reflux I can't get my VA home lone because of my low income and I'm told by the VA I falk through the cracks
Thank you for the comment. Based on what you have shared, it certainly seems that you have "fallen through the cracks". It is unclear where you are in your appeal process, but it might be wise to consult with a local VSO to assess your claims. There may be VA disability benefits on the table for you.
There is one thing that you ladies need to mention is that Disabled Veterans Can also apply for Social Security Disability Insurance. Find a law firm that deals with SS make an appointment and bring copies of your medical treatment records from day one as well as all your X Rarys MRI's and CAT SCANS. The cost of law firm I used $ 1,500.00 it comes off the top but it tax deductable. I used Shook & Stone in Las Vegas Nevada.

Yes, you should still be able to receive the property tax exemption. However, we still recommend that you reach out to your local tax assessor for the most up-to-date information regarding the application process and specific requirements.
Thanks for the Info. I was examed in 2004 as a Gulf War Vet and the Examiner stated as why I had no PTSD or Sleeping problem was because He couldn't use the DSM-lV rating? He noted that I did, in His opinion have a SCL90-R 1.87, PSDI 3.0, IES-R 2,42 and BDI 21 and that I "didn't mention any sleep problems, but stated I couldn't sleep past 03:00"? Is it possible that I have a case for review or backpay? I've been given a 50% benifits rating for PTSD finally this year after going through therapy although I mentioned it in 2004, 2021, 2022. I would appreciate any info You can give. Thanks again for the Info. Unfortunately the VA and C+P Examiners were working against the Vet back then. I've suffered 30+ years with Depression and Sarcoidosis, swollen Lymphknodes but due to the Old System not recieved any compensation. Things have to get better. It seems that the VA will Deny until the Vet DIES.

Your recent diagnosis and treatment for PTSD provide additional evidence to support your claim. It might be wise to seek assistance with appealing your claim. Make sure to pay attention to your appeal window so that you do not miss it. You have 1 year from the date of the decision to appeal. Also, continue to gather medical treatment records and receive treatment for your mental health. Keep a symptom log, as well. Hope this helps!

@nixpixmusic What about BACK PAY? I had been denied for many years and attempts.Then,they finally gave me what I deserved.100 percent. But, they only paid me 2 months back from my last attempt. I have seen where vets like me had received this benefit from the DATE IT HAPPENED. Not THE DATE IT WAS FILED FOR THE FINAL ATTEMT. WTF. Why do they do this to vets who risked their lives for their country and get screwed up for life? WHY? I deserve pay. back to 1976. When this all occurred. And the way the VA treated me was unbelievable. For instance. I went to SAN FRANCISCO VA for my back injury . I go there and they tested me for HEARING. Months later I get the letter from the VA stating that they didn't find any hernia on me and I was denied. WTF. 1 month later. I had DOUBLE HERNIA SURGERY. I really messed up trying to save another vet from the tail of an APC coming down on him in GERMANY. I was uneducated on APC ,because I was trained for COMMUNICATION TECHNICIAN. The U.S. ARMY made a big mistake on my MOS . And I'm paying for it in pain and agony ,because of their mistake. I was trained to be the person that repairs the communication equipment in the field. Instead ,they made me a tank operator in the communications field . And I would troubleshoot and (NOT REPAIR) these bad equipments. I was to send them to what my job should have been. A 31b10. COMMUNICATION TECHNICIAN. I was even at FT. SILLS OKLAHOMA for the additional training of AIT 12 WEEKS ! And I had a guarantee to go to FT. ORD,CALIF. for my permanent duty station. WTF. They sent me to GERMANY. And it took weeks for my family to find out where the HELL I was. So, I have many more issues with our U.S. ARMY. Abd have been dealing with this through the worst of suffering times my whole life. SAD BUT TRUE. OUR GOVERNMENT DOESN'T CARE ABOUT THE TROOPS WHO PUT THEIR LIVES ON THE LINE, SO EVERYONE ELSE CAN KICK BACK AND RELAX AND DO WHAT EVER THEY WANT TO DO. WE ARE THE MAIN REASON WHY THEY CAN DO ALL THOSE THINGS. AND WE DESERVE.WAY,WAY,WAY BETTER. YOU'RE ALL HERE. BECAUSE OF US......
What if you’ve been on a sleep apnea machine for over 10 years, does the VA require you to use their machine? The people I work for pay for the machine and the monitoring, I’ve done two sleep studies in 10 years and I have terrible sleep apnea because of a near lightning strike back on active duty.
No, you do not need to use a machine provided by the VA specifically. They are mainly concerned with if the condition is service-connected. Although I have never heard of a lightning strike causing sleep apnea, if you can connect an in-service event to your condition, and have documentation of a diagnosis and ongoing treatment, then you have a good chance of receiving a compensable rating.
@ at the same time the close Lightning Strike happened, I got knocked off a ladder which is in my medical record and injured my hip, and had to have surgery years later to repair my hip. I’m 10% service connected with tinnitus working on the flight line

BELIEVE IT OR NOT TO THIS DAY AT SIXTY TWO NOT ONLY IS IT EVERY DAY DOCUMENT. WITH THIS ALL BEING SAID SHOULD I REQUEST ANOTHER C&P EXAM?
Based on the information provided, we would be very cautious about adding additional conditions when you are already receiving a 100% P&T rating. Your care remains the same, your benefits remain the same, so if the only goal is to have your knee noted as being service-connected, there is no real added benefit to you. Plus, opening a new claim, or reopening an old one, often brings unwanted scrutiny to an already good rating. Proceed with caution.

Yes, you can claim both IBS and hiatal hernia as separate conditions for VA benefits. The VA considers each condition individually and assigns a disability rating based on the severity of the condition and its impact on your daily life. This is not considered pyramiding, as each condition is evaluated independently.
I wish I would have seen this before and had someone to help me with this. So much of this is me. I was told not to worry about evidence or a nexus until after first attempt. Would love to find someone in the Houston area that I can meet in person. I have such anxiety I have was not able to submit my claims on my on. And still need to get evidence, I actually have been in a care type facility and saw a psychiatrist about 8 or 9 years ago. I do have service connected tinnitus also .
The filing process is complex and can be frustrating. Sorry you have had a negative experience. Having an attorney that you can meet with in person is often a comfort to veterans. There are capable individuals in your area, just do your research and we are sure you can find something.

My Dad is 100 p&t for MD alone with a verity of other problems for over 20 years. With a&a and K, he has a Nurse, a OT, a PT, and a PCA. He's has been diagnosed with TBI. The TBI is new, but not service connected. His in service medical records prove that he went to sick call for the TBI related problems that he is complaining about. Some of those injuries are service connect and some are not service connected. But, of the ones that are not, he has them as medical complaints during his active service. His head injury happened during his active period. A VSO said that it's too late for TBI to be added or even separated from his MD because it has been so long. So can he not reach SMC R2T even if he qualifies for it via the VA's own regulation? Or was the VSO correct?
It's concerning to hear that the VSO may have given incorrect advice regarding your father's potential eligibility for additional VA benefits, particularly given his existing 100% P&T rating and the newly diagnosed TBI. While it may seem counterintuitive to add a new condition to an already 100% P&T rated veteran, it's possible to achieve a higher level of benefits, specifically SMC R2T, if the new condition, in this case, the TBI, significantly impacts the veteran's ability to function independently. If the TBI can be directly linked to a specific incident or exposure during military service, it can be considered service-connected. Or, it may be presumed to be service-connected if they occur within a specific timeframe after military service, especially if the veteran served in a theater of war. The severity of the TBI and its impact on the veteran's overall health and functioning will be crucial in determining eligibility for additional benefits. The TBI may exacerbate existing conditions or lead to new disabilities, which could increase the combined disability rating. It might be wise to seek a second opinion from a different VSO or VA representative. Explain your father's situation in detail, including the evidence of his TBI and its impact on his daily life. If necessary, file a new claim specifically for the TBI. Provide all relevant medical records, including those from active duty, to support the claim. Keep in mind that any time you file an new claim, it does bring scrutiny to the case. And with the VA, there is always a risk for this to have a negative impact, so you will need to weigh the pros and cons carefully.
Is your Dad getting Special Monthly Compensation? If not you can appeal the TBI and Request Special Monthly Compensation. So you know, Special Monthly Compensation (SMC) is over $8000.00 a month besides is 100% Rating. Lets say $3740.00 for 100% plus $8000.00 Plus for Special Monthly Compensation. That is over $11,700 per month. Don't let the VA Short-Change your Dad. SMC Covers additional expenses related to the care of your Dad, which include, fitting a Car to accommodate disabilities, Rooms, Meals, Special equipment, Travel Arrangements, Service Attendant etc.
Seeking medical care from a VA medical center CAN be considered a claim for service connected compensation.
Seeking medical care at a VA medical center does not automatically constitute a claim for service-connected compensation. While seeking care at a VA medical center can be a step towards potentially filing a VA disability claim, it is not a formal claim in itself. To file a formal claim for service-connected compensation, you must submit a VA Form 21-526.

Thanks for these videos. I'm starting the process and while the VA claims to help with the process, its like asking the IRS to help file taxes. Its one thing to have a diagnosis with something and another to file with the VA about it; there is a good, better and best way and I think part 9 of this video was the most helpful and I'm starting this process today. How are they testing these different faucets, Memory and such?
VA examiners typically use a combination of methods to assess TBI. They will review medical records, looking for previous diagnosis of TBI or accidents or injuries that could have led to a TBI. The physical exam assesses neurological functions like balance, coordination, reflexes, and sensory perception. They may administer standardized tests to help with this assessment. And they may do a mental health evaluation. This will all vary depending on the individual and the severity of the TBI.

Nope, it's not too late. Remember, these are proposed changes. No changes have been made to sleep apnea yet. In fact, if you file now, you would fall under the current criteria, which is a 50% rating with the prescription of a Cpap.

What if I’ve been seen for constipation from all the medicine that they prescribe me? Is this something I can claim for IBS secondary?
Yes, you can potentially claim constipation as a secondary condition to your service-connected IBS if the constipation is directly caused by medication prescribed for your IBS. You'll need to provide medical evidence that clearly establishes the link between the medication, the constipation, and your service-connected IBS.
I opened 2 Claims with the VA, they went and combined my claims. I argued that each claim are regulated by its own Code of Federal Regulations and all have separate DBQ's. By combining these, they are preventing Injuries from being properly evaluated. The trick VA is using is not to deny the claim but to simply closed the Claim and attach/combine evaluated symptoms into a Single Claim although they are evaluated differently.
Based on the information you've provided, you may have grounds to appeal the VA's decision to combine your claims. Here are some potential arguments: Violation of Specific Regulations: Argue that combining the claims prevents the VA from applying the correct regulations and rating criteria for each specific condition. Cite specific regulations and DBQs that apply to each condition and how they differ. Impact on Disability Rating: Demonstrate how combining the claims could potentially lead to a lower overall disability rating. Explain how each condition should be evaluated separately to accurately assess the combined impact on your overall health and functioning. Procedural Errors: If you believe the VA made procedural errors in combining the claims, such as failing to consider relevant evidence or applying incorrect regulations, you can raise this issue in your appeal. Best wishes! You can start treatment now and begin to build your case by keeping symptom logs. That way, even if you get denied down the road, you are already beginning to build your case for appeal.
Esophageal stricture is bullsh*t. I have GERD and have severe epigastric pain which is a symptom. Also I have acid reflux where I throw up or literally squirt out stomach contents in my mouth or out of my mouth. The esophageal stricture was obviously implemented to it deters from veterans from claiming it. You can have GERD/acid reflux without having esophageal stricture and still be severe.

Talk about till it’s beat to death. But I don’t see anything show if the cases where tie, that we can then bring to anyone attention to rectify the denial, so it’s all well and good to know this but no where in any case file tells that the case was that close, or be able to sue the federal government over these issues. The government has and always will try to save money and incentivize the act of saving money by denying cases. They will lie or put the blame onto someone else or on the veteran, just like lawyer will lie or view a potential case as not profitable.

I just saw your website, can you explain what additional a/a spouse means?
That is an additional benefit amount that can be awarded if the veteran's spouse receives Aid and Attendance (A/A). My big hang up and I can’t get a definitive answer from people, but you as a lawyer could possibly help. It’s people with PTSD and depression and the big “S” word. I have thought about the S word many times, but I’ve managed to power through it. Now here’s the big dilemma. My golfing or bass fishing or whatever is going to the range and target shooting and trying to get a better score each time constantly challenging myself. But now sitting in the room with a C&P examiner, and I’ve already related about the S word and now I mentioning firearms. Where does the red flag laws or policies or whatever the hell they are, where does it go with that?
Hey brother, you're not alone and I've been where you're at before. In my experience I've talked to the VA therapists about this exact thing and they can't touch your g*ns unless you've explicitly stated you're going to "S" yourself or hurt someone else. I 100% get the anxiety that comes with talking to therapists and the subsequent "they're coming for my g*ns," but a CMP examiner would have to have some explicit and exigent reasons to make a red flag or emergency order on medical grounds to a judge for you to be in that situation. Raters typically rely on the medical evidence you provide them in your record. There are some instances where the will request additional medical information before they will make a decision, but you will be expected to provide that to them.
