    Well done to the driver of the blue van for helping provide protection to the injured cyclist by parking his van at an angle. At least in that way he protected the cyclist and by angling his van even if someone collided with his van it wouldn’t be pushed into the scene.

      I was in similar situation 20yrs ago, and I used my vehicle as a shield. Props to the van driver; regrettably my chap had cut himself in half on a road sign, so all I could do was pray for a kindly judgement on his soul...

      That car was effectively a lethal weapon driving like that. As long as the law continues effectively let drivers get away with this behaviour they will continue to drive in this manner they effectively just got a slap on the hand not going to deter them in the future and soon the driver is back behind the wheel, then it’s back to jumping reds and speeding until the next victim

    BMW driver was speeding for sure and classed as reckless driving, but the cyclist clearly started crossing when the traffic light was still green.

      Light was amber at 0:56, turned red at 1:00 and cyclist entered road at 1:03 by which time the BMW had jumped the red light. Cyclist may not have made adequate observations but the BMW driver was definitely in my opinion guilty of driving without due care and attention and also dangerous driving based on excessive speed for road and weather conditions as well as running the red light. Had the BMW driver complied with the requirements of the Road Traffic Act the collision would not have occurred.

      The dashed lines are placed at 9m centres, the BMW driver passes 3 of these in just 0.6s (measured frame by frame). That means his speed was 45m/s, approximately 101mph. In a 40. 2.5X the speed limit. Peoples don't anticipate that kind of speeding. You wouldn't tend to expect someone doing 75mph in a 30 for example.

    British people are kind and compassionate as we can see the others stop and block the road in order to rescue the cyclist. I was an overseas student in the UK for 4 years during the 80s. I love England.

    The postman did cross when the lights were green. He probably rides that route 6 times a week. He saw the lights before were red, car stopped, so crossed. Didn’t see the BMW had run the red light.

    Too much of this going on, i drive for a living and see it half a dozen if not a dozen times in my work day. Why has red light jumping become a thing, do drivers think they are clever flouting this law? Its not a difficult one, light on red stop, light on green go. It really is that easy.

      You didn't mention the amber light preceding the red which people seem to have also forgotten means "stop if you can". They seem to think it means "You have 4secs to get over the line before you're breaking the law although you can ignore the law totally if you know there's not a camera".

      Sadly, both the BMW driver and cyclist are to blame in this instance it would appear...
      Firstly, the BMW ran a red light and was correctly punished for it.
      However, having committed that crime, he wasn't at fault for hitting the cyclist as he (the cyclist) must also have 'ran a red light' across the pedestrian crossing as the lights, at that point, were on green in favour of the BMW driver.
      The BMW drivers speed obviously played a part in the whole thing no doubt but the cyclist did cross when he shouldn't have.
      Hope he made a full recovery however, I'm a cyclist myself as well as a driver of over 50 years and this sort of incident is always just around the corner with the poor attitudes of some (not all) of today's drivers.

    Hi Danny - I totally agree with you, the cyclist is 0% to blame in this case. Those waiting to cross at a pedestrian crossing do not have to wait for a green light to cross if the road is clear, they do not ' jump the red light ' as some others have commented. The time between the red car stopping ( on amber I think ) and the BMW going through the red light is approx 2 seconds. The cyclist, seeing the red car had stopped and the lights at red, would have assumed that the BMW was stopping. I don't believe that the cyclist's view of the BMW was obscured by the red car. Had the BMW been travelling at the speed limit and ran the red light the cyclist may have been able to make the decision not to cross, however the BMW closed him down so fast he had no chance to make that decision! Excessive speed kills. I have been driving for 53 years now and have learnt that as a driver ( and pedestrian ) to never assume that others will ' follow the rules or abide by the law '. The cyclist made the mistake of (reasonably)assuming that the BMW would stop at the red light - lesson learnt .

    The truck must have been doing the 40 mph speed limit, that BMW must have been around 80 mph, Ran the red light and almost killed someone, he needs jailing and a life time ban. Hope the postman dose make a full recovery,

      Observation. BMW driver barely missed the first light but had green on the second light. At 1:18, still a red light for the crossing cyclists but elected to step in front of an approaching vehicle? At 1:20 with cyclist on the surface, the crossing light is Amber. The cyclist did not look to see approaching vehicles nor waited for the pedestrian light turning green, otherwise he would have not stepped into the roadway. When I drive, I often see people in crosswalks doing the same insane move! They wait for pedestrian sign to signal to cross never looking for approaching vehicles that are not stopping. This accident happened in a peculiar intersection. First a vehicle intersection then just barely down the road a pedestrian crossing. I noticed the signal lights did provide time for vehicles crossing on Amber or stale green light to proceed on green on the pedestrian crossing. As estimated, speeding is seldom a wise option specially with wet conditions. Two wrongs created this unfortunate accident.

Stop defending stupid dangerous driving and trying to apportion blame to the cyclist which is abundantly clear isn't needed because they clearly weren't at fault, I think your American, in the UK pedestrians and cyclists get more protection under UK law because of their vulnerability. The cyclist was not at fault here

    The pedestrian crossing signal was still showing green to the road users when the cyclist crossed the road. It doesn't excuse the BMW jumping the red light at the first signal, but the cyclist should have waited for the pedestrian signal to give him priority before crossing the road.

    The root cause of this accident was the BMW speeding in the 40 limit; if he was driving to the limit he would have been able to stop in time at the traffic lights.

    Raining, BMW speeding and undertaking at traffic lights, cyclist crossing road - new highway code ruling regarding vulnerability of road users. Court obviously put the full blame on the vehicle driver, not just to get a ban and fine, but also unpaid work and a driving test resit. Correct result, CPS would not prosecute otherwise. Hopefully driver will learn from their error. Hopefully cyclist will make a full recovery. Pretty horrific to witness, thank goodness not fatal. Mitigating for the driver, at least they pulled over and stopped.

    As a pedestrian using multiple sets of crossings, I'd say I see this 80% of the time the lights change to red. Red light running when they've just changed to red is actually more common than people stopping. There's just no excuse for it, these people need to stop being c***s.

      The amber light comes before the red and amber light means STOP.
      So a driver crossing on amber is commuting an offence. Red comes 2 seconds after amber so there is no leeway.

    Driving like that deserved more than a fine and a ban, it was down right dangerous, no hazard perseption, excessive speed, poor road conditions, and though it will increase their insurance, it needed a shock to hit home and also give their friends something to think about, not just a ban and a retest.

    Would not surprise me If the cyclist saw the red car stop at the lights the blue BMW a long way from the lights assumed it was safe to go not expecting the tool in the BMW breaking all sorts of road laws to run the light and with the speed he was going as it looks like he speed up towards the lights sfater he started to cross at that speed he had no where to go except get hit, needs license removed for life as do all the idiots who drive like this, its a privilege not a right to drive until the courts start to really deal harshly with this sort of thing it will never change

    The worst and most dangerous drivers on the roads are young asian guys, like these. They've got no regard for the rules of the road as if they don't apply to them.

    Whilst the BMW driver was going too fast (what’s new?) and should definitely have stopped at the red light, the cyclist presumably has eyes and ears and should have stopped, looked and listened before crossing. Also, it looks as if the set of lights he crossed at were green for the BMW, so he should not have been crossing anyway. So both are at fault as far as I can see.

      he got away with "a slap on the wrist" and should have been punished much harsher...
      the cyclist did absolutely nothng wrong, had a green light and with an A-road you hear loud motoring noises ALL OF THE TIME!

      i happen to cycle far more often than i drive a car, i currently don't even own a car so i use the cars of friends and family when i have a real long commute to make (which is no problem in the Netherlands, but seems to be a problem in the UK)...
      i absolutely hate drivers like the one in this BMW, they endanger everyone on the road!!

      @@ingeposch8091 Watch the video closely. The BMW speeds over the first (red) light, but the second (decisive) light is still green at the time of collision. Or in other words: The cyclist's was red. That the accident happened because the BMW was way too fast is only a part of the truth.

    Maybe the BMW driver would have got a bigger sentence if the cyclists had not been particularly to blame. He is using the Toucan crossing when the light was against him. Cyclists need to take responsibility for their own safety. 😳🏴󠁧󠁢󠁥󠁮󠁧󠁿🇬🇧🤠

      ​@@raftonpounder6696 On a 40mph road the BMW was doing a minimum of 61 mph and probably closer to 70. (120 yrds / 4 seconds). Had he been driving at the correct speed he would have arrived at the pedestrian crossing 2 seconds later and the cyclist would gone on his merry way. He also had at least 5 seconds to react to the changing traffic lights.
      I am not saying the cyclist is completely innocent. They should have read the road conditions better. In terms of fault it lies 99.9999999% with the BMW and had it been 3 months later it would lie 100% with the BMW. Add to that, there looks to be an automatic filter for the pedestrian crossing (I have no local knowledge of the A580). The cyclist could easily made the assumption that it was safe to cross.

    Posties no longer use bikes. The bike was a privately owned cargo bike, a Surly Big Dummy. It’s a big heavy solid thing that would probably have saved the rider from more serious injury, and rendered the bmw unable to make off.

    To those who say it’s the cyclist’s fault, they may have made a mistake by way of an error of judgement caused by the seriously excessive speed of the beamer driver.

    As far as I can see, he jumped the first red light but had the lights with him where the accident took place. You can try to make out it was his fault but that wasn't his fault. If you go through an orange light you haven't broken the law.

    The BMW driver clearly jumped the first Red light and was probably well over the speed limit. Having said that the cyclist also crossed ignoring the little Red man. Thus they were both at fault.
    Drivers need to remember the Amber actually means STOP. Not speed up to avoid the Red. And Pedestrians 🚶‍♂️ and Cyclists 🚴‍♂️ need to remember that that the little Red man means Do Not Cross.

      Not victim blaming, this was clearly homicidal behaviour on the part of the car driver, but was that actually a TOUCAN CROSSING? I can't see a cycleway marked adjacent to it and If not it was a PEDESTRIAN CROSSING and the cyclist should have dismounted, regardless of the colour of his lights.
      Had he done so, he wouldn't have changed the circumstances in front of the stupid BMW driver, so quickly and it might never have ended as it did.
      Yes BMW at fault. But on a very minor level of culpability (if it wasn't a TOUCAN he used); how much care of himself was the cyclist taking?

    It might be worth mentioning that the BMW driver's insurance will have paid compensation and other expenses to the cyclist, and that once the BMW driver does finally return to the roads he will face astronomical insurance costs, very high excesses, and he'll also probably be forced onto a telematics "black box" based policy. Insurance companies use these methods to stop dangerous drivers returning to the roads even when the police are pretty much powerless.

      I always wonder about that, but drunk drivers get reinsured, I heard for about £5,000. I believe that the circumstances for a life-ban should be much less than they are, very poor drivers are very likely to cause serious injuries. Maybe there should be a 3 serious offences and you're out policy, I mean as in drunk/dangerous driving etc

The cyclist obviously thought that he would, just like the other car which had already stopped there. 100% the BMW driver's fault and he deserves prosecution for the offence "causing serious injury by dangerous driving", or just "dangerous driving" (depending on how serious the injury was).

    The BMW is totally in the wrong and an arsehole and ran the first set of lights that were red and against him and he was speeding, but the second set where the accident happened were green for traffic and red against the cyclist.

      He crossed because there was no traffic on any of the lanes going ahead because the set of lights the BMW jumped were on red! The only vehicles were those waiting to turn right and nothing was merging from the left. He wouldn't have been able to prejudge that some twatty BMW driver was going to jump the lights. But no, lets blame the cyclist as per usual rather than the male ego driving the BMW.

Iimagine they were also able to analyse the video and prove he was speeding, which would cause a person crossing to misjudge what time they had to cross, or not even have seen the car. It isn't an offence that I know of to cross a road on a red man.

      Light was amber at 0:56, turned red at 1:00 and cyclist entered road at 1:03 by which time the BMW had jumped the red light. Cyclist may not have made adequate observations but the BMW driver was definitely in my opinion guilty of driving without due care and attention and also dangerous driving based on excessive speed for road and weather conditions as well as running the red light. Had the BMW driver complied with the requirements of the Road Traffic Act the collision would not have occurred.

    The adjoining street on the right, governed by traffic lights is Old Clough Lane. At the top is Manchester Road, where I was hit by a speeding car and Hospitalised in 1994. I wish people would have to take refresher driving tests every ten years or so. Would help keep idiots off the roads a bit more than currently.

    Totally agree the BMW driver jumped the 1st set of lights at red & far in excess of the 40mph posted limit but the 2nd set were at green when the cyclist started crossing the carriageway. They changed to red after he/she was hit & the BMW pulled to the left hand side of the carriageway. If the cyclists had waited for the safe to cross light or beeper it would be a different story. Both participants in this collision were at fault.

      If a pedestrian/cyclist fails to look properly and enters the road right in front of a speeding car they are clearly partly at fault. We can tell as they have broken highway code rule 7.

      Are you for real? There was a crossing at the first set of lights that the BMW drove through. Anyone crossing there would have been hit. Yes the second set of lights were green but the queueing traffic was in a right filter so natural assumption for the cyclist to cross. Also if the BMW did blow through the lights at 80, not much time for the cyclist to react. I guess the court made a different judgment on who was responsible.

      If he was unable to stop safely then he was not driving in an appropriate manner for the prevailing road conditions and having such a blatant disregard for the safety of other road users should result in a lifetime driving ban in my opinion. Strong measures like a lifetime ban is unfortunately the only way some people will take on board the message that driving in such a dangerous and careless way can result in fatalities.

    I think the cyclist seen the first lights go red (the set one the car jumped) and was thinking that his crossing set changed at the same time and so started across, however the the lights for the road at the crossing stayed green and the car hit him on a green light. So two wrongs do not make a right, The car jumped a red and so did the cyclist, both bloody idiots anyway.

      There are two separate sets of lights on different timings and @ 1:16 the cyclist starts to cross the pedestrian crossing and the driver has a green light, then 3 seconds later @1:19 they crash and the driver still has a green light 1:22 the lights turn amber for the driver. If you watched it on a phone you may not have seen the second set of light, but on a big screen you will and so they are still both bloody idiots anyway.

      Yes, mistakes from both. I suspect the cyclist regularly does this route and knows when he sees one stop he is safe to cross. Did not expect the BMW which was way behind to run the lights so long after they went red. Also, that was a 40mph limit. So he did not expect the BMW to get so close to him so quickly out of nowhere. Fair enough I think. Just shows we should always look twice as, there might be law-breaking idiots around, speeding and running red lights even in the wet.

    It's curious that there are numerous comments that attribute some fault to the cyclist based on they shouldn't have been there or should have looked better. The reality is that the driver was driving as if everyone needed to get out of their way. Their speed and manor of driving meant that if anyone did get in their way either because they were 'allowed' to or because they made a misjudgement a collision was inevitable. This is dangerous and perhaps if you also think that other road users need to out of your way then you are too.

      Given honest intentions many might well be exploring all aspects.
      Imagine if there had not been a cyclist on what is likely to be a pedestrian crossing. We wouldn't even be discussing it, except to call, the BMW driver rude names for driving like an idiot.
      I made the point above that being in the wrong place (when you can observe and plan not to be), when it all goes dangerously wrong, does indicate some usually very minor culpability.
      Given green traffic lights mean proceed with caution if its practical, for a car driver, then I'd expect other road users to be thinking the same way. (We know they don't but attention and adherence to limits usually sort that out).
      This is not to say that the BMW idiot was not totally to blame, only that pedestrians must also observe and assess risk, even if their light is green.
      e.g. Since 2011 special forces drivers have had the legal approval in law to exceed limits, run lights and if a death ensues they in times of national emergency or protection of senior people, cannot be sanctioned. (Police do not have these rights or protections).

    Looks to me as first lights crossed when red and is why the red fiesta had stopped some 4 seconds before the bmw got there. 2nd set of lights (the pedestrian crossing) were green so the cyclist would have been crossing while his notification was red. I can’t tell for sure if the bmw was exceeding the 40mph limit, though it does look like it. The BMWs guilt was jumping the first red and possibly speeding and that could be worked out by measuring time and distance. The cyclist must take some responsibility for not waiting until the pedestrian crossing lights had changed before crossing.

    The BMW driver is totally at fault, undertaki g the diver in the outer lane and jumping a red light. There seems quite a delay for the 2nd set of lights to turn red. This is a 40mph road so bearing that in mind the BMW driver must have been flooring it

    Red light jumpers are especially annoying when you’re pushing a grandchild in a pram or buggy. You’re about to cross and there’s always some idiot driver who will run the red light. Endanger their own lives by all means, but don’t gamble with another human-being’s, especially a baby or a child. 😡🤬

      I got banned to 9 months, 6 points and a £300 fine, for doing 120 mph on an empty dual carriageway, in good weather. Even the cop that caught me wasn't on the dual carriageway, he was on a flyover or something.
      Nobody died.

      @@fredmercury1314 well of course you would at that speed, all the road being empty does is reduce the amount of aggravating factors they can bring to bear on you in court, but it's rarely going to get you off with any speeding offence - what would have happened if there was a car ahead of you? Or one car happening to pull out and pass a slower one?
      you'd go to prison for years if someone died - grow up!

    Looking at this in slow motion and with the help of Google Earth, we can see that the lights went from green to amber when the BMW driver was 380ft (117m) from the intersection. At the speed limit, and even in the wet they could've safely stopped (as required by the Highway Code). BMW driver just f'ed up big time.

      typical cyclist IGNORE THE LIGHTS, BLAME THE DRIVER, reason he went is he saw all the traffic in filter lane stationary waiting to turn right, ASSUMED LIGHTS WERE AT STOP,, WENT WITHOUT CHECKING..
