    Anytime someone gets defensive about not opening the books to an owner means the other partner is stealing from the company. He most likely is pulling out equity from them. They are not all paid for. She needs to hire an audit firm to investigate the books or at least a CPA to review the books and lawyer up.

      Wow. Good call. I'm not a 'real estate' professional but I am a student of human nature. I believe, like you, that the poor woman's brother has 'dipped' into the value of the business and he's either ashamed or afraid to share that info because he's probably 'forged' her signature somewhere along the way.
      She's probably hearing her husband go on about her needing to "sort this s**t out with your brother" but he's not willing to get involved. So she's stuck between a rock (her brother) and a soft place (her husband).
      Look, she's called into the show because she's at a loss regarding what action to take. It's taken a decade and this is the furthest she's taken things.
      'Option Two', getting her brother to buy her out is no-brainer. I suggest she date and write the following... "Brother mine, I love you. You say I don't trust you when I ask for information due to me. Well actions speak louder than words and your actions are shouting from the rooftops that you don't love me, that's blatantly obvious. This deeply saddens me. So I've made a decision I should have made some time ago and my actions over the next seven days will be dependent on your Yes or No answer to my following question... 'When we inevitably enter the courthouse to compel you to buy me out, ALL financial details of the business will be revealed (by law), so my question to you is this. 'Would court-driven investigations into the business reveal you've done something that could put you in jail - Yes or No?' - If no, then come and talk with me, I forgive you in advance for any mistakes you've made regarding the business. If your answer is yes, then get a lawyer and face the music, as I can no longer bear the unreasonable stress you've inflicted upon me, my husband and the kids."
      She's welcome to create a variation of this note,or leave it as is, just send something to change the status quo because her brother won't.

      Truth. I worked in a camp office a few summers. I worked hard to get their charity Navigator score up. CFO said they were working on certifications but never finished. Turns out he was using camp money to fund his house.

      Dividends are not required by law, but shareholders should get some sort of payout at the end of the year if the company is in the green. Unless the owner decides to put retained earning back into the company, which is doubtful for ten plus years in business.

      Problem is her brother is pocketing all the money that's what it sounds like to me. Because if this real estate was bought from their Grandma it was probably bought 10 20 years ago so the values of increased along with rents at very minimum she should be receiving a check every month for at least $500

    Yes, Lawyer it up. Hold him accountable. Dividends need to have been paid out the whole time. He made cash flow, tax benefits, appreciation etc... FOR SURE HIRE A LAWYER!!! Show the Rental rates above mortgage payments and maintenance. He is keeping all the money

      If David gave his grandchild half a million dollars and someone kept them from it would he be so okay about it?
      If he gave his son keys to eight cars with the intent he distribute the keys to other family members would he be okay with his daughter not getting her key?
      If he gave Rachel the keys to the family’s supply room with the intent she distribute the stock to herself, his son, and his nephews and nieces would he be fine with her withholding from those he intended to provide some security for?
      I don’t understand his attitude. The woman has a right and perhaps an obligation to protect what was meant to benefit and provide financial security for herself and her own family.

    I think Dave is missing a huge thing, that while she doesn't have money tied into the business, she does have risk. If her name is part of this business and brother is doing something atrocious, there could be liability or at least reputation affecting issues at foot. I don't think her burying her head in the sand and staying blind but part of it is an option AT ALL.

      Also, you’re acting like she deserves 50% of the profits, but she’s not actually putting any effort into running it. If it was a passive income type of business, like owning a McDonald’s, that would be one thing. But a real estate business requires somebody to do all of the work themselves. So if they’re not doing any of the work, then they don’t really deserve to make much money from the business.

    I say go for the second option and make a RUclips video about it for us all to hear! Her brother is committing fraud and financial embezzlement against the other stakeholders and needs to be put in his place. He is no longer family with how he has been treating her. He needs a court order against him personally for the amount that was owed to her over all this time.

    Till to this day, I do not understand the point of "Equally" given shares, it will only cause chaos. I was in a similar situation, As the eldest, I was suppose to take over the family office with equal shares to my siblings, while I have to take all the burden of working fulltime, but my father lied multiple times and I had enough with his style of management and his people. I chose to set up my own group and take my own path. Lost of on millions on inheritance due to this but I came out stronger and more in control of my future rather than having to deal with people I do not trust.... the only thing I regretted was I did not tell my dad why I did not want to be a part of his group in his face before he died.

    Get an attorney, bring a claim against the brother..(He’s done with you anyway). Make him an offer during the initial conference, demand discovery of EVERYTHING, get a professionals auditor, and take what is yours. If you don’t want it, give it to charity.

      You're right. The whole "you might lose your brother" thing is crazy because if he's been cutting her out of the money for 10 years then the brother was already lost to begin with. I'd lawyer up and get the cut. The guy clearly has no morals and doesn't care about his own family. He will only give it up if he is forced to.

    Geez lady, get a lawyer and Demand or sue your brother for transparent access to the financials and get your share. You may need a forensic accountant to really see where the money is. This is what lawyers are for. I bet the brother has been lining his pockets with the cousins and his sister’s share of the money. He may even have transferred some of the money to his wife in order for it to be untouchable. This is a tactic some people use but it definitely is within reach of the law. Being a doormat gets you walked on. This lady should go see a therapist and learn how to take what is her own. This Story disgusts me, but the cause of the problem rest squarely on the squirmy shoulders of the doormat.

      Years ago, my father and his two brothers inherited the family business. My father immediately asked to be bought out and walked away. A few years later, both this brothers were so in debt one of them had a breakdown and the other lost his home. It was a valuable lesson to me and my siblings.

    She sounds like she doesn't know, is unwilling to learn, and wants to know what she's entitled to... she's probably gone about it the wrong way by asking through her former employer or whomever and seemed greedy causing the misunderstanding... she should be entitled to her percentage no matter what that is, but she also owes them to go about it properly and understand what she is actually entitled to. They can try to explain it to her, but they can't understand it FOR her. She claims to be a teacher but seems unwilling or unable to educate herself.

      I was just going to say the same. Unless it's a C corp, which I doubt, she certainly must have been receiving a K1 each year for her share of the annual activity. Find out who prepares the return and get a copy of the return. She's an owner, she can get copies if she wants.

      I would hold a family meeting without the brother. Women have always been easy to exploit because they typically value relationships and family over money. They tend to be more passive and peace at any price. There is NO WAY SHE SHOULD walk away from this “found money” That suggestion was disrespectful for her grandmother’s wishes and this woman’s long term financial wellbeing. It also reinforces these stereotypes about women and money and REWARDS THE BULLY!

    I’m a notary closing agent and I would bet he has cash out refinanced every one of these properties and if they were paid for he probably went and got a HELOC or 2nd mortgage. He probably wasn’t collecting rent during COVID bc of moratoriums and has been living off the the stimulus packages that provided benefits to plenty of landlords. I have had multiple clients do 2 refinances in 2021 and one client did 3 refinances in like 9 mos. I would bet everything I have that he has pulled out all the equity and cash he could from this home and is living high off the hog. He probably got one of Granddaddy’s buddy’s to notarize a POA or put the property in a trust (via a title co) so that he doesn’t need all 7 ppl there during closing. Nothing would surprise me anymore🤷🏾‍♀️

    The problem with letting him continue to just "run" the business and NOT tell you anything....if he runs up a bunch of debt or breaks laws and her name is on the business as a part owner...then will she also be legally liable? Anything that he has to pay immediately...will he then want to divide that by all the cousins/siblings? Would she want to be responsible for those bad choices because her name is on it? eeks!

    Huh!?!? If these are income producing properties, whose been reporting income to IRS & paying taxes on the income?

    She needs a buyout. A CPA firm can value the business and the judge can uphold the decision for the buyout. All is well and done. Get a CPA firm that is an expert in valuing companies and they will get it done.

    I don't think we're getting the full story here by any means. What would the brother say if he was to be interviewed I wonder? What do the other six cousins know or think about this? Are ALL of them in the dark? Seems unlikely. And the business kicks off zero cash to each cousin and yet nobody has taken action to get answers? I suppose it's possible, but definitely weird. At a minimum, I suspect that the brother syphons off as much cash from the business for himself as he can. And if he's doing all the work, he may feel justified in doing so. At worst, he could be refinancing the properties as they have gone up in value and using the money as a slush fund to provide a lavish lifestyle for himself. That would definitely explain his reluctance to provide any details about the business to the other partners.

    When you are conditioned in your family to submit and don't try to ask questions, you sense you should have rights but question yourself. Piling on insults doesn't help her. Similar thing happened to me as a teen. As I grew and understood what happened I was infuriated but I was told the statute of limitations expired...too bad for me and my kids. Not so sure!

    I don't know if that's public information, but as an owner she's certainly entitled to see what was filed.

    There’s three sides to a coin. Heads, tails and the side edge. The truth usually lies somewhere on the middle. I heard the brother has his own business aside from the properties, the sister has no clue about business and the grandmother is still alive. How does anyone on the outside know if the brother wasn’t entrusted to manage the properties until death and the rents go to sustain granny until her passing? No mention of a living trust or anything. I learned long ago, If it’s not in writing, it doesn’t mean Sugar, Honey, or Ice Tea.

    This is an example of a passive agreeable person who has struggled to not allow people to walk upon her her entire life. I have a 9 year old daughter who has some of these traits and you better believe I'll be teaching her how to be assertive.

    I don’t like the structure or lack of structure to family companies. I used to work for one. They prefer their own family and in some cases they can take advantage of family members and if you’re not family they treat you like family. It is better to have a business relationship with your coworkers and boss.
