We need more landlord / tenant LAWS . A new landlord bought my property and now he is giving old tenants a 30 days notice to vacate for remodeling. I don’t feel 30 days is fair. Most rental places have a 6 to 12 month waiting list . It’s sucks because he automatically puts people on month to month after a years lease . He doesn’t renew leases . I feel most Landlords don’t renew leases cause it makes it easier for them to turn people over .
Kevin, I agree that it is really tough to find a decent rental. In a normal housing market 30 days was something that was tight but doable. However, in the current market finding a rental or even a house to buy is tough to accomplish in just 30 days. Many landlords and apartment complexes have waiting lists so the available options are few and far between - Sam
@kevinbennett36 I'm not sure I understand your need for more laws. You say you were in a m2m lease and LL gave you 30 day notice. That is right and in keeping with the law. What if YOU wanted to live somewhere else, so you gave 30 days notice that you'd be terminating and leaving? Can LL make you give him more time? Heck no. A m2m is a risk for both parties.
All too often a renter just doesn't grasp that a m2m works both ways. A tenant that wants to terminate doesn't have to give a reason- just give proper notice, and the LL just has to deal with it. But the same holds true for a LL- no reason required, just give proper notice and the tenant just has to deal with it. If either party doesn't like those terms, try to negotiate for other terms. But if that's unsuccessful, just move on and find more likeable terms with someone else.

My mom ask the land lord if he could give us extension he said “no!”It’s so dumb that he is doing this to us- if we did not find apartment or a house what would u recommend us do? This has become a serious issue and it’s a real challenge in most parts of the country because the available rental market is so short of available inventory. I would contact an attorney and see if the attorney can find a legit reason to get you an extension. There may be issues with your lease / notice to vacate. The most important thing is to aggressively look for a place to live while you are exploring your options with an attorney because you will have to move at some point - Sam
30 days sounds tough, but based on what you've said it doesn't sound like LL is doing anything wrong. Look at it this way: what if you had wanted to move elsewhere, and so you gave LL the 30 day notice. Could he say- NO! You're not allowed to move! Of course he couldn't. That's the risk of a m2m for both parties.

After living here for 3 years and maintaining ALL OF IT with rent always paid.... strangers came to my door the other day to tape a piece of paper to my door that I have 30 days to move. Called the landlords wife to see if this was a scam and she said of 2pm that day it was sold.
This just happened too me. Owner sold the home and I have 30 days too vacate and I have a dying dog and a father in hospice who lives in another state. How do they expect people too find a home in such a short period of time.
@@tsams1037 Those who do not have a lease are the ones that it is happening to the most because those houses are easier for the landlord to sell especially to a buyer wanting to buy the property and move into and live in the home.

The other thing that makes a 30 day notice to vacate challenging is that the available supply of housing to buy or rent is in extremely low making it hard to find a place to move.

How about if i was given a 30day notice to cure past due rent or vacate, but 4 days later in the same week they gave a 3 day notice to vacate, can they change the timeframe of a notice like that in ohio?
Hi Garrett, Thanks for commenting and you are asking a good question. I am not an attorney so I can’t give legal advice but I may be able to shed some light on your question. I have seen many cases where a tenant is late on rent and the owner requests the tenant get caught up. Then they call their attorney to ask about an eviction and the attorney says provide the tenant with an official 3 days notice to vacate in writing and to document it. They likely are doing this so that they can legally begin the eviction process - Sam
I would add from a practical perspective(not a legal one), it is REALLY REALLY rare to give a tenant 30 days to catch up on past due rent. Doing that, the LL continues to put himself at an even greater financial risk. Could it be you misunderstood the notice? Your attorney should be able to clear that up.
In Ohio what happens if I want to buy a home that has a month to month tenant and they don't leave before closing? Is their some type of way to put that into contract that if seller doesn't get them out before closing I can back out of deal? I don't want to inherent the problems of having to evict people, I just want to move in to my home.
Thanks for your question and comment! You have some options and it is a very good idea to address these concerns upfront and in writing. If the tenant is month to month you can have a provision in your offer that states that the tenant or tenants shall be given a 30 days notice to vacate the property and that your offer is contingent upon the property being vacant at the time of closing. You can also request a walk-thru period in your offer which is a good idea so that you can confirm that the tenant has vacated the property prior to you closing on the deal. She told me that the 1 property I really liked and we looked online has a tenant month to month and would like to stay if possible. She said their is all kinds of problems with this and she avoids these property's. I asked if we could have it written like you said and she said no. It becomes my problem and could take months to evict them and get them out. I just thought it sounded weird that the buyer would be stuck.
@@muchlovetoall7966 I am not fully in agreement with what the agent told you because you can place a contingency in the offer and it is up to the seller to provide the legal notice for the tenant to vacate. That agent is partially correct when they say the tenant may not move out per the notice to vacate. It would be the sellers responsibility to file the eviction notice and if the tenant is not out, you simply would not close on the deal per your agreement because the seller would have failed to meet their contingency (providing you had that written in the offer)..

I’m sorry this is happening. I don’t know where you are located but typically if you have a 6 month lease in writing, you have an agreement to occupy the property for 6 months. It doesn’t sound like they are honoring their side of the lease. I haven’t seen your lease but I would believe you most likely need to pay for the time that you lived at the property because that is the language in most rental agreements. Did you document your communication with the landlord regarding the condition issues? If you end up in court for not paying, the judge may take this into consideration. Is there a provision in your lease that addresses how the deposit is handled?

Hi Lual, Thank you for your comment and there are a lot of people who feel the way you do. However, that is not actually the case today. There are many landlords who realize the value of their home has increased dramatically and they want to get rid of the tenant so that they can sell the home. They can file an eviction and try to scare the tenant out of the home and you would be surprised how many tenants won't fight the eviction process and they simply move out. The bigger issue is that there are a lot of landlords that are notifying their tenants that they are not renewing their lease and they are giving the tenants 30 days notice to vacant. This is a very tricky time for tenants - Sam
if you have an active lease the likelihood that you would have to move out before your lease expires is extremely low and this happening would be ultra rare. It is not uncommon to receive a notification from the landlord notifying you that the landlord will not be renewing your lease because they are going to sell the home. Hope this helps - Sam Miller

Which is approximately 30 days from the end of the leasing term. I requested 60 days. They granted an extension. I literally almost lost my mind trying to move. Today is 8/6/2023. I logged in to my portal to finalize my move out. They accidentally uploaded my new lease signed by all partys. The same lease that I didnt have access to prior to today. I basically had a lease with them that they should have honored. So whay should I do about this new lease that I thought was never signed by them. When she told me that my lease was voided. I assumed she was talking about the old lease that ended 7/6/2023. I have a new lease in their portal that binds me from 7/6/2023 until 7/5/2024.

this is bad information but do check with your State law, if your lease expires and you continue to pay rent, and the landlord accepts the money, the terms of that lease are still in place, just on a 30-day cycle.

@Howardmorton I understand LL might be more caring than what you have experienced. But is that their job? They aren't your mother, they aren't your clergy. Understanding a tenant's difficulty isn't their concern. Similarly, a LL dilemma isn't the tenant's concern. A tenant doesn't volunteer to pay extra rent if LL has extra bills, or has a sick relative. I have never had a tenant offer me extra money if I was in a money pinch, yet sometimes tenants want me to do extra for them if they are! There are political reasons why available units to rent or buy are in such short supply, but it might not be appropriate for me to expound.

@Howardmorton I understand LL might be more caring than what you have experienced. But is that their job? They aren't your mother, they aren't your clergy. Understanding a tenant's difficulty isn't their concern. Similarly, a LL dilemma isn't the tenant's concern. A tenant doesn't volunteer to pay extra rent if LL has extra bills, or has a sick relative. I have never had a tenant offer me extra money if I was in a money pinch, yet sometimes tenants want me to do extra for them if they are!
There are political reasons why available units to rent or buy are in such short supply, but it might not be appropriate for me to expound.

@@SamMillerSells Definitely. There has been a dearth of rental units and also homes for sale for the last 10 years or so. Imo, there is a clearly political reason for it, but I'm not sure it's appropriate to say

There are certainly cases where that is true. With the increase in home values, we are seeing a lot of landlords cash out and sell their properties and even some landlords sell them to first time buyer - Sam
I'm curious, sircampbell, what in this clip, or in comments indicate that the LL is offering a dilapidated home and will not do repairs? That's what a slumlord is.

I am hearing more and more people are having to move out of the house they are renting because their landlord wants to sell their rental property while the home prices are up
What's some advice for someone with no credit to buy a home what do I do?

It is very hard to find apartments and good landlords where you have a lot of drug dealers out here and you don't want your kids to be around that that's how I feel
