      Was the problem truly that he wouldn't bring the car in, or did they just not order the part? You would think she would have brought the part to court, or taken a pic of it - to prove they were ready to work on it; Think they wanted to be done with him since they already gave him a good discount.

      @@missy67 The defendant admitted they still have not got the part yet. She claimed that if he brought the car in they would start working on it immediately, but when the Judge asked how are they going to do that without the part the defendant had no answer.

      How would it have been different when they didnt do the work . Here is how a contract works since you are not familiar with a contract, .. A contract has terms in it, and when any of the terms are broken, the contract is now null and void, .. If when they signed that contract for the car, they stated that the mirror would be fixed in x date and it was not done as a part of making the contract whole, he could by law, force them to take back the car since a part of the deal before he bought the car was that this thing would be satisfied to complete the purchase. Now, secondly, after them failing to install the mirror, he could have went to hyundai and had them do it and force them to cover the full cost of the mirror and the judge could not depreciate the cost based on that it should have been remedied with a used mirror because he gave them an opportunity to fix the issue which they failed to satisfy and at that point he can do whatever he wants to satisfy that agreement.
      What the judge say is moronic because when cars get into accident, regardless of its age the insurance company cant dictate that the repair shop get used car parts to fix the car because it was old but that car still get a new part so she is off her rockers and tend to do what she wants since this is a made for tv entertainment nonsense. Next time you get into an accident , if you car is old, go find out if they use old car parts to fix the car or do they use new car parts and if that part is a dealer only part, that is where that part has to come from and not the junk yard down the street

    I am usually anti car dealers but I was 100% on their side in this case. Even the judge wished defendant came with a little more evidence. The plaintiff is an idiot

      I don't understand how you could be in agreement with the defendant after the plaintiff had tried on numerous occasions to have the mirror repaired & still nothing was done by the dealership to remedy the problem. Is the plaintiff supposed to continue driving without a rearview mirror, which is very dangerous & illegal, until the dealership can find another "used" mirror? Nonsense.

    The plaintiff reminds me of David Ellis.
    The dealership returned $450 , which they didn't have to. Now he wants to nickel and dime them until the car is Free. He'll probably get the mirror on Craigslist for $31.57 .

But here is the problem with context, it's subjective and I don't think it is fair or reasonable to put your take on things in another person's head. That is how we divide our society. I am the type of person you could walk up to and say hey jerk and I will laugh. My default is to think the best about people and their intentions. Too many think every one besides themselves are bad. Not a good way to live life.

    I replaced the front bumper of a Hyundai Elantra with aftermarket online purchased Elantra bumper for less than $100 and I installed it myself within a few hours. Did the same thing with an aftermarket Elantra mirror for like $40.

    I would have never taken the car off the lot if it had’t been fixed. If buying a used car and repairs need to be done, make sure the dealer takes care of them before taking possession of the car, or just say “no deal”!

    So the dealer charged $2100 in extra fees because they didn’t make enough profit and thinks they did him a favor? That’s their problem not his. They are scam artists and she showed it to be true. I wouldn’t trust the defendant to sell me a pencil let alone a car.

      Sorry I meant a "used parts site" not a used car dealer. I ordered a mirror assembly for my 2008 Hooptie through a site that lists used parts nationwide. I got it in 5 days. That's what the used car dealer in this case should have done.@@tmilesffl

      He's good except for dog cases. He "humanizes" dogs saying "rescue a dog and they will love you forever". It's not true as I have clients whose rescue dogs have bitten them and/or their children. The dog has no clue you saved him. I rehabilitate the dog by challenging him in "his house" then train the client to reclaim their goddam home. Smh.

    Plaintiff was unprepared, he signed the contract and agreed to the used car terms, and then decided not wanting to pay the fee, he wanted to renegotiate the terms after he signed. What a loser.

      Funny thing though, is that they actually refunded the fee to him because they were caught. Did you miss that part? Did you even watch the video? Also, how is he a loser? He did what he had to do to get the car fixed and just won in court because the defendant (dealer) decided to be shady and not go through with what THEY(dealer) agreed they’d do. If you ask me, the dealer is full of losers.

    Dealers are not allowed to charge customers bank fees. Bank fees are charged to the dealer. That was against the law and she as a judge should’ve known better. And not ALL parts are available as aftermarket. There are some parts that are only available as OEM. Also, as a judge, your job is to hear the case and rule accordingly with the evidence provided. Not to belittle someone because of their accent. She is rediculous and always on a power trip as a GIRL judge. 😂

    This guy will buy an aftermarket or used mirror and install it him self for probably between $25 and $150. The bank fee is like the cell phone connection charge. It is a way of advertising a cheaper cost then tacking on fees that aren't included in the (purchase). Many service companies do this like auto services will charge a miscellaneous fee.

    I don’t know why everyone in the comments is being so understanding of the defendant. I get that the plaintiff was a fool for signing something without reading it. However, the defendants clearly took too long to deliver and you can tell that their business is unorganized.

    This is common.dealers do this everyday.bristol auto mall agreed to replace truck bed. After he left he was told it was sold as is.my brother was screwed out of a good bit of money.

    The fact that the defendant didn't want the business name to be mentioned says a lot!!! If you know you your business ethics are great, you would not care about a mass mention of your company name! The plaintiff was right, the dealer was waiting for a junk part from a junk car! This is why you buy any car from a name brand dealer, you may have to look a different dealers but you can hold big name dealers to so much more than those shady small ones!
