The defendant should've paid the $220 and had the solenoid replaced. Whenever there is an "intermittent" problem with a part it's best to just replace the part because you know it's going to happen again.
Stick to the law Matlock. You are wrong. I have turned a wrench. Sometimes issues are not simply the solenoid(s) You replace in pairs like brakes- both sides. I think that the defendant should have been responsible for the entire cost of repairing the boot as opposed to half. The plaintiff made the defendant fully aware of what he deemed to be wrong with the boat & she agreed to have her mechanic correct the problem but because her mechanic couldn't "duplicate" the problem the assumption was taken by her mechanic that there was no problem to be repaired. This being the case, the defendant should have relayed/quoted this information back to the plaintiff & then the plaintiff could have made an "informed" decision as to whether or not he wanted to keep the boat or return it to its original owner. Because the defendant did not specify/quote to the plaintiff her mechanic's lack of findings, the plaintiff was left with the logical assumption that the aforementioned problem was addressed & repaired. Justice did not prevail today.
The judge should’ve asked the mechanic why didn’t you change it just as a courtesy or safety potential safety problem you ask the mechanic why he didn’t change out the part for 250 bucks and free labor she had the guy on the phone should’ve asked him that
