The proviso reads that Police custody can be sought in parts for a total period of 15 days at any time during the first 40 days or 60 days as the case may be and not 60 or 90 days. Is it correct
Waiting for 3rd part
Though Senior Counsel Mr. Nagamuthu given a good lecture being useful to all, regarding period of police custody, not analysed 167 property. First he failed to refer about 40 or 60 days. This is for what. Secondly on what basis he fixes total perid of police custody for 15 days. Such custody means both police and Judicial. No police custody after 40 or 60 days as applicable, but for statutory bail at the end of 60 or 90 days as applicable.
Listeners must analyse and discuss on this aspect.
If one can face cross, why one can't depose.
Even section 33 is sensible, but proviso in section 164 . Incongurrancy open.
What about leading question etc. Issues
So now, some intelligent mind will ask for hours of a day, this 15*24 equal 360 hours meaning 6 hour daily for next 60 days. Thus imagine the fate and accused fate.
