    This case is a goldmine for legal students across the globe in that it shows one of the prime examples of how to lawyer on Camille's side, and one of the prime examples of how not to lawyer on Elaine's side at the same very time :') Similarly we've had a grand spectrum of all kinds of witnesses worth talking about as well.

      If someone made a movie like this, it would be unbelievable. Good lawyers and good witnesses all on one side and bad lawyers and bad witnesses on the other? Nah, that feels stilted and unreal.
      As they say "Truth be stranger then fiction".

      Elaine wasn't that bad. She had a bad client and bad facts. Don't get me wrong, she wasn't stellar, but I'd bet if you went back in time and somehow swapped Camille and Elaine, we would have seen the same outcome.

      @@ConsciousExpression Probably on the same outcome, but Elaine IS a bad lawyer. From unethical behaviour like insinuating that Tremaine and Depp lied to the jury (without any evidence to back it up) to abysmal cross (asking the same question several times or adding "if any" doesn't overcome objections) there are several things that not only but her in a different class of lawyer then Camille, but solidly but her into the bad lawyer category.
      You can only do so much with a bad case and a bad client, but Elaine managed to make it worse (which is some sort of acomplishment I guess).

      @@MrNorker77 Elaine used to be a great lawyer. Top Ten lawyer in Virgina and member of a certain group that only 1% of all lawyers in a state get into. However, she might have lost the plot.

      @@ConsciousExpression Everybody keeps saying this, but I don't buy it. Elaine spent almost half an afternoon trying to get hearsay evidence (the EMT rapport of Amber's nose) in, and failed spectacularly.
      Camille had the same situation (Morgan Tremaine) and masterfully directed Tremaine towards the right conclusion.
      Johnny's team made sure all the witnesses were capable and likeable, when Amber's team couldn't even manage to find a comb.
      Johnny's team were fulle prepared and ready for anything Elaine might throw at them, Amber's team looked like they thought they would win, just by playing the sympathy card.

    I agree this is just another delay tactic. She is giving herself time to keep working on JD (hoping he will settle without the money) and begging for a contribution and bailout from anyone with lots of money, no names needed here. I just hope Mr Depp stands his ground, leave it all to his legal team.

      Depp doesn't want the money, and the time to settle has passed. Depp offered to settle on the condition that Heard didn't appeal, and now here we are.

      I think she wouldn't accept any compromise anyway. It's always her way or the highway, and based on her behaviour she doesn't ever want this to end, since this is her last tie to having control of JD.

    This case should be used in law schools. Also Amber NEVER paid any of her law suit from her own pockets, she has always used her insurance to pay. I do wonder who pays her insurance though.
    No matter what Amber MUST pay cos she has the money e.g. the $7million dollars we still dont know what she did with the money.

      $7 million, plus whatever she made from all her movies and modelling contracts. And all her financial gifts from wealthy men. I think AH has plenty of money, she's just put it in property, and her sister's and daughter's name to protect it, and then filed bankruptcy.

      @@gardenersgraziers7261 Don't know where you are getting your info from but BBB is correct in stating the U.S. law has exceptions to discharge & the malice portion of the judgement makes the 10.35M her responsibility. The bankruptcy judge MIGHT lower the amount to be paid, but as in overturning a jury trial in the U.S., seldom happens.

    I'm assuming that she has mountains of other debts. Despite having a $7 million divorce settlement and $2 - $3 million from Aquaman, she lives like she has much more from what I understand. She never expect to lose the defamation trial because narcissists always think their lies will be believed, she probably gave herself a 50 / 50 chance of winning a judgment for her counter suit as well. If she won as the defendant against JD's suit, she'd be good for another movie or two and her career as a spokesperson and UN ambassador would have been secured. She never thought she'd lose in a million years.

    If she filed bankruptcy, has nothing to do with losing the lawsuit to Johnny. Her legal team must have explained to her can’t use bankruptcy to avoid the payment. Her lawsuit was paid by insurance. Amber has been over spending. It’s her own financial in trouble with or without paying Johnny.

    This whole mess AH brought on herself. This is a good case to be used for examples and education and the awareness that men also are victims of being abused.

    I suspect AH has been living well beyond her means for a very long time. This came up many years ago as a possibility to explain why she pursued JD. Long ago I'd read somewhere that she was spending tens or it might have been over a hundred thousand a month (the figures that sit loosely in my memory are either $14K a month or $140K a month) leaving her in a very tricky situation which looks & youth may have allowed her to get away with up to a point. I guess she was always on the lookout for someone to pick up the tab. Friends and family would have encouraged her to utilise her looks while they lasted. Considering there is a possibility that she spent over $20K per month on a rental house near the courthouse, I'd be very surprised if the rumour mill wasn't at least close to the truth. Apparently it's why so many people were concerned about her being a gold-digger and JD picking up the tab only confirmed the suspicions of friends and almost everyone associated with him or interested in his wellbeing. Poor lad.
    The 6 acre property she bought and put into a trust (just before covid) only supports the probability that she is a schemer and is willing to play the long game. It's a game that people have a very hard time believing, but as a person who has shared a family home and had relationships with at least one NPDer, the long game is a winning tactic from their perspective, and all the moreso because they know witnesses find it hard to believe that someone can plan and execute such extraordinary evil for decades. I have to wonder if she bought her child to ensure she would have a human shield and a darned good excuse, as well as a sympathy card. I hope the child is somehow safe & does NOT turn out like her, or suffers in any way because of her.
    All this is speculation and opinion based totally on the rumour mill. None is fact to my knowledge, but I wouldn't be surprised if there was a bit of truth in there somewhere,....or not.

      I thought the baby was a sympathy tactic as well. She can't be thst broke as she pays for a full time nanny, why can't she look after the baby herself? She is still flying around in private jets and first class. It's amazing to me that she gets away with it, but banks seem to allow rich people to run up millions in debt! Oh and don't forget her taste for $40,000 bottles of wine! I could never conceive of paying that much for a drink of any sort.

      @@shendisackett If it makes you feel any better realize if AH files bankruptcy the banks will only get pennies on the dollar (if anything) yet she will STILL have to pay JD. :-)

      Just a thought....a property in trust does not necessarily protect the property. I used to work as a real estate title examiner and with a lot of lawyers. And my ex is a lawyer. (My advice....NEVER marry a freaking lawyer cuz divorcing them is a b*tch).
      Anyway....if someone is both the trustee and beneficiary it is considered a 'dry trust' and is able to be accessed in law suits.
      Would love to hear any comments from any legal types here.

    The suspension bond is just to prevent johnny from collecting during the appeal, it is not required. And it actually seems to me that instead of paying the suspension bond to prevent JD from collecting she filed for bankruptcy which will freeze creditors from being able to collect until the bankruptcy judge determines what is dischargeable and what is not. But I do agree I strongly doubt the bankruptcy judge will discharge the judgement against her for JD because of the fact that the jury found malic

    I'd be interested to see the list of who/what she owes and wants to get out of paying. I bet she has run her credit cards to the max for one. She probably hasn't paid for her expensive digs during the trial and owes the wine distributor a small fortune. etc. I hope we get to see the list.

    What an incredibly silly girl she is her insistence on trying to destroy JD she has completely destroyed herself including, probably, her ability to return to work and put her life back together. I have no doubt she’s ensured her financial future … ahem baby daddy? 🤷🏼‍♀️ … and if Katie Price is any example bankruptcy doesn’t seem to have much of an impact on their way of life anyway.

      Yeah, so many self inflicted wounds. She could have kept her divorce money and walked away, and nobody would have said anything. Instead she had to try to destroy his life. She saved up dirt throughout their relationship, and she wanted to use it.
      How do I know she was saving dirt, and not just documenting what happened? Amber used just as many drugs as Johnny did. But for some reason she only took pictures of Johnny's drugs and Johnny's drug use.
      Taking pictures of felony activity by your spouse, when you also engage in that activity, is super shady. Even if she didn't indulge herself it's destructive, dishonest behavior. But when combined with the fact that we know she used cocaine as well, it's just shady man.
      She wanted to marry a rich old dude and take him for everything she could get. She had a plan from day one, pretend to be the doting wife for as long as she could stand it, collect all the dirt she could manage, and then frame him for whatever she could get away with. It's sickeningly manipulative

    Always interesting. The Depp v Heard case has really sparked my interest in multiple aspects: mental health, body language, and legal process. TheLawyer You Know has even done videos of insurance contracts and loopholes since AH’s insurance companies have refused payment. Now we have more information on bankruptcy law. Thanks to this case, channels, learning something new every day. 👍

    there is a lot of mis-information on social media about this but this is spot on, ive went trough pages and pages about the Virginia law and even so called lawyers where dead wrong saying that she didnt need to pay bond or Johnny... She has to pay one of the two by Virginia law if she wants to go trough ! The law states she has a right to appeal and the appeal cannot be dismissed UNLESS she doesnt pay the bond OR the appellee (Johnny) so that means she'll need to pay either bond OR Johnny !!!

      @@thekitowl there is only one bond left to pay and that's the suspension bond... The $500 bond is only to file a notice of appeal and you can't even get around that, the court clerk wouldn't even docket the notice without the $500... Also there is only one bond to pay when she refuses to pay Johnny and that's the suspension bond... As soon the appeal goes through the appeal court will put the appeal on hold according to the Virginia law and give Amber 21 days to correct the defect, if she fails her appeal gets dismissed forever.

      @@JerryDoe the suspension Bond is not required under Virginia law in a civil case & it’s not mentioned in the final judgment. If a huge amount of money in Bond form was needed in order to appeal it would stop Ms Turds legal right to appeal.

      @@thekitowl Virginia law states, she has to pay the suspension bond if she doesnt pay the appellee (Jhonny) furthermore is specifically says that if shes to be found in defect of paying the appellee (Johnny) she has 21 days to correct this, the court will give her 21 days where she can choose to either pay the suspension bond or Johnny ! that is what the virginia law says, that's is whats written in black and white on the Virginia law website. come back when you have actually read it... (it literally says the suspension bond is not required UNLESS she doesn't pay the appellee...)
      I might also add that this was designed to prevent her from escaping her debt, the "suspension" literally means to "suspend" her debt to Johnny that is what it literally is designed for and there is a great section written in the Virginia law what steps will be taken if no suspension is posted and she fails her payments...
      So in short, the law states she can skip payments to Johnny if she pays a suspension bond, the law also states that she doesn't have to pay a suspension bond if she pays Johnny (logical right ?) and just under that clause it states that she cant do neither (not pay bond and not pay Johnny) she has to choose one of the two....
      Then the law states what actions will be taken if she fails to do so... then it states that she got 21 days extra to correct the defect... if she still fails after 21 days the law states her appeal gets thrown out...
      There are 2 notations at the end of this clause, where it gives the remaining exceptions for not paying bond:
      1) the appeal court in rare cases may waive the bond for both parties (rare and never happened before)
      2) both parties agree to waive the bond during the appeal
      Those are the only 2 last resort exceptions at the end of this clause.

    Americans should note that bankruptcy is very different between the US and the UK. BBB mentions some of them that are relevant to this case, but the differences go much further

    Could this also be seen as a tactic to not repay back the home insurance companies who are wanting the money back they have already paid out for the case, because of AH' being found guilty of willfully defaming JD or does that repayment still stand because of the outcome?

      The insurance company who paid her legal fees aren’t coming after AH. The insurance company that was supposed to pay $1 million towards the judgment is .

    Thank you !! I so enjoy the detailed and accurate responses/analysis...I learn something from every video you post. I do feel sad about all the hate that AH is receiving and by that I do not mean the challenges/legal analysis to her testimony and comments/reflections on the court case - these are necessary and invaluable. I have a family member who has a personality disorder and it has fractured the family- it is incredibly sad. AH has so many enablers around her I'm not sure she'll find a way out from this or find the kind of support she needs. However, having been on the receiving end of someone like AH, at home with my family member and at work ... there's no choice but to expose it/challenge it. I am still traumatized because someone from work took out a complaint against me re bullying and harassment..I went through months before it was resolved via investigation, however, even though it was proved I had not acted in any way inappropriately, there was no consequence for the false allegations. For example, she complained I harassed her because I sent her 20 emails in a day..the facts were that there were 6 staff with different timetables trying to arrange a mutually convenient time to have a meeting! Yes, there were 20 emails but it was a 6 way conversation about arranging a mutually convenient time to meet! That was only one of about 15 ridiculous claims. However, because bullying and harassment is an important issue my employer had to address it however, I had to prove my innocence and it was months of a cloud over me and my career. It actually broke me, it was traumatic...people don't want to be on the wrong side so they distance themselves from all of it. AH was quite a triggering individual for me. I enjoy your analysis of the legal processes/arguments, while you come across as firstly a decent human, you give an objective analysis and it is always interesting! Thank you again!! Also, in one of your videos you said that we have the choice to do something or do nothing..and that doing nothing is a choice...so each day now I chose to do something! Thank you for that wee snippet of motivation. I can now count 2 gems of motivation in my life - 1)It doesn't have to be like this and 2)chose to do something rather than choose to do nothing!!     What if she moved her assets under other’s name or hidden somewhere before filing bankruptcy?
    Filing bankruptcy not only allowed her to skip the donation pledge, but also avoid the possibility to pay back the insurance etc, I guess
    We will see how her post-filing living conditions will be, whether she could maintain her luxurious living style.

    There have been a lot of articles out during the past few months concerning AH that have been totally inaccurate. I will believe it when I see it.
    Bankruptcy laws can vary in the U.S. so it depends on where she filed….IF she filed. She may just choose a state that would protect her assets better than some other state and established residency there. Whatever she is up to you can bet it will be shady.

      She owns a home in California, and I am sure the home is already leaned for the judgment. She won't be able to get another home loan with the judgment against her. She spent the 7 million on world travel after she got it, and what she had left she has been vacaying it up in fancy homes in resort areas. Spending it as fast as she can to keep JD from getting it I believe.

    We were told AH couldn't appeal unless she posts the 10.3 million bond. It turns out she only needs $500 to appeal and the bond only needs to be posted to stop collections.
    I'm reserving judgement on the truth of AH not being able to escape paying by declaring bankruptcy.

      People mentioned it initially as a distant possibility, but no one thought she would let the collections just hang over her. Before the insurance payments became public, everyone thought that she was bankrolling her lawyers out of pocket. If she was, then she would need to logically post the bond to appeal so that Depp's team couldn't just send it to collections and take away her legal team. Instead, she seems to be going all in and banking on them not collecting, which is a really weird move strategically. She claimed after the trial that he is an abuser that used the system and his influence to take everything away from her out of spite for speaking up and to continue to control her. If that was true, why is she seemingly relying solely on his good will not to send her to collections and take away her legal team?
      The only strategy I can see this being an angle for is she's baiting him to collect so she can play the victim again and claim he took her lawyers away and that's why she's losing. The issue is that she's already lost in the court of public opinion, and that strategy relies on people believing her over him that he's the one pushing her around. The issue is that the Depp team has showed a lot more patience with her post trial games than most of the public would, and is simply responding to only each move individually while calling them out. Files motion, counter motion. Files appeal, counter appeal. It's VERY hard to play the victim when the other side is only countering your actions. It also doesn't explain where she expects to pay the lawyers from, unless she somehow thinks she can then roll that into a counter offensive and get crowdfunding and jobs back at a rate far higher than she's ever made in her career before

      No the 500 was only to allow filling, she would still need to pay the full ammount either to JD or into bond plus intrest. Only then would the appeal actually be considered. If by some miracle she then won on appeal shed get the money back, but she needs to have put the money up front or its going nowhere.

    One of the strategies maybe a delay tactic. Bankruptcy can initiate an "Automatic Stay" which means that the collectors who are in the middle of collection actions, are automatically stayed or paused. It may be that JD's judgement cannot be discharged, but the collection can be delayed. If AH can delay 6 to 10 months, it may be that she can gather enough funds for a bond.

    I think she was always going to file for bankruptcy as a way to keep JD from starting to demand payment. While in bankruptcy your creditors cannot ask for relief (including JD ). I also agree with the comments that another reason is to keep the insurance companies from collecting.

    Case aside, In New Zealand you have a thing called no assets procedure, that is a alternative to going bankrupt. Its only up to a set amount $$ wise and is of a lesser time frame that it stays on record. Also only some debts are covered. Bankruptcy is a higher $$ amount than a no assets and i think more or different debts can be included. But with both you are allowed to own a car worth upto a set amount and house too i think unless payments are behind then its a different case

    There is an interesting point at least in the US I just learned. A person can get bankruptcy filed by a person or company they owe money to. This is covered by 11 U.S. Code § 303. Because AH did not post a suspension bond and it is later discovered she has hidden money JD can "bankrupt" AH and force the issue. It is interesting talking to people that actually know the law. JD can file against AH, force her into bankruptcy, go after any and all assets she has, and that judgment is STILL in place. I also was told it is growing interest as well. In all honesty, AH needs to stop acting like a 6-year-old child and contact JD and settle this!

      @Nick Giorgione I date a Virginia Based Attorney. She specializes in Family Law. She and I were discussing this very topic last night. All of what happens next is based on how much energy and money JD wants to invest. He can get AHs bank records and track large deposits and withdrawals. The places where those withdrawals went in some cases can be tracked. In today's world, it is not easy to hide money in institutions. Even the Swiss banks have opened up more to allow people to track banks there. Even if AH is hiding cash, all cash withdrawals over basically $9,000 to $10,000 have to be reported. Just as there are fantastic "skip tracers" that can find people, there are people that can find money worldwide. The firm my GF works for has recovered millions over the years by using these types to find money.

She paid $500.00 to file the appeal, but that filing didn't help her in the way of a delaying tactic because she missed the deadline to put up the bond on Monday the 25th. She can file an appeal again, but since she missed this deadline, Johnny can now begin taking legal action to start acquiring the judgement from her.     A suspension bond is not required in the USA. A bond stops collection only. It only "holds" off enforcement but if the claiming party isn't enforcing there is nothing to hold "off". For example if Depp files a Judgement against her Income from a book deal it would be in effect unless there is a suspension bond. Depp has not filed any claims.

    If her insurance company is successful in their judgement, AH will still be responsible for attorneys fees as well. In the US, many debts can be relieved, and any assets are "collected" and sold. The money is then dispersed to all creditors in line of importance at a certain percentage. For instance, mortgages are paid at a higher rate, after paying any taxes due, clear down to credit cards.
