I'm sorry, but I respectfully disagree with Dr. Jabari. We are setting a very VERY dangerous precedent by not being able to have social media posts and music lyrics admissible in court rooms when a murder happens. If the other circumstantial evidence matched, those should have been able to be used. If this happened in America, this rapper Top 5 would be out and there would be no chance to re-convuct him due to double jeopardy. It's things like this that R Kelly and P Diddy were able to get away with hurting people for so long.
I could not agree more, honestly I'm pretty disappointed in his take. He's basically saying "hip hop shouldn't be on trial", but this is not hip hop anymore. It's a bunch of kids who say they're committing crimes in songs and on social media, and then going out and doing it, in some cases they are committing actual murder & then going online or in the studio and bragging about it. They should absolutely be held accountable. This is a horrible take from him, I'm disappointed.
@generaldiscernment I felt like I was going insane watching this interview. Nobody is convicting rappers just for saying gun bars without evidence of a crime (like... just for instance... a dead body). The only logical conclusion of this argument is that no artist can ever be held accountable for any threats, admissions, etc because they might be just crafting a persona. Love Kidz In The Hall and I'm sure Dr Jabari is a smart dude but this just felt insane to me and I would have liked to see Justin challenge it more tbh.
Keep in mind, during the height of the beef with Kendrick, Top5 said he was OVOK or OVO Killer, because he said Drake did NOTHING for the streets of Canada. Now he's out, and he's riding hard for the person he said did nothing for him. Just a clout chaser.
He said the man paid his lawyer bills so the newly formed alliance is obvious. Plus, these L's his new bestie has been catching are hurting the money piles.

This is one of the major things thats always angered me about Drake as someone from Ontario. Drake is very clearly not a street guy yet constantly uses Toronto gangs as clout. If he was actually from that life thats one thing because you could understand him bringing drill rappers into his orbit as a connection born from shared experiences or upbringing but thats clearly not the case- in other words he would have a connection *in spite* of the association with violence. When it seemed like Toronto was getting noticeably more violent in the 2010s Drake did nothing, instead he starts bringing lots of drill (or quasi drill) rappers into his orbit seemingly *because of* their association with violence and nothing more. Americans were surprised seeing Toronto not being super loyal to Drake during the beef but I dont think yall understand that Drake is only a status symbol to many people because he's never built meaningful and lasting connections with the community as a whole. He talks about how much he loves Toronto but exploits the legitimate deteriorating material conditions of Toronto in an attempt to boost his own street credibility while never actually doing anything for the community or at the very least giving people something to aspire towards. And I don't think this is some unrealistic ask, just listen to Kardinal Offishall's albums; Kardinal shows a legitimate empathy for Torontonians that Drake never has.

How did Top5 get to Los Angeles? In a private jet, likely with a fake passport. You can do your own math for figuring out who could provide both of these things.
IMO I'm fine with the videos and lyrics not being admissible as evidence in a court of law. BUT i can't be ok with channels and platforms that promote such content being monetized, while innocent people die and their families are denied justice Drake could have paid a top lawyer to represent the victim's family. He has chosen a side. As FD Signifier said, he's (So Far Gone) Anakin Skywalker..

I believe they are all part of the same media apparatus with agendas to distract, keep negative and destructive behavior going/normalized. Even in the face of these crumbling industries they cant help but run the same play book. Just think, if this was the 90s without the internet that goon saying not to come to Toronto would definitely lead to some altercations whether with involved parties or better yet young impressionable fans. With respect to Dr Evans, he definitely has not been involved with the legal system enough. When a person says they committed a crime it’s a confession. Now unless the confession was given directly to law enforcement, WITHOUT any coercion, rarely is it enough for a conviction. However, even giving a wide bit of latitude to the creative license granted to art, we have passed the point of using “it’s just an image” and “fake it until you make it” as a defense for excluding character evidence. There is a line, it is when the music stops. Social media, live streams, etc. these are not the “art”. While these artist may be “performing” and displaying enhanced versions of their persona… What happens when someone like Top 5, who just made a threat to Kendrick, gets killed because the person threatened saw them as a “clear and present danger” and “feared for their life”? Provide guidance and solutions not excuses.
THANK YOU! I fear that Dr. Evans is trying to protect Hip Hop as an art form, that he’s willing to sacrifice the common sense of allowing people with ill intent to confess to crimes, threaten people, and distasteful make money of someone’s death, … all behind the protection/disguise of “art”.
Hey I’m a huge fan, just want to specify something from a Canadian perspective. Top5, by no means, is considered a staple in Canadian rap from a musical perspective. He’s basically a dollar store/canadian version of 6ix9ine. A clown by definition. Attaches himself to any type of clout, especially if it’s negative. For context, his come up was basically him taking pictures with celebrities and claiming they were friends. An embarrassing representation for Canada that no one takes seriously.
This is exactly why he needs to be canceled. And Adin Ross too. Inserted himself in some street shit now wanna get lawyers involved cause some L.A. dudes told him the truth security get shot everyday. Nah Adin let wakademicks and bottom 5 keep gassing you up.
This time it is Kendrick and different. Kendrick is a global superstar who is loved by the culture. He also has the support from really powerful people AK doesn’t have any clue what he is going up against.
The case is only stayed / suspended and the Defense has up to a year to re-file the charges and bring a case. Bottom5 is not off yet. Justice for Hashim! 🖤
Kendrick said "I think men like him should die" on Meet the grahams. Drake financially supporting this guy is indirectly endorsing this behavior, and personally, for me, i'm starting to think Kendrick's words might be of value. Drake's power is being misguided and damaging what beautiful people are trying to build. Fuck this narcissistic pieces of the industry, we're tired Edit: I don't really advocate Drake's literal demise, it just seems at this point that he doesn't understand good values and isn't interested in seeking help or self reflect, so it's like when will this guy stop?
@@dominicthelordkabinga My guy, where did you hear me say that Kendrick is the example? Where did you read my take on Kendrick's exempt line of action? This is a bit odd for me. Though I directionally agree with Mr. Evans’ point about persona and actual character in life, I believe it’s very irresponsible to make these points in the court of law. I think that using music as a form of testimony is tricky, because there are individuals that “fake the funk”. Yet, I also believe that there is a responsibility that comes with embodying that persona.
Yeah, he completely lost me when he got to acknowledging the clout-chasing aspect of this. I don't think I understand how someone is no longer responsible for the things they say (online or otherwise) simply because they're an artist and they're willing to do anything for attention.
And they (lyrics/social media) should be considered admissable on a case by case basis for that exact reason. Shame on Dr. Jabari. But then again he is from that poisoned soil, the birthplace of Drill: Chi-raq
Dr Evans is wrong. If a rapper raps or posts about killing someone then someone ends up dead and they are involved then they shouldn’t be able to hide behind artistic expression to evade responsibility for those words….connected to actions. As if people didn’t die around lyrics in drill rap. Him saying it’s all a created persona assumes that everyone is pretending when the bodies say otherwise.
Two things 1. Canada stay losing as of late. You beat the case and decide to threaten a famous rapper if not one of the most well known rappers on live. 2. Canada being corny. Y'all can't avoid it for some reason.
Akademiks smiling and laughing at the perpetuation of violence against Kendrick that is being sponsored by Drake through Top 5 is incredibly dangerous. Drake who is from no hood is reaching into the hood pulling people up and creating very real issues that will extend beyond this performance of hyper masculinity.

For Transparency, I'd like to know how much Dr. Jabari Evans was paid to be an Employee expert witness. "Expert witnesses are paid a daily rate of $100, plus reasonable travel expenses." Or ...... "Contract amount A party may pay the expert more than the amount they are entitled to under the law, if the expert incurs expenses or losses attending the proceeding."

"He beat a first degree murder charge which is hard to do in Canada" Man I wish this was true...Our justice system is probably more fucked up than yalls and we let way too many people walk. Letting a killer walk is what resulted the death of Pat Stay. RIP.
This is a great example of the pendulum swinging too hard in one direction, I think if lyrics are the ONLY evidence then yeah it shouldn't be enough but to say all those things are inadmissible is fuckin wild.
I feel like that meme: “we’re going to give back to the kids, we’re gonna stop the violence”…FIVE MINUTES LATER…””Kendrick better not cross the boarder, I’m gonna slap Kendrick when I see him. If Kendrick comes to New Hope, it’ll be the last place he will be seen”. It makes me sick to my stomach that this guy was let off, by a technicality. I wish this negativity wasn’t supported by our own community. Disgusting.
Kdot got all gangs together and created peace. Different gang members danced together. He is a peaceful guy and God and angels are with Kdot. This is a war between good and evil. It’s a spiritual war. We all need to stay prayed up. God bless you Kdot.
I appreciate Dr. Evans' point of view but I strongly disagree. I think we're past the point of accepting "faking it till you make it" as an excuse for how artists behave. And at what point do you, the artist, decide that you don't want to engage or further perpetuate this? Where is the responsibility to one's community and people? Does anyone care about what their art inspires in the world anymore?
11:42 it’s “killies/killy” which is the Jamaican version of killas….. the part speaking on the “bun skin” is very accurate. Bun is the Jamaican word for burn, so they are saying “you will bun their skin” is basically saying the bullets that hit you will be so hot they will burn your skin
His whole argument is predicated on an assumption that everyone is playing a character when there are piles of bodies of people that have dies as a result of lyrics in a rap song.

My ex knew the man who was killed and it's honestly awful that someone, who for all intents and purposes, is the one of the most heinous, disrespectful, ignorant and toxic people I've ever seen has been protected by Drake, whether or not he was guilty. I'm fully aware that trials and cases are based upon the evidence presented, part of me is just baffled as to how this man is allowed to behave the way he does. Why shouldn't his social media be used as evidence? Maybe it was that there was no concrete evidence for the murder so his social media was irrelevant? Even so, you will never get me to think that some drill rappers, lying or not, are not incredibly detrimental to their audience. (Top5) Hassan's brother Said Ali was killed and less than three days before the shooting of Hashim Hashi he was on social media talking about getting revenge. Hashim Hashi had absolutely no ties to any criminal activity, this was likely a case of revenge and mistaken identity. They have CCTV footage of the shooting, I think it just wasn't clear enough to show the perpetrators. They said that Hassan was just an accomplice though. As far as I'm concerned whether or not he shot the gun he should be punished appropriately for what he did if that was indeed him which I think it was. I know that you don't have any emotional ties to this case Justin but it really isn't "dope" that Drake paid for his lawyer fees, whichever way you swing it. Either Drake paid the lawyer fees of a conspirator in a murder that took the life of an innocent man or Drake paid the lawyer fees of someone who promotes death, hedonist capitalism and gang violence that drives the cycle of death and destruction. Drake is a prime example of the negative power of this gang violence culture. Drake was never hard and that's okay, he doesn't have to be. Like Lil Wayne said he should've kept it to what he knew but thanks to fragile male egos we have to be the biggest and the baddest, helped along by this arms race of rap personalities. Now Drake really does have criminal ties. Drake, one of the biggest musicians in Canada and one of the biggest in the world. I'm not saying Drill/Trap/Gangsta Rap has hypnotic abilities and strips people of their autonomy or anything but it's not a positive force and we really need to start standing up and saying this isn't right. There's a big difference between recounting your own personal experiences and actively promoting death. I have no qualms with rap about crime as an idea but the balance isn't there, apparently nobody wants to hear the actual consequences of that kind of life and that's the problem. If we're really saying these are anecdotal pieces of art entertainment where are the atrocities, the horrors? Anything other than that seems extremely irresponsible to me. I used to think street raps were either anecdotal if true or like a horror/action film in song form if fictional but I'm genuinely seeing the negative effects of this kind of culture. If you watch Nightmare on Elm Street Freddy Krueger never says that he's going to kill anyone that actually exists in real life, it's ludicrous to me to imply that it's remotely the same thing. It's not just the music though, in my eyes it's a mixture of; the music, established gang culture, the fans with no criminal ties, capitalism and social media. The music began from the genuine expression of the disenfranchised, then came capitalism to snatch it up and commodify it, leading to suburban youth and outsiders gravitating to the hyper-masculine, violent Gangsta Rap being heavily marketed in the 90s. A big part of Hip-Hop is its competitive nature and focus on authenticity. All of this comes together in a gigantic cultural movement being adopted by outsiders who did not grow up in gangs emulating gang culture to show how "hard" they are and feeling like they have to back up their claims, resulting in them escalating their behaviour to either engage in it themselves or promote/support it. All because everything in our society says you must make as much money as possible or your life doesn't matter. You have to have the perfect life with money, women, cars, clothes, mansions, guns, chains or you're irrelevant. I understand that it's not as easy as just saying "Gang violence culture is bad guys, you need to stop", it's a symptom of something much bigger, but something that I feel like a lot of people can do is realise what they're actually listening to, buying and promoting. In our society people only want to hear the extremes, if it's not; immediate, extreme, vulgar, shocking or controversial it doesn't get engagement because of the way our brains are being wired by technology in capitalism. We need to distance ourselves from these cancerous sirens that lure us in and stimulate our brains but offer us no humanity or sustainable life.

I was really wondering if anybody else felt like this

I appreciate your perspective ✌🏽😊

With respect to Dr Evans, he definitely has not been involved with the legal system enough.
When a person says they committed a crime it’s a confession. Now unless the confession was given directly to law enforcement, WITHOUT any coercion, rarely is it enough for a conviction.
However, even giving a wide bit of latitude to the creative license granted to art, we have passed the point of using “it’s just an image” and “fake it until you make it” as a defense for excluding character evidence.
There is a line, it is when the music stops. Social media, live streams, etc. these are not the “art”.
While these artist may be “performing” and displaying enhanced versions of their persona…
What happens when someone like Top 5, who just made a threat to Kendrick, gets killed because the person threatened saw them as a “clear and present danger” and “feared for their life”?
Provide guidance and solutions not excuses.
THANK YOU! I fear that Dr. Evans is trying to protect Hip Hop as an art form, that he’s willing to sacrifice the common sense of allowing people with ill intent to confess to crimes, threaten people, and distasteful make money of someone’s death, … all behind the protection/disguise of “art”.

Thank you for bring someone who give us knowledge, I learned something today
