      @Nova their was no pull over for an observed violation on traffic laws.. They were already parked. So no they dont have to provide ID nor even talk to the officers because no crime has been committed nor did the police accuse them of a crime. They need to articulate reasonable suspicion the person has committed, was in the process of committing, or will be committing a crime. None of that occured and only they didnt follow my commands that were not backed by law.. So unlawful commands will not be followed. The founding fathers would call u a red coat

    The most disgusting thing is that the police department did an internal investigation and found nothing wrong. Whoever was in charge of that investigation needs to be fired. How can anyone who knows the law find nothing wrong here?
    And the two cops are both still employed by the department. They've both been promoted. Unbelievable.

      Abolish qualified immunity. Make cops purchase insurance just like doctors have to for mistakes they make. Taxpayers should never be forced to shoulder the financial burden for cops who are negligent because they know mistakes don't cost them personally.

      It takes 6-8 years to go through law school & graduate... then get your law license in order to be an attorney, so that you can interpret the law. Police go through 3 -6 months of training to enforce law that it takes an attorney 8+ years to be able to do. How is it that you can enforce laws and you don't know what the laws are.

    That’s what won them the lawsuit. Two clear examples of them violating her rights. Having no actual reason for detaining/cuffing her. Then literally telling her that she can’t invoke her rights by asking for a supervisor and question why she’s being detained.

    Muting the body cam video should be against the law..it's obvious they had something to hide. Understanding this family did win their lawsuit but all trust in the police system has been broken and no amount of money can replace that.     UPDATE!!!!!! A jury awarded this family $8.25 million dollars for being violated the way they were. Alameda County offered the family $700k but they declined the offer and took their case to trial where a jury awarded the a huge sum of $8.25 million dollars.

    In NYS, you’re not required to show ID, although police would rather u to do so.
    Lots of times when black folks randomly show their ID, police write a report for ANYTHING, just for whatever. When they could just have walked away. No. They want you to have something on your record, even if it’s the most minor thing. Which it would have to be minor since they took your ID, just to type in something. I’m glad this woman & her children won the Lawsuit. Period.

    A federal jury awarded this innocent family $8.2 million for having their rights violated. Good for them. I'm grateful for the groundswell in police auditing, body cam footage, and social media posts of this kind, as of late. I have also experienced something similar to this, when I was a teenager, walking home from school. A deputy, who was extremely aggressive and rude, grabbed me. He handcuffed me, and put me in the back of his car. Drove me a few miles away, to a house, where a lady was standing outside. I repeatedly asked him "What did I do?" He said that I was seen trying to break into a house. He then brought me out, and asked her: "Is this him?" She nervously chuckled, and said "No...not even close!" You would think he would have been apologetic. Not a chance. He took me out of the cuffs, and told me I was free to leave. I asked him to dive me home, or at least where he picked me up. He was still being nasty to me, and would not even do that. Never been in trouble. I was just a regular kid who lived in a nice middle class neighborhood in the suburbs. I was 17 years old. I never told my parents what happened. I really don't know why. It makes sense that I should have. I really wish I did. Now I'm 48. And the adult me, realized that I was basically kidnapped, and traumatized. I'm not a crybaby, or anything like that. But that experience has stuck with me. And it just about brings me to tears when I think about it.

I have huge difficulty getting my mind around such incidents. NOTHING will happen to the cops. Getting fired means nothing to them - they get a job in another state, keep their pensions by resigning before they can be punished (IF they do) & you live the nightmare of having been treated like an animal bound & hauled off as worthless meat. I never feel sympathy for cops who get a good smackdown. I feel for you & the millions who have sufered as you did, including this family.

    She knew her rights, and they did not. She did nothing wrong, so no ID is needed, and it is not required. She asked for a supervisor, and he said no. Then, an illegal search and detainment. There was no crime except for being black in Castro Velley. SMH

      Obviously, this was racial profiling. But what strikes me as odd is how dumb the cops were. They mentioned she was parked in a handicap spot. I used to have a handicap plaque after an ankle surgery, and they specifically tell you at the dmv that cops have the right to verify any time I use it that I am the actually owner of that plaque. It's in the paper work you sign at the dmv. Verifying includes the handicap paperwork and your id. So the cop could have used that as justification to get her id and protected theirs butts.

    Seems like most people here got it, but a few didn't, so read here: Officers may only detain and/or demand ID from an individual ONLY if they have a *REASONABLE and articulable* suspicion that they're in the process of committing a crime, have already committed a crime, or are about to commit a crime, or infraction. Sleeping in the car by itself is not reasonable suspicion. Maybe sleeping in the car with burglary tools in plain sight (window punch, prybar, etc) could fall under reasonable suspicion, or if the lady rolls her window down, and smells like alcohol, or is slurring her speech. The officers were in the wrong here.

    He is on a fishing expedition, and she has no duty to give him her ID, he doesn't have reasonable articulable suspicion she has committed, or is about to commit a crime. These officers need to be fired and prosecuted. Their superiors and the prosecutor need to be charged as well for covering up the actions of these tyrants. All of them are culpable in a USC title 42, section 1983 and 1985 lawsuit for violating these ladies 4th amendment rights. And muting or Turning off body worn cameras is spoliation of evidence, and should be grounds for termination in itself.

    Mute buttons should be removed from all body cams. Period. Or at the very least, a law passed that states they cannot be muted until a suspect is released, or has been booked in completely.     This happened to my son when he was 18. In Jacksonville Florida at the WaWa on Beach Blvd. He was eating his Quesadillas he just got parked in front of the store and a cop said that same exact thing!! Being black is the real reason. We probably should have filed a complaint but I was just relieved that they didn’t kill him-he was by himself only 10 minutes from home.

We need accountability from law enforcements and people should also cooperate with law enforcement. All giant corporations pay little to nothing in taxes.     COPS SHOULD NOT BE ALLOWED to redact body cam audio or block the lens. Allowing cops to turn off audio is counter productive to the purpose for the body cams in the first place. Body cam footage is public domain, and the public is (entitled) to see and hear every frame of footage. The Supreme Court needs to intervene again, and outlaw the corruptive behavior, yet again.

    The daughters acted out the way they did because the mother set an example. I don't think the officer did anything wrong asking for ID . She should have shown it to him. Perhaps the officer didn't have good reason for seeing it. I don't think he did. But he did so just show it ! These guys keep us safe so show some gratitude.

      I cant figure out why, when you are waiting for a store to open, that you park in a handicapped spot, at the far end of the building form the door you want to go in, and since they were there before the store opened, you can't say it was the only spot open. Definitely should have been given a handicapped parking fine, which, they had the right to ask for a ID for.
