Of course you can use that design. If there was ever a patent on the Foliot and Verge mechanism, then it would have expired over 700 years ago, so we're both safe from prosecution! I like to think that all Meccano model designs are 'discovered' rather than 'invented', because we only have a finite set of components to use in a finite set of ways. I imagine it was easier to set up than a pendulum or balance wheel escapement, with or without Meccano. Best wishes for future school projects.
