It also means no one can prosecute the Captain of the vessel if he orders the pirates stabbed in the belly and tossed over board after his security detail captures them.
The US can't possibly be the singular effort to eliminate sea piracy. All pirate host countries need to be held accountable and an iron fist must be used to convince those attempting to pirate vessels that it is too expensive and risky to proceed in that direction.

As long as the pirates technology improves they will always pose a threat.
If a ship is fired upon return fire with the aim of sinking the attacking boats. If the pirates make it back to land fine, if they do not make it back to land, that's the risk they take. Pirate's would soon run out of boats and even crew's to man them.
Maybe allow lethal contact..............Since nothing else has seemed to work ? Let just a few boats not return home and see how many more "sailors" sign up.
Why not implement electric fencing around the ships to prevent the boarding of pirates. The ship's batteries could double as power for ship operations and the electric fencing and the costs kept at a minimum.

Saying cargo ships should pay for their own security teams. It's not the responsibility of the United States of America to police the world. Who's paying for it United States America, taxpayers are paying for this. And that's not right. The shipping company should pay for it, not us.

I don't see why any navy should guard ships the are flagged with flags of convenience for tax avoidance or, more nefarious reasons. If they fly your flag and follow your rules and pay for that privilege it's your "merchant navy". When not, the ship's owners/operators are profiteering from your taxpayers.
