      Should be fined and jailed for unconstitutionally prolonged detention. He was trying to get this guy to drive in a way he could claim was endangering him. There’s no other reason to place himself ahead of the car after delivering the ticket and stating the driver is free to go.

      that was my instinctive thought also! if anything the cop has cited him for a false violation, then pouring salt on his wounds by provoking the driver bc he believed qualified immunity makes him bullet proof. hence the provocative misconduct.

      The government of which they are part?
      Or the people who have no access to the criminal justice system and very limited access to the civil system?
      No one will hold themselves accountable, stop being so naive and silly.
      Answer this question, who can charge a crime? Who can prosecute a crime?
      The answer is, NOT YOU, only the state can charge and prosecute a crime. Only the criminal organization can prosecute criminals.
      Are you seeing the fundamental problem.
      Asking the fox to punish himself if the chickens he is guarding get eaten by himself.
      Doesn't work in theory, doesn't work in practice, stop expecting it to work and stop asking the criminals to police themselves.
      Who will hold them to any standard of they are the authority on authority?
      You? Lol. Right. No one will. They will pay lip service. They will put on a show, give the illusion that there is justice and equality. But you have to be pretty naive to believe that and still see the reality all around you.
      Immunity isn't just given to the government by the government in doctrine. Immunity exists because you have no authority over your servants. Some judges are elected, some appointed.
      You might have some control with your vote but even that is highly questionable.
      We have a judicial system for the purpose of providing a fair, impartial and consistent application of laws. To create faith and belief in the system in order to prevent vigilante and mob justice becoming the way of the land.
      But once the impartiality is gone, once the fairness ceases, once the faith and belief fade, there will be only vigilante justice.
      You could completely remove all immunities and nothing would change really. All that would allow would be for civil suits to occur.
      But still you need the court to hear the case, you need standing in a timely manner with remedy obvious and possible from the court.
      Your case is not ripe in the spring, you lack standing, latches in summer and moot by fall.
      The point being, there is always an excuse, always a way to deny justice even in civil litigation if you rely entirely upon the state for justice.
      Why not allow the victim access to a grand jury. If the Grand jury indicts, let the victim decide to prosecute or not and let the state/ the people pay for the prosecution just as we pay for every single criminal prosecution already?
      We can use the system if we have access to it, if we have equal protection under the law.
      Otherwise we are subject to begging the state to prosecute state agents for criminal acts.
      We are asking the criminal gang to prosecute their own for "we the victims".
      Shockingly, this is exactly what we get. No accountability, no criminal prosecution and denied any civil remedy because of self created, self declared immunity.
      Judicial immunity was not given to the courts, it was created by the courts and given to every public employee. From your town hall janitor up to the Vice President.
      The only immunity that arguably exist Constitutionally might be presidential immunity and diplomatic immunities.
      Everything else was created by the government for the government in direct conflict with The Declaration of Independence and The United States Constitution.
      The criminal created immunity for themselves and you see that immunity as enabling the criminal?
      Well no kidding but immunity did not come first, the crime came first, the criminal came before the crime, immunity was the result of criminality not the cause of criminality.
      There would be no need for immunity if the criminals did not commit crimes.
      Immunity protects from consequences it doesn't enable the act. Power and authority enable the acts. Immunity is a symptom people fixate on because they want to see others suffer. If they wanted to stop the crimes, prevent the violations they would remove the power and authority, make prosecutions mandatory for violations under color of law.
      Instead they focus on immunity that really only applies to civil litigation not so much to criminal liability.
      Civil litigation against a state agent puts the individual plaintiff against the entire system backed by all of our resources and holding all the power.
      Criminal prosecution puts the entire system and all of our resources against the individual who commits the crime.
      You want immunity removed so an individual can take on the system but you seem to ignore what a mismatch that is. You seem to ignore the criminal aspect of liability, deterrence and accountability that every other person faces.
      You want protections removed but ignore the power that is being abused to commit the acts.
      Fine, remove this judge today. Tomorrow a new face will take their place and have the exact same powers to commit the exact same crimes with the exact same liabilities.
      The judge won't pay the awarded judgement if and when one is gotten.
      The state, we the people, will pay the judgement on behalf of our servant who caused harm abusing our power on our behalf.
      That would be the best case scenario if immunity was abolished.
      And it should be.
      But it won't actually fix the underlying problems. In my opinion.

A lot of good that does.... Naively, I still think public servants need to actually serve the public and not themselves. Fat chance I know.

      You're definitely not wrong. I think there is a bigger picture with deeper roots.
      We do would do well if we could actually hold our servants to any standard but we have very little power or recourse with which to do so.
      Immunity is definitely a blockade to accountability.

    This is the city where I got a $350 ticket for cussing a game warden. Instead of getting an attorney, I contested the ticket so the game warden had to repeat every foul and disgusting thing I called him in open court. It turned into a laugh fest and the judge(not Bull) reduced the fine to $25. It was worth it and, if I ever see "little princess" again, I'll give him part two of my Navy vernacular.

      Judges and prosecutors are pretty much untouchable You cannot Sue them. They illegally prosecute and convict people all the time and are almost never held responsible. They have judicial immunity
      which allows this to happen. It's a pretty sweet system they have set up for themselves to not be responsible for their actions.

      ​The prosecutor of the duke lacrosse fake rape case only has to serve 1 day in countyjail for his illegal acts.. the family court judge who illegally entered a mans home andlet his ex wife rifle thru his personal items. Was thrown off the bench and he has sucessfully sued her in federal court. Those are the only 2 examples i know of were even a little action was taking against these tyrants.​@@Welderman007

    first. it doesn't matter that he DA and judge 'backed off' making him apologize. he needs to sue them for the threat in the first place. as the threat of punishment is all it takes for a violation to happen. and try to get that judge's immunity removed and sue him personally... bankrupt him.... AND have him removed from the bench. a JUDGE SHOULD KNOW that the 1st Amendment protects his speech and NEVER should have required him to apologize.
    Second, I'd sue the cop for harassment for his behavior for 1. extending the traffic stop by refusing to move away from the vehicle to allow him to leave after it was over... that's a violation of the 4th Amendment according to the Supreme Court on 'extending traffic stops'.... 2. it HAD to be the cop that reported that he cussed during the traffic stop in order to further get him into trouble because he KNEW that the DA and that Judge were blue line boot lickers and probably have done this kind of shit before... that's a violation of his 1st Amendment by trying to stifle his Free Speech by using the DA and the Judge to do the dirty work for him...

      In my mind, it is not "Clearly Established" when they authorize locking you up for months in coercive detention until they get their coveted "conviction". I spoke with one prisoner who had been fighting bogus charges who had spent over a year in the local jail. They know how to fatigue you into "compliance" since they know they no longer need "the consent of the governed". The quid pro quo relationship between cops and courts is clearly establishing a religion of "we say so with the "cuz law". What is the Cuz law? Just cus. Arbitrary power in protected municipalities always gets buried under a sea of obfuscation.

      Reading one of John Whiteheads post this morning, he summarized how the government likes to come up with their own labels describing personal behavior and conduct of others. But if we identify them openly knowingly and willingly destroying the lives, liberty or property of strangers, there is a financial incentive behind it. To label them as communist, pirates and scoundrels may to much too generous in some of the "memory holed" cases.

      There is a town in he state where I live that had cops who wrote citations for one MPH over the limit if the sign was passed even though slowing down. I was stopped for one over and as I was being lectured, a semi busting the limit went past in the opposite direction. The cop threw my stuff in my lap, went back to the patrol car, did a U-turn and went after the truck. If I could have found the driver of the truck, I would have bought him a steak dinner.

    Forcing someone to write such a "letter of apology" is a very clear breach of the First Amendment. Freedom of speech does not only mean that you can freely express any opinion you want without punishment, but it also means that you can't be forced to say what you don't want to say, or face punishment, ie. compelled speech.

    This judge is a great example of the huge problem caused by the go along to get along crowd. They have bowed to the self-appointed authority of these people to the point they just expect it. Its a blow to their ego anytime someone questions it or stands on their rights. They dont know or care about the law because they have never had to. People really need to wake up.

      The police and the courts invoke the sorcery of "magical thinking" that the rest of the 4th amendment is supplanted by "probable cause, reasonable suspicion, suspicious behavior and more specious excuses to justify the unjust. Like bubbles in a boiling pot, they rise to the top, do their damage and disappear almost as quickly as they attack, all in real time. When it comes to a rigged game, stranger danger is not just a wayward expression, I cannot deny the anxiety I experience when police present a clear and present danger, and the neighbors just bleat Oh well.

    The judge, in my case, was so old and senile he said if I don't pay the fine, they'll suspend my license. I was charged with driving on a suspend license.

      When we were kids ,a buddy got busted on his 4 wheeler and got a ticket.
      Went to court and paid it.
      Got a license suspension notice 2 months later because of a screwup at the courthouse.
      Oh, did I mention he was like 15 at the time?
      Do I even have to ask, how do you suspend a license when they arent old enough to have one?
      I'm sure they have a way ,they always do.

    Judge needs to be disbarred for his blatant violations of the first amendment protection of free speech. This Judge should know better, his failure to uphold the constitution, and his demonstrated willful disregard for this guy's rights shows clear cause to disbar him. Give him a taste of his own medicine, I'm sure he'll want to apologize for his willful disregard for violating this guy's rights. But that's not good enough. Make him find other career opportunities, because he's unfit for his current position! The simple fact he was willing to demand the apology letter under threat of deprivation of freedom is appalling, and needs a remedy like disbarrment to send a message that it won't be tolerated! This bullshit immunity for people who demand compliance and enforce law with convictions with fines,or imprisonment, need these same consequences for their unlawful actions, how else will they learn. That's how they justify punishing us! Why is or should it be any different for them!

    "Judicial immunity" = Judges are held to a lower standard than the average citizen, because "ignorance of the law isn't an excuse" for us.
