Strangely enough, laws around knowingly transmitting an STD including HIV varies from state to state, and at the worst, these charges are "reckless endangerment" or "assault". In Texas, there is no law that he would need to tell that he has it. I would be curious to see if they can elevate the charges anyway considering this was a sexual assault.
EVEN in Canada people knowing spreading HIV get kept in jail. It's been on the books now for twenty years.

In a consensual situation, in the state of Texas there is no law that he needs to disclose his HIV status. I do not know if it elevates any charges related to the fact that this is a sexual assault case.
There are only 13 states that require you to disclose your HIV status, which is REALLY scary to think about. Morally and ethically, there is something wrong with this. In the states where you are required to tell your partner... not telling them is at worst either "reckless endangerment" or assault.
@@RingoHalliday sorry, but you're misinformed. There have been several cases where attempted murder charges were filed against a defendant who knowingly infected others. In fact there's a Yale Law School Journal written about this very topic. (Look it up)
Also, those who don't disclose in a consensual situation still open themselves up to a civil lawsuit in both states that do/don't require HIV status disclosure.

By law, it has to be offered based on flight risk alone. That is how it works. A bond is nothing but a guarantee to appear in court. I am not saying that he is innocent, but in the land of the free, you are innocent until proven guilty by a court of law. This is not North Korea.
@@snowflakehunter Bond is not a guarantee to appear in court, otherwise there wouldn't be bail-bondsmen. They need to do away with bail and ensure quick and speedy trials so suspects are not detained for long periods in jail. Anyone who's detained on a felony charge should be in court within a week if they plead not guilty and take it to trial.

I was informed by a doctor that it's difficult to catch the virus unless there's a break in the skin OR you've had consistent sex with an infected person over a period of time. I'm guessing since it was a SA that could be the case. But you have 3 days to go to hospital to get a special medication if you've been exposed so I'm sure they are okay. I had this conversation after I had just been intimate with my partner and another woman showed up to his home. I ran to the hospital so fast and demanded to be tested for EVERYTHING.

Canada had a club security guy in Squamish "spash" 200 women while HIV positive (you have to TELL partners under law). The guy looks like a dud. I don't know what these women were thinking, or if it was the alcohol, but he admitted on the stand he didn't use protection as it "didn't feel good". One guy died in prison in Alberta for knowingly spreading HIV as a male prostitute. EVEN in Canada it's been considered the most major assault under our Criminal Code for two decades now.
They were probably trying to bribe him to get back stage.
