So it is very difficult to us ,nature of duties sometimes as per designation and sometimes as per Qualifiaction.

Sir, we filed a WP(C) in the high court against the UoI and the decision will come in our favour by the single judge. After that, the UoI filed Review Petition against the WP (C) decision. The Review petition was also dismissed on merit by the High Court. Then we filed a Contempt case against UoI for not implementing the decision of the court given in WP (C). In response to the contempt case, the court in its hearing mentioned that " . THE MATTER IS ADJOURNED AT THE REQUEST OF THE RESPONDENTS (UoI) BY A PERIOD OF 5 WEEKS MAKING IT CLEAR THAT IN CASE, THE RESPONDENTS DO NOT SUCCEED IN THEIR APPEAL OR DO NOT GET A STAY ON THE OPERATION OF THE ORDER THEY SHALL COMPLY WITH THE SAID ORDER FAILING WHICH RESPONDENT SHALL REMAIN PERSONALLY PRESENT IN COURT ON THE NEXT DATE OF HEARING." On that basis, UoI filed an LPA in the High Court and the high court issued a notice to our advocate with the direction to submit the reply of LPA within 5 weeks and give a new date for the hearing. Know I want to know what happened to our case can UoI implement the order of WP(C) or decision will be implemented after the outcome of the LPA filed by UoI. What happened contempt case filed by us. देखिए सुप्रीम कोर्ट में ही नहीं तो किसी भी कोर्ट में कैसे दायर तो कोई भी कभी भी कर सकता है। इसलिए क्या आपके सुप्रीम कोर्ट में दायर कर सकते हैं या नहीं इसका जवाब है जी हां आप कर सकते हैं। मगर केवल केस दायर कर सकते हैं और इस वजह से अपने केस दायर कर दी इसका मतलब यह नहीं की आप केस जीत जाओगे। आपकी एवं पी ए डिसमिस करने में हाई कोर्ट ने क्या लीगल गलती की यह जब तक आप सुप्रीम कोर्ट के दिखाकर कन्वेंस ना करोगे तब तक सुप्रीम कोर्ट में जितने की संभावना कम है।
Sir admission -25 क्या होता है। एक केस में नैनीताल कोर्ट ने amendment file करने को कहा है 10 दिन के भीतर pititioner को। और फिर अपने आर्डर में लिखा है list this writ pitition as soon as amendment file by pititioner. Amendment भी फ़ाइल कर दिया है, responder को नोटिस भी आ गए है ,इसे एक महीने से ऊपर हो गया है। responder कोई रिप्लाई नही कर रहे है इसलिये अब आगे सुनवाई कब होगी ,बताने का कष्ट करें।

So, accordingly High court has granted interim relief (status quo) still, is it necessary to file another application in State Administrative Tribunal pertaining to the impugned notice?
No. Not necessary. Once the matter is under consideration of the High Court and even interim relief is operating, then unless this writ petition is disposed of by high court by passing some order you need not go to administrative tribunal. It appears that your case is pending in the court, meaning that you also have a lawyer. So under the circumstances it is best to go by your lawyer's advice.

Sir, we filed a WP(C) in the high court against the UoI and the decision will come in our favour by the single judge. After that, the UoI filed Review Petition against the WP (C) decision. The Review petition was also dismissed on merit by the High Court. Then we filed a Contempt case against UoI for not implementing the decision of the court given in WP (C). In response to the contempt case, the court in its hearing mentioned that " . THE MATTER IS ADJOURNED AT THE REQUEST OF THE RESPONDENTS (UoI) BY A PERIOD OF 5 WEEKS MAKING IT CLEAR THAT IN CASE, THE RESPONDENTS DO NOT SUCCEED IN THEIR APPEAL OR DO NOT GET A STAY ON THE OPERATION OF THE ORDER THEY SHALL COMPLY WITH THE SAID ORDER FAILING WHICH RESPONDENT SHALL REMAIN PERSONALLY PRESENT IN COURT ON THE NEXT DATE OF HEARING." On that basis, UoI filed an LPA in the High Court and the high court issued a notice to our advocate with the direction to submit the reply of LPA within 5 weeks and give a new date for the hearing. Know I want to know what happened to our case can UoI implement the order of WP(C) or decision will be implemented after the outcome of the LPA filed by UoI. What happened contempt case filed by us. Consideration of arguments relating to violation of fundamental rights guaranteed under the constitution of India is not restricted only to the high courts or Supreme Court. That can be considered also by the Administrative Tribunal.
If your case falls within the definition of "service matter", then according to the judgement of the supreme court only Court of first instance would be Administrative Tribunal.
It would be a matter of being fortunate if the high court entertain the petition directly.
Please show your papers to some expert lawyer in the field and take further step only in accordance with his advice.

But if the plaintiff deprived of fundamental rights like article 14 or article 23 then is it possible by the constitutional courts to directly take cognizance as CAT is a quasi judicial body? I mean if the statute falls under constitutional courts.

देखिए सुप्रीम कोर्ट में ही नहीं तो किसी भी कोर्ट में कैसे दायर तो कोई भी कभी भी कर सकता है। इसलिए क्या आपके सुप्रीम कोर्ट में दायर कर सकते हैं या नहीं इसका जवाब है जी हां आप कर सकते हैं। मगर केवल केस दायर कर सकते हैं और इस वजह से अपने केस दायर कर दी इसका मतलब यह नहीं की आप केस जीत जाओगे। आपकी एवं पी ए डिसमिस करने में हाई कोर्ट ने क्या लीगल गलती की यह जब तक आप सुप्रीम कोर्ट के दिखाकर कन्वेंस ना करोगे तब तक सुप्रीम कोर्ट में जितने की संभावना कम है।
Sir admission -25 क्या होता है। एक केस में नैनीताल कोर्ट ने amendment file करने को कहा है 10 दिन के भीतर pititioner को। और फिर अपने आर्डर में लिखा है list this writ pitition as soon as amendment file by pititioner.
Amendment भी फ़ाइल कर दिया है, responder को नोटिस भी आ गए है ,इसे एक महीने से ऊपर हो गया है। responder कोई रिप्लाई नही कर रहे है इसलिये अब आगे सुनवाई कब होगी ,बताने का कष्ट करें।

Regarding your service matter, you need to first determine whether you are an employee of the Madhya Pradesh Tourism Corporation or the MP State government. If you are an employee of the Corporation, then your case may not be under the purview of the Administrative Tribunal, but you may approach High Court directly unless you have any other alternative remedy.
However, if you are an employee of the State government, then you can approach the State Administrative Tribunal to file your case.
I strongly suggest you to consult a practicing Advocate who is well-versed in the local laws and procedures, before deciding to file your case. They will be able to guide you better and ensure that your case is filed correctly.

So, accordingly High court has granted interim relief (status quo) still, is it necessary to file another application in State Administrative Tribunal pertaining to the impugned notice?
No. Not necessary. Once the matter is under consideration of the High Court and even interim relief is operating, then unless this writ petition is disposed of by high court by passing some order you need not go to administrative tribunal.
It appears that your case is pending in the court, meaning that you also have a lawyer. So under the circumstances it is best to go by your lawyer's advice.

The joining process has been delayed by the authorities for more than 7 months. So what we can do this in our case. Where to approach for our joining. About Compulsory retiredment...my father died on 10/10/21...can we go karnataka admit tribunal.. Are high court...in1996 he as been ordered to compulsory ... 2/3 of pension is not given

Sir state tribunal judgement diya hai, fir bi us judgement ko challenge karke oppotion party HC me article 226 te hat parciparans hua hai bolke case kiya hai, fir kya hamare requirment ke upor stay par sakta hai😭😭😭🙏🙏pls answer me sir. HC ne adesh diya tha 3 month ke andar case result dena parega SAT ko, fir bi sat 14 monthe k bad judgement diya, fir bi oppotion party HC me giya, ab hum kiya karenge sir plzzzz help me😭😭😭😭

Disposal of the case by sat in a delayed manner may not be right but that does not make the order of the SAT automatically illegal on that ground alone. The high court will also examine the merits of the order of the SAT. Only thing I can say is that you should fight your case well in High Court.
