    He established the following with his first call:
    1. She lied (she labeled him a misogynist in the approach).
    2. She is disingenuous, “I am in the exploring phase.” “But you put that as a fact about me. It doesn’t seem like it’s still in exploring phase, but rather you established this.” “You didn’t even talk to me.” “I was going to ask tomorrow!” “Yeah but the article comes out Friday. It will be written by then!” “No!”
    3. She is manipulative, “well it’s a technique to force them to respond.”
    4. She is ruthless/sociopathic, “you realize you can hurt my business and all the things that benefit from the festival. You are hurting people.” “Well I’m trying to write an article and that’s what matters to me.”
    So, Dave, you should take a shot a journalism! Rent a full page ad in the biggest competitor. The ad should be your own investigative journalism piece regarding the integrity and ethics of this journalist. Include all the quotes, established facts and a website address to see the video.
    Also, you should approach all of the Washington Post advertisers demanding they answer about how they feel doing business and supporting an organization who lacks ethics, is manipulative and sociopathic.

      "Digging up dirt" is absolutely happening by Dave's lawyers. It just won't be turned into tabloid. I'm sure he's playing the long (legal) game. These are both claims, that are in the letter and article, she asserts to be true. Then in the phone call, she admits that she doesn't know that those are true, and she only said them to get a response from sponsors. Then Dave asks why did you not talk to me before the article was published, she did not answer him on that question, saying I want to talk to you tomorrow. But that is too late, because the article will already be out there, and the damage will have been done. If this was a fair article, they would back up their claims with evidence, and would give him a fair chance to responds to that evidence. They did not, and therefore I think Dave could argue defamation because this is not a fair article, and people who will read that without context or doing researching for themselves, will now think Dave is a misogynistic person, with a pattern of problematic behavior.

      I didn't read the article bc you have to sign up for the wp and fk that, but according to the quoted email, she said "Dave portnoy, WHOS BEEN ASSOCIATED WITH..." That makes all the legal difference. It's been said before so they will just say she's not the one who said it.

      Depends on what gets published completely. They're opening themselves to a lawsuit, if they do continue down a path of negligent public portrayal, if they support their opinions with organized and structured means of malicious intent without source of truth. In civil tort law, it's not beyond reasonable doubt; rather evidence and relying on supported substantial malintent. Was the intent outright damaging? Was the piece reasonably supported by the facts? Was the piece reasonably giving the impression towards others/public that negatively impact Dave without any truth, attempts to pursue truth; the arguable definition of what is reasonably "truth".
      Intent and reason are the two most commonly repeated terms in both civil law and criminal law, because they are the two biggest factors towards defining legal language. These terms are constantly battling sides of roughly drawn grey lines, as laws are never just cut and dry definitions based on their language. Precedence exists because of this, otherwise new issues would not impact prior outcomes whatsoever. Thus, how reasonable the Post was to defend their position, how reasonable they were in offensively damaging Dave and Barstool by a malicious structured means, and how reasonable an opinion a public reader, customer, or partner of Dave/BS would form based on the piece, are the overarching issues at hand, followed first by the level of intent.

    honestly sounds like, they were hoping to get a sponsor to cancel under the threat of a negative article. Then reach out to you for comment on sponsor dropping your event. Self fulfiling hit piece. When they couldn't get a sponsor to drop the event they moved your interview back to give themselves more time.

      Yup, she defamed Dave to a sponsor and admitted in a recorded call that it was a deliberate and calculated lie. WaPo's lawyers (and everyone else) becoming aware of this made a follow-up call absolutely impossible. Especially with dave mentioning tortious interference in the call.

    The laws on recording vary from state to state. Where I live, so long as you are a participant in the conversation, you don't need the other person's permission or knowledge to record. Also known as 1 party consent law. Might be useful depending on which state you find yourself in when these issues arise.

      The reason there’s so few lawsuits against these media companies that blatantly and provably lie, is because the criteria for defamation includes malice. It’s hard to prove they lied out of malice (meaning the motivation for the lie, was to harm the person they lied about).

She lied on the call then admitted to intentional defamation with reckless disregard for the truth just to provoke a reaction from your sponsor. It was obviously attempted TI and again we don't even know if there was an article. If she'd gotten a sponsor to withdraw then she'd have had something to write about and satisfied that activist itch darkening her soul.       He can't sue for defamation, because journalists are trained day in day out to word things to avoid being sued.
      HOWEVER he does have a potential tortuous interference and him saying that phrase "tortuous interference" during the call absolutely must've set off alarm bells at WaPo and give their lawyers a heart attack - because there is definitely basis for a tortuous interference suit.

    Recording laws vary by state. Most states only 1 party of the conversation has to be aware that the conversation is being recorded, and it doesn’t matter what the laws are in the other state.
