She should have been penalized for lying about how many were in the home and thus gotten nothing. While I agree that a $400 refund for all their troubles was probably not enough, especially since they've been repeat customers for years that didn't cause any problems, I can't understand how they would be entitled to half the rental fee being returned. If they had left because it was so bad then I could see a case being made but arbitrarly being given a 50% discount for no air conditioning in part of the house and refrigerator problems has no basis in law. With that being said, had I been the owner I would have apologized profusely, and given them some options. Give them a night for free, or a reduced rate when the problems occured, or leave the rental and refund the unused nights.
I´m originally from Puerto Rico. Yes. 80s F isn´t bad. More so when it starts to heat at 11:00am and around 7:00pm is already night. That being said, I moved to Spain. Seville. Now, try 230 F from 11:00am till 10:00pm...if you´re lucky. Sometimes it doesn´t cool until past midnight.
I lived in communal apartment for 13 years, no hot water, no elevator, no AC, could not take showers and shared kitchen, toilet and bathroom sink with 30 people. We had rats, roaches, bed bugs and no heat in winter. Had to heat up rooms with wood in fireplace and every day went from the fifth floor to the wet and dark communal basement and hauled wood on my back (from age 7 to 18). And I miss it! Americans are spoiled, I am not American and after 52 years in this country I can’t get used to it.

I doubt the plaintiff would’ve complained much if the defendant had brought portable A/Cs or maybe window units. At the absolute minimum she could have brought several stand or box fans. I have a medical condition that causes me to sweat excessively from my head (all over it, including face and neck) so I absolutely hate to be too warm. Because of that I always verify that any hotel/rental that I am staying at has A/C even though I already know 99.9% do have it. So my “vacation” would be miserable if the A/C was out most of the time while the temps were in the 80s - 90s. I think a refund of half was fair. (Of course,I personally wouldn’t even take a vacation at the beach in the summer because of my situation.🙄)
The temperature normally drops at night. So unless it was over 100° during the day, it wasn’t 90° at night at the beach. The ceiling fan should have been sufficient. Whiney babies. And I hate heat. It’s a contractual failing. Just like if a tree feel through your apartment-it is an act of god, landlord isn’t at fault, but you should have to pay full rent either because the landlord can’t complete their end of the bargain (livable space). They rented a space w ac, but then there was no ac.
Yes it was an Act of God. JM didn’t blame the defendant. But the plaintiff paid for a vacation rental in a certain condition. If an Act of God had caused the electricity to be out for several days or if there was a flood and all the floors were wet and muddy, would you expect the plaintiff to still pay full price? The defendant wasn’t punished for something she couldn’t control. But if it’s between the owner and the renter, the renter should not be the one who bears the cost.

For some A/C is a luxury, for some it is not. But you should get what you pay for. If you are willing to pay for something that you didn’t get then have it, don’t complain if you don’t want to. Not unheard of at all, especially during peak season. We rented a cabin in the Tetons for six and that was 1250 per night for five nights.

They got less then half the rental fee. 300 of that 400 was deposit. So 1600 - 300 deposit = 1300 refund.

I lol at that. Especially given the circumstances of the central air. I think had the owner brought window units and fans maybe the ruling would have gone differently. However, window units aren't very attractive to look at and some ppl hate the noise of fans. If I owned property I would probably keep a few window units in storage just to keep my guests comfortable if a situation such as this one arises.

That Defendant is making money an unbelievable profit on that house & had a loyal customer for the past 4 years. So much so, that the Plaintiff took the conditions in stride. Sounds to me like she left them a space to get freaky and they broke the phone during their session. I have had phones that have charging issues, and they will die without warning... You have to get the charging port fixed if the issue isn't resolved after new cables/chargers.

Complaining about no air con in 91F heat, try it in Melbourne Australia when the temperature is 42C (107F) and then a thunderstorm comes and the temperature drops but the humidity goes through the roof. Unexpected things go wrong, you are at the beach, take advantage of it.
You are not paying for her vacation so the fact that you can tolerate a higher temperature is not relevant. She paid for a house with A/C so she has a right to expect that. The landlord didn’t even try to provide any other type of A/C or even fans.

I have a medical condition that causes me to sweat excessively from my head (all over it, including face and neck) so I absolutely hate to be too warm. Because of that I always verify that any hotel/rental that I am staying at has A/C even though I already know 99.9% do have it. So my “vacation” would be miserable if the A/C was out most of the time while the temps were in the 80s - 90s. I think a refund of half was fair. (Of course,I personally wouldn’t even take a vacation at the beach in the summer because of my situation.🙄)
The temperature normally drops at night. So unless it was over 100° during the day, it wasn’t 90° at night at the beach. The ceiling fan should have been sufficient. Whiney babies. And I hate heat. My comfortable temp is 72°. I see her butt didn’t leave and check into a hotel if she was sooooo uncomfortable.

It’s a contractual failing. Just like if a tree feel through your apartment-it is an act of god, landlord isn’t at fault, but you should have to pay full rent either because the landlord can’t complete their end of the bargain (livable space). They rented a space w ac, but then there was no ac.
Yes it was an Act of God. JM didn’t blame the defendant. But the plaintiff paid for a vacation rental in a certain condition. If an Act of God had caused the electricity to be out for several days or if there was a flood and all the floors were wet and muddy, would you expect the plaintiff to still pay full price? The defendant wasn’t punished for something she couldn’t control. But if it’s between the owner and the renter, the renter should not be the one who bears the cost.
The posted ad included certain amenities so she didn't get what she had paid for.

For some A/C is a luxury, for some it is not. But you should get what you pay for. If you are willing to pay for something that you didn’t get then have it, don’t complain if you don’t want to. But paying $450/night and then accepting less than what you were promised for 6 out of 7 days seems pretty foolish to me.
