  • We explain the divorce process in 5 easy steps:
    Step 1 - Proof of Marriage. This is normally done with a marriage certificate. If it is in another language then you will need to change it to English, however, if you don’t have a marriage certificate then our family law experts can assist you in getting one.
    Step 2 - Proof of Separation. You must show that you’ve been separated for at least 12 months before filing your divorce application. If you are still living together in the same house, you can be considered to be separated. You don’t need to officially register your separation, however, you should take note of the date that you and partner do separate. An easy way to do this is to write an email to one another confirming the date of separation.
    Step 3 - Care of Children. If there are children involved with the relationship, you must have some arrangement where the children are safe and are properly taken care of. The court must be satisfied that the children are not being neglected and have a place to stay.
    Step 4 - Submit the application online. Preparing and submitting a divorce application is now an easy process. The easiest way to submit the application is online. In order to do this, you will need to register with the Family Court.
    Step 5 - Serve application on ex-partner. Once you have completed your application, you must serve your application on your ex-partner. You must give it to your ex-partner at least 28 days prior to the divorce hearing. If they live overseas, you need to allow for 42 days.

    Hi, I have a question for a friend of mine Who is a Filipino citizen currently living in the Philippines and has been separated from her husband since 2010. They got married in the Philippines and her husband is an Australian citizen. They’ve been separated for 15 years because her Australian husband was both physically and verbally abusive to her. She has photographic evidence of the abuse. He has a mental illness but never took his medication while they were married. She has been trying to get an annulment in the Philippines for about 15 years now, has spent thousands and thousands of pesos on two different attorneys in the Philippines, but still no luck. And her separated husband has never cooperated, even though he apparently has moved on many years ago, is back in Australia and has had other relationships with other girls since that time. Meanwhile, my Filipino friend has been stuck living like a prisoner unable to move on with her life for the last 15 years. So the question is how can she get divorced from the Australian guy if he is not cooperating in the matter, and help in the divorce be recognized in the Philippines? I mean, she can go abroad and legally get a divorce in some countries, but in the Philippines for divorce will not be recognized and get in legal trouble there.

      Yes this is possible, you will need to establish that the Australian courts have jurisdiction to get a divorce order:
      You are able to get a divorce in Australia even if you were married overseas if one of these conditions apply to you:
      1. You or your spouse are an Australian citizen, or
      2. You or your spouse think of Australia as your home, or
      3. You and your spouse normally live in Australia and have lived in Australia for at least one year immediately before applying for a divorce

    Hello sir!
    I have a problem about my ex Australian husband. We separated for almost 5 years now. I am living in the Philippines and he is there in Australia. We got married October 28, 2016. Since then we have no communication anymore. I want to apply a divorce but I don't know how to start it and what to do first. We got married in Darwin. Please help me what to do. I am willing to pay.
