The problem is the wording of the law. As it is it says that anyone even pointing a firearm at someone SHALL be charged, It should say MAY be charged. The difference is that in the first case there is no room for common sense or taking the circumstances into account and simply let the court decide. The second case allows police to decide whether charges should even be laid once all the evidence is taken into account. HUGE difference in that one word change.
@JohnDeereR-zw3wj actually you left out the most important phrase in the clause; "without lawful excuse". So there is no requirement to charge based on that. If that were the case, the police would have to be charged whenever they pointed a firearm.
The problem is the wording of the law. It states that simply pointing a firearm at someone means that you SHALL be charged. This leaves the police no choice whether to charge or not. If he law said you MAY be charged, then that leaves room for police to decide themselves if the circumstances warrant even laying charges. Police actually have no choice when it comes to laying certain firearms charges.
@JohnDeereR-zw3wj not to be argumentative, but you are not reading that section in its entirety. It says it's an offense to point a firearm without a lawful excuse. the supreme court of liberals had someone place a straw-case placed which was intentionally lost in order to guarantee the liberals the assertion that "self defense" using a gun isn't a right in the mid 1990s. I say "straw-case" because any competent lawyer should have been able to perfectly reasonably argue that no other reasonable thing other than a gun actually comes close to guaranteeing that right of equality.

I had a neighbor who had a mental meltdown because he thought my dog pee on his cedar. He was right in my face screaming at me so we had a little tussle. He went home and called the cops on me. Then 2 days later he showed up at my front door pounding on the door and ringing the bell furiously. Hes lucky i didnt own a gun. He did the same thing to another guy down the street a month later but this time he got arrested and had to go to court. Hes been behaving since but that man is a threat.
With logic like that, perhaps change your handle to ''numbskull''! You seriously would have considered shooting someone because they were acting immature? Perhaps it's people like you that give respectable firearm owners a bad name? Jumping to severe conclusions is infantile at best.
I appreciate all that you're doing. The right to speech and self-defense of the two most fundamental rights we need in to maintain a free society. But one point of order, if someone's kicking in my door I may not know whether or not they are armed. The homeowner is not the aggressor, the one kicking in the door is the one that crossed the Rubicon.

Better to be judged by 12 than carried by 6. Just know that if you use a firearm for self defence they WILL arrest you and you will have to fight for your life again in court.
I defended myself with a firearm some 35 years ago. Was charged and went to court. Charges dropped, cause the procecutors witnesses didn't show up. Stayed the charges. Got my hand gun permit after and just renewed my FAC.
The problem with the laws in Canada is that even if you were completely justified by any reasonable measure, the government will still put you through the wringer even though they know the charges will be acquitted. The process is the punishment. As far as I am concerned, if a police officer would have been justified in a self defence shooting, then so should any citizen.
Scary thing is say for example you did use your firearm in Toronto/Vancouver for self defense you'll be dragged and cuffed immediately and thrown into jail. They treat you like a criminal for doing the right thing.
That's the problem, your guilty until YOU prove that you are innocent. And by the time you've done so, you're in debt of $75-100K in legal bills, which you can't sue the government for it. Crazy!!!

People who honestly didn’t have a just cause for self defence will hide behind that and use it as a justification.
So we need to be careful when looking at this, But I agree we need to roll back some of these absurd prohibitions that have recently been put in place.
You guys are one of the most amazing people that I've ever come across and I am proud to actually be subscribing to you guys and supporting you guys as I'm a firearms older myself and I don't think anything that's the liberals have been doing with the federal government has been anywhere remotely positive for anybody even outside of gun enthusiasts. So keep up the good work!!
Why does nobody ever reference the "Citizen's Arrest and Self-Defence Act" of 2012, passed by the Harper government? We DO have a right to defend ourselves, written in law.
the supreme court of liberals had someone place a straw-case placed which was intentionally lost in order to guarantee the liberals the assertion that "self defense" using a gun isn't a right in the mid 1990s. I say "straw-case" because any competent lawyer should have been able to perfectly reasonably argue that no other reasonable thing other than a gun actually comes close to guaranteeing that right of equality.
You been to Canada lately? JT doesn't let those laws happen!
Because it's all fake, there is no process or system, only people saying whatever's convenient in the moment.
You guys doing a great job absolute right to self defence at home and conceal carry wouldn't have all this criminal activity going on
Thank you For all your hard work, and all that you do for Canadians
I appreciate this down to earth discussion. Thank you.
It's alright to use a gun to defend a Brinks truck or a politician but not our family. What has *really* occurred in this country?
When you and your family's life is on the table. What are you going to do????? Bonnie and Clyde didn't care!!!!!
Thanks for everything.. Rod, you're looking better praying for you
Thank you CCFR!
Lol, tracy sounded like the understanding mom: "They sort of lash out. I'm frustrated too, I understand. But that's not the answer".
I love this organization.
Citizens deserve the absolute right to defend themselves, family and property by any means including by fir ear ms. When the state bans this, they are basicaly declaring that people are sla ves, not free and equal citizens.
The only knock I've ever had with the CCFR, is really one I have with nearly every gun owner I've talked to. Is the fact that wording like, "we're not trying to be like America" or similar speech. Because such speech is really saying that there is a level of gun control, against non-criminals, that's acceptable. Which is the slope that got us to where we are today
Agree 👍
It's good you have clarified that!
Hey CCFR!! I am with you on the right to bear arms and the justification of necessary force. All the way. We should have and maintain the right and ability to do so.
But we, as a family, need to encourage our fellow firearms owners to study and know the regs. for themselves so that there isn’t these dumb moments that bring every body down. Know what you have in your lawful possession and how to store it. And store it and the ammo appropriately.
That’s just a beginning. Look after your own stuff and stop whining……. Maintain your rights and don’t supply the politicians with ammo to shut us down……..
Keep doing the work guys. It's CRITICAL
Great stuff you 2!! You are our voices. And your composure makes me proud of the both of you. I would let my anger get the better of me in a court room. Respect and many thanks.
We shouldn't have to defend ourselves and our family twice. once from a criminal, and once from our own government
IF I have a right to self defence then I have a RIGHT to any tool that allows that defence to be effective. In Canada you will be charged with a crime first, then it is up to you to prove that you acted in self defence.
This needs to change
Welcome to the new reality! I have encountered so many people who, on current events or issues of interest, seem incapable of doing even basic research. It seems to be the prevalent norm of 'tell me, tell me, explain to me, " etc. I'm continually saying check it out, do some research, and statements to that effect. God bless your good work! Given the bone-headed stupidity infecting our society and the forces arrayed against us, I fear it's a losing battle but keep fighting the good fight. I've been trying to overturn the Liberal lies for over 35 yrs.
The age old art of self preservation ‼️👍👍👍👍👍👍
You guys are *SO* underrated for your efforts. Please don't give up! 👍
“You can’t use a gun for self-protection in Canada. It’s not a right that you have,”
Justin Trudeau
Unless you are Justin Trudeau then you can be surrounded by them, at the Canadian taxpayers expense.
When has that idiot ever been right about anything.
the use of proportional force is allowed to defend yourself.. ROD JUST STATED.. AND BTW IS ALL AROUND THE WORLD LIKE THAT .( or at least the civilized I'm aware of)
Then trudy needs to get rid of all his armed guards.
Private citizens can also become security guards and use g uns to defend Brinks trucks.....just not your family.
Good point and it clearly shows the hypocrisy of the state.@@LegendofNelda
Rod/Tracey, we really appreciate the work you are doing for us. Never give up, we’re standing with you!
You have the right to defend yourself.
It is a God given right.
Despite what Justin the traitor Trudeau says.
I will use whatever I have at my disposal to defend myself, My family and my home.
Keep up the good work you do. Much appreciated from Alberta.
You have a thankless job, especially in these past few years with the run-up to covid and the sweeping B.S. bans put into place. People are rightfully pissed off, but without the CCFR we wouldnt have many people fighting for our rights. So Thank You.
Thank you for your hard work
I agree, proportional force may be legal. the problem is getting proportional response ready when needed (Removing security devices unlocking munition, loading). A loaded gun stored in a quick access case is a criminal offence in Canada.
Keep the mag separate from the pew pew.....in the same case.
@@useryggfdccfirst, I want to say that pointing a loaded firearm at any person is unfathomable to me but not impossible when circumstances develop to such a condition requiring it regardless of any legal consequences. i.e: rather be judged by 12 than carried by 6. So, having said that, SOR/98-209 is some of the most convoluted law regarding firearms in Canada. Yes, it allows the storage of ammunition with a firearm but it appears that the process is "NESTED". That is: Gun in vault and ammunition in locked container in same vault. I like your interpretation better but?
P.S. just trying to be helpful.
@@TheSkillkeeper
Having the Law punishing a person if in a life threatening situation he have to point a firearm at a person is absurd.
That actually force the defender to pull the trigger instead of trying to stop the attack.
I, for one, appreciate all the efforts you and the CCFR put forth for law-abiding Canadians, currently not a member but will be in the near future. Thankyou again
Thank you.
Good on the CCFR for Clarifying their Policy ! 👍👍🥰
Tanks both for your efforts!!!
We need an update to the Canadian Charter of Right, it just have the right to self defence, defence of another person and defence of property. Keep up the great work CCFR, member for life.
Where I stand on Self Preservation (Defense) is that I STAND MY GROUND.
Thank you
Everything living thing has a right to defend itself. No government can change that
archery less storage requirements
doesn't disturb neighbors
I couldn’t find a policy on suppressors on the website. I know your position but maybe it should be added. :)
Just a quick point: You don’t know if they’re armed if they’re “kicking your door in” unless you have X-ray vision. The very fact that they’re kicking your door in should be enough.
IT IS.
Is there a video where this self defence with a firearm in canada is explained?
That would be really good information.
Thanks
try that Runkle of the Bailey guy he has lots of videos on almost every subject with guns.
States right in section 20 of the firearms act that protection of life is a valid reason to own a firearm.
Summon the Lawyer Elf!

Asking TURDO how many are in his security detail must be taboo in the HOC
I would Fully support self defense with a firearm as well as concealed carry! The way our country is going it's glaringly clear that we need to push for this kind of thing!
Anyone in this community paying attention, is thankful for all you do at the CCFR. If not for the CCFR standing up for our rights, Canadian PAL owners would be in an even worse predicament. I can't think of anyone else that even comes close to the effort the CCFR has made.
Maybe its a good thing you don’t own one
With logic like that, perhaps change your handle to ''numbskull''!
You seriously would have considered shooting someone because they were acting immature?
Perhaps it's people like you that give respectable firearm owners a bad name? Jumping to severe conclusions is infantile at best.
We have every right to defend ourselves.
You do good work, thank you.
100% bang on folks
I appreciate all that you're doing. The right to speech and self-defense of the two most fundamental rights we need in to maintain a free society. But one point of order, if someone's kicking in my door I may not know whether or not they are armed. The homeowner is not the aggressor, the one kicking in the door is the one that crossed the Rubicon.
Pierre Poilievre For Prime Minister!! 🇨🇦
PP likely with his liberal poli-sci degree in "international relations" told Harper to keep the CBC funded... well at least when they still had Don Cherry, that was.
Good. Thanks.
🙌 it's a Last resort up here, not a go to, even with that state of mind. BUT it is proven more people carrying has lowered crime in many places. CC in canada Could be a good thing with the time change. Maybe our New PM might have an open kind with the way of the world these day. I'm here for the knowledge you share, Seems a lot of us have the same look at it, just a different approach to it. Appreciate the channel thanks for Clarification kn your Support for safe self defense
If someone is kicking my door in, I’m not going to wait around to find out if they’re armed.
Absolutely self defence
If evil intends to do harm as they usually do , defend yourself and love ones at all cost.
Better to be judged by 12 than carried by 6. Just know that if you use a firearm for self defence they WILL arrest you and you will have to fight for your life again in court.
Here in Alberta we still subscribe to the three S rule on the farm.
Guns will get you trough times that money won’t !!!
I defended myself with a firearm some 35 years ago. Was charged and went to court. Charges dropped, cause the procecutors witnesses didn't show up. Stayed the charges. Got my hand gun permit after and just renewed my FAC.
Whether in your home, in public or in bear country, a gun makes the best tool for a defensive emergency.
"I rather be judged by 12 than carried by 6"
What was the self defence arvument in the court ? I cant find it.
The problem with the laws in Canada is that even if you were completely justified by any reasonable measure, the government will still put you through the wringer even though they know the charges will be acquitted. The process is the punishment. As far as I am concerned, if a police officer would have been justified in a self defence shooting, then so should any citizen.
WARNING ! I keep my house locked to protect you from me........
🙄
Some people expect everyone to do everything for them while they do nothing.
Crazy!!!
If people are asking question about self-defence using fire arms....it is simply that the rules and regulations are forvever changing and interpretations kick in adding to the confusion....so don't call people lazy for asking questions.
