Marriage Fraud Interviews - i.e. the Stokes Interview - is NOT what you think

  • The infamous USCIS marriage fraud interview is not what many people online seem to think it is. When applying for legal permanent residents status through a spouse, an interview is mandatory. However, most interviews, even the vast majority of them, are not marriage fraud or "Stokes" interviews. Rather, they are straightforward interviews that allow the interviewing officer to judge whether two people are who they say they are, whether their marriage vibe is genuine, and whether there is any missing or inaccurate information that USCIS needs to follow up on.
A marriage fraud or "Stokes" interview, which comes in at least two distinct flavors - full and mini - is an interview that can be formally or spontaneously initiated by the officer if she suspects fraud. This is the interview where, infamously, people are asked about seemingly inconsequential details about their partner, like the color of their toothbrush. The questions asked in this stokes or marriage fraud interview are standard in an of themselves and owe their existence to a U.S. Supreme Court case.

Me and my spouse are separated for the past 15 months . In the next coming month we have an interview to remove the conditional green card. What should I expect? cause him & I are not communicating. Please give me some advice whether I should even go. And if I don't go, what are the consequences?
