There's one last wrinkle in this sordid tale:
In the episode 'Money Talks', Mr Krabs makes a deal with the Flying Dutchman, selling his soul in exchange for the ability to talk to his money.
Honestly, the biggest red flag here is that Mr Krabs seems to have a _very_ good idea of how these dark pacts with otherworldly spectres tend to go. He fasttracks through the Dutchman's warnings and even gives an implication he EXPECTS this sort of thing to cost him his immortal soul as he signs the contract. ("Yeah, yeah, my immortal soul, whatever...")
Sure enough, at the end of the episode, when the Dutchman comes to collect his due, he reaches inside Mr Krabs and pulls out a piece of paper.
*I.O.U One Soul*
It soon emerges that Mr Krabs has sold his soul to over a double digit amount of spirits and wraiths (as well as SpongeBob himself), and they all hold similar claims to Mr Krabs' soul.
So what does this mean?
Well, with Mr Krabs having made so many pacts with entities both living and deceased, this means that upon death, his soul would be in proverbial escrow until true ownership could be established.
While the legal dispute in the underworld court runs it's course, Mr Krabs' spirit would be trapped in the SpongeBob equivalent of purgatory until a true decision can be reached. And even then, it's highly unlikely his soul would ever end up in any form of afterlife, as he'd be bound to whomsoever holds legal possession of his immortal essence.
In short, _his prison sentence is the least of his worries._

It’s like the consequence of using the Death Note. Let’s just not give Krabs any ideas.
Under most common law systems, the most effective claim to ownership over Mr. Krabs' soul would be that of whoever signed the earliest notarized contract of sale. In short, whoever bought Mr. Krabs' soul first gets to keep it, and all subsequent sales would be null and void.
However, there's a very real case to be made that the sheer amount of fraudulent sales in this situation would cause undue harm to the other supernatural beings, too much harm for the underworld court to write off. In this event, Mr. Krabs could very well be looking at a class action settlement whereby his soul is divided into pieces and distributed among his many creditors in order to, to use the legal term, "make them whole". This is most commonly seen in real-world bankruptcy proceedings, after all; albeit with physical property and financial assets, rather than one's immortal essence.

Although it could be argued, SpongeBob was complicit in this, it should also be noted. Mr. Krabs wasn’t paying SpongeBob to capture any of those jellyfish that he was using for profit. I don’t know if that would cause any legal consequences, but it’s definitely not going to help in a potential case against Krabs

I do remember that Mr. Krabs is the true criminal mind of the SpongeBob SquarePants series, and worse than Plankton is. Yes, Mr. Krabs has been exploiting SpongeBob and Squidward for years and paid them back almost nothing for their jobs at the Krust Krab for years. I didn't know as a child at first that this greedy krab is actually the villain of the SpongeBob series, but when I did, I grew an antisocial conscious as an adult that Mr. Krabs should be imprisoned for every money scheme he pulled over the years ever since SpongeBob's first day of work at the Krusty Krab. The only reason why Mr. Krabs still isn't imprisoned after all these years since 1999, is because nobody in Bikini Bottom wants to see the Kristy Krab out of business and don't know how to function without eating Krabby Pattys all the time. But if Mr. Krabs WAS finally caught, I'd imagine that he'd be more afraid of the fines than the time sentence in jail.

In defense of Eugene regarding the whale thing, Plankton in the first movie took over Bikini Bottom and brainwashed nearly all the residents, including King Neptune to serve him and rebuild the city in his image. And this was AFTER framing Krabs for theft of Neptune's crown, leading to him being frozen (allowing Plankton to steal the Formula unchallenged while Spongebob was searching for the crown) and set to be executed in a week.
And that's JUST that movie, not counting the other movies/specials and regular episodes of him at best just harassing Krabs trying to steal the formula and at worst causing city-wide mayhem. I'm just sayin that tormenting Plankton through his whale phobia is honestly pretty light compared to what he's done, including actively trying to get Eugene killed.
Apparently that movie happens at the end of the series timeline-wise.

There was also the episode when he steals a growth serum from Sandy and uses it on a Krabby Patty, which then gets sentient, grows 100x its size, and then proceeds to eat (Or absorb however you wanna put it), the residents, and buildings of Bikini Bottom. Im no lawyer, but I assume an event like that could induce serious trauma, which if its caused by another individual purposely, could end in major fines.
There was also the episode with the Mana Loa. When Mr. Krabs turns a very unsafe boat into a sub-par theme park ride, which snaps from its restraints, and blows up. Injuring everyone on bored. He does get arrested in the episode, but he could be BOILED ALIVE with the amount of people who decide to press charges.
