Jacksonville Officer Uses Taser on Shoplifting Suspect

    Jacksonville, Florida - On Thursday, May 11, 2023, the Jacksonville Sheriff’s Office responded to a call for service at 929 South McDuff Avenue. While on scene, a Family Dollar employee flagged him down in the parking lot and informed him that a man, later identified as Daniel Forrest, had just stolen from the business and was running across the area. The officer drove and caught up with Forrest on some railroad tracks. “Hey come here. Brother I’m going to (expletive) tase you, man,” the officer said.
    The officer used a Taser and Forrest fell and hit his head on the pavement. After the officer put handcuffs on Forrest, he called for an ambulance. “Just send rescue,” the officer can be heard saying. In accordance with policy, the officer asked the Jacksonville Fire & Rescue Department to assist in evaluating Forrest after the CEW had been used. Forrest was taken by JFRD to a nearby hospital, where it was discovered that he suffered internal bleeding. He's still in the hospital. Forrest’s family shared photos of him in the hospital. His family said doctors told them he might not make it. According to JSO, the officer's use of force was within policy.

      This department will be writing a check. I'm a former Taser instructor for an LE agency. Taser-induced falls causing serious head injury is a top training topic and very likely to occur when a suspect falls, especially to the side or backwards. While it is hard to mitigate, it must be taken into consideration before deployment. Humans are designed to instinctively break their falls and protect their head, but the Taser interferes with the muscle movements needed to do so. Once an officer uses force or "seizes" a person, they are responsible for their safety. He was seized the moment the Taser trigger was pulled, not when the officer cuffs him. Further, the context of a Taser deployment, including reasonably apparent potential for harm to suspect, can elevate it to lethal force, vs. less than lethal force. For example, tasing a suspect that is likely to fall in front of a truck or off a roof is a situation that can result in serious bodily injury, permanent loss of a normal body function, or death. Even if that doesn't occur, the deployment would have still needed to meet the threshold for lethal force to be appropriate.
      So, while inherently reasonable that an officer would use a Taser on a fleeing suspect, the officer must evaluate the likelihood of injury to the suspect, the suspects actions, and the seriousness of the offense. In this case, the risk of serious injury was too high for a misdemeanor offense where the suspect was not presenting a weapon of physically resisting the officer. If the suspect hd had a knife, was though to have had a knife, had said words to the effect that he would hurt the officer, or was otherwise presenting a clear or reasonably demonstrative threat, then the context is such as this could be a "good" use of force. I see that the officer ruled this within policy, but I suspect that is a protective move more that anything. I hate it for all involved and I think the officer should not be overly disciplined, but this is gonna cost taxpayers.
      In any case, the Taser, as many commenters have implied, has proven to be a problematic force tool that often under performs or is used when inappropriate. I found that most people who needed tased were not really affected, and the ones who were affected could have often been handled differently anyways. YMMV and IMHO.

Whenever an officer has to use force, no matter the level, there is always an inherit risk of injury up to and including death from the rapid sequence of events that unfolds during the use of that force. He brought that on himself through choices HE made. The initial crime he committed is irrelevant.

      Don't run from the police, I didn't hear the officer say he was police rather stop or ill taser you... if he is suspected of a crime the officer could have advised he was "under arrest for suspected shoplifing" the suspect did appear to have a mental illness shown in the video, after he was tassered ... the video is inconclusive in my mind

It is unfortunate that he hit his head hard. That sucks. But it could've been avoided if he didn't run or better yet, didn't commit a crime.

      Tasers are actually 95-98% effective when properly used, it's just that none of the officers seem to understand how they work.
      Both prongs have to pierce the skin in order for a shock to be delivered.
      Tasers aren't heat seeking missiles, they need to be aimed properly and administered from the correct distance.

      Oh, and another thing....don't expect me to SWERVE to avoid hitting your police car!
      You can walk about a half to three quarters of a mile beyond the road crossing to TRY and retrieve your personal possessions
      provided your police car isn't engulfed in FLAMES.

When the officer caught him at the tracks and told him to "come here" the guy should've gone "darn, my actions have consequences, guess I'll come clean" and just walk to the officer. If he complied and worked with them the charges would have almost certainly been dropped.
      But no, he had to turn it into a whole ordeal. Who the hell runs from cops over a misdemeanor shoplifting? The guy is just an idiot, period. This is 100% completely his fault. He chose to steal, he chose to run when the obvious action was to NOT run. Bad choices produce bad endings.

    That's why tasers are called "less than lethal" and not "non lethal", because although it is designed to be less than lethal in certain circumstances they can become lethal. In this case the circumstances were a suspect who decided to disobey a lawful command and headbutt the pavement, which could have all been avoided by simply complying or better yet not stealing.

      I remember back in the days when, we the people, were told that a tazer would only be allowed in situations where a gun would be the last resort: an unarmed man fleeing on foot should not warrant the use of a gun so I don't think it was the right choice for the officer to use a tazer. I think he simply didn't want to run today.😎

    Unfortunate, but his own bad choices landed him in the hospital. A really petty crime to almost die for. I took a 5 dollar bracelet for this girl I was dating when I was 14. I got caught, patiently waited for the officer to come. He wrote me a ticket turned me over to my parents. I did what I was told to do by the court. It was eventually expunged, and I’ve never gotten in trouble again. Learned my lesson early about responsibility for my own decisions, and I hope he does too.

      Dang. I stole hundreds of times. Only caught once. Still didn't care. Only when I was busted on ice after being locked out of the house naked after verbal fight in bedroom, did I get the point. I was one of these guys darn near(aside from the killers, rapists, cop haters, or ANYTHING violent) but all the dumbasses in these videos, that was me 10-15 years ago. And it just makes me grateful for the cops who believe in what they're doing. If not for their job, soooo many more people would die, be killed, overdose, raped, etc....anyone who says "defund them", I hope they get to that point, where they eat their words. And realize anarchy does not look like peace and comfort. Police maintain order and reiterate that consequences always follow actions. Cuz some kids truly believe consequences are only what adults want them to be. "If not for police and adults, there would BE NO consequences for ANYTHING 😠 If only they would listen to us kids. Legalize looting, if youre minority, legalize drugs, stop arresting violent homeless people... then crime would go away. Racist conservative fascists!" Hmmmm.       I shoplifted quite a few times when I was 14 too. I didnt even feel bad about it, and I wasnt a troublesome kid (straight As etc) but I just didnt realize how wrong it was because "everyone was doing it". I eventually got caught and have never stolen anything since and now Im a doctor

      21 years working for the railroad in Transportation /Operations and while I've never hit a stopped police car, I did take out a fire truck and several hoses. Just because a train isn't there now doesn't mean there's none coming! Folks, if you can't clear a crossing in 20 seconds, wait! If you've got a situation where the crossing is obstructed, do not call 9-1-1, call the phone number on that blue sign at the crossing.

      @@alfredthorneborn6295 he didn't/doesn't deserve to die. But he made his choice. No one forced him to run. The officer very easily could have tackled the guy and he still could've hit his head and gotten the same injury or worse. All in all it's a sad story that didn't need to end this way. But as I said, he made his choice. That's a risk you take running from the cops. You fight the cops in court, not on the street.

      It wasn’t the taser…it was the asphalt that did the job. You could see the blood spot he left where the back of the head hit the asphalt.
