Yeah that's less than Basic Combat Training for the Army, and Basic isn't really your training. Most MOS's (your job in the military) have a longer AIT (school for that job) than Basic. No wonder cops don't usually know the law...

I was worried the Jury were going to find him guilty despite the fact there was no evidence presented by the prosecution only hearsay because Juries are fickle and don't like to go against police especially with DUI. Nobody likes a drunk driver so you're usually guilty in the eyes of most people before you even go to court.
Change my mind: Jurys at the end of every case should also have to rule on whether the cops or prosecutors should be criminally charged and if they rule yes, then they must be charged with all possible charges.

I am not shocked having watched the trial. The behaviour of the prosecutor was what shocked me. The lack of any investigation resulting in any evidence was shocking. No pictures of the vehicles or of the skid marks, no breathalyzer, no blood test, witnesses favouring the defense. I could never have found him guilty. I have to wonder how many innocent people have been convicted in that proseeutor's jurisdiction because they did not have a lawyer or did not have a good lawyer.
We all need a lawyer like Larry here otherwise the state will automatically win and good people get screwed over by tyrant cops who just wanna get someone on some kind of charges.

It can be evidence, it is just not a hard fact. And the evidence needs to be weighed against other evidence and other plausible theories of the incident. So, it was extremely weak evidence without any supporting facts.
Witness testimony can be considered evidence of the jury believes the witness is credible. Like if he said he saw him drink and then watched him drive drunk and that is why he arrested him they could use that testimony to convict him. But all he did was “smell” him. Even if they found him credible, he still had no testimony to prove he was drunk.

I think the whole county is suspect. Why wouldn't their police have cameras? Last case I heard of with no body cam was the ATF when they raided and killed a guy in Arkansas. Why they didn't have any cameras? It's not a budget issue, the ATF makes 100s of millions of dollars off of just NFA tax stamps and transfers and they only have 5800 employees or so. They have plenty of money coming in, so why no cameras when they were raiding the home of a suspected gun runner?

Even if he had 1 beer at 2 hours before the accident, he was not drunk driving. And the 360 ° turn of car 2 is because of the point of impact from car 1. I don't think the commonwealth proved guilt and there was a lack of evidence.
The prosecutor was pretty slimy. The officer and himself had an opportunity to get the jails video. They had an opportunity to get the EMT, nurse or whom ever else to help their case. He knew he had nothing and tried to bluff and failed.
Larry, I watched all three videos and seeing this verdict has restored a little of my faith in the jury system. Great job! I must say I was struck by the casual way this judge ran his court....those were not just speaking objections, those were soliloquies. The banter back and forth by counsel, counsel testifying during examination, the endless leading during direct... let's just say my idea of order in a court is a little different from this judge's court. But I know every judge is different. I also noticed the jury was out only 18 minutes. That barely gives them time to walk down the hall to the deliberation room, elect a foreperson, and then vote. I'm surprised they didn't just raise their hands in the courtroom and say, "Your Honor, there's no need for us to walk down that hall... The defendant is not guilty!"

Similar here. I found out after, because a jury person told me, that the first vote was 11-1 for acquittal. Took three more votes, no changes, and one of the jury people said "hung jury" and the one hold out voted for acquittal. All within 40 minutes. :-)

Toward the end of the persecutors closing comments, didn't he make a Fifth Amendment violation? Legal precedent and the Fifth Amendment says the court and the persecutor can't use a defendant's invoking of his constitutional rights against them. Just as somebody refusing to answer questions cannot be held against them, their refusal to participate in a field sobriety test shouldn't be held against them either.
In most states, the implied consent statute makesrefusal (after probable cause) admissible. "Implied consent" is a legal fiction that, when one accepts a license it constitutes a "contract" between the driver and the State that the driver will consent if there is PC that he is in control of a vehicle while under the influence, thus an exception to 5th Amendment right not give evidence against yourself. I would agree, but it seems to be a grey area where the State views refusal as suspicious, whereas civil-rights minded would see it as an exercise in rights. Judges seem to lean toward the latter as well, unfortunately.
By the domineering way the prosecutor spoke to the judge at the beginning of the trial, to the way both the judge and prosecutor admitted they didn’t expect this trial to take so long to present, demonstrates how most DUI cases probably go in this county. Were it not for the awesome representation from defense council, I believe the defendant would’ve been found guilty, regardless of the aforementioned 11 reasonable doubts. Well done. 👏👍

Earlier on in voir dire, one of the potential jurors said that your job was to "poke holes" in the version of events and the story posed by the prosecution. It's absolutely ridiculous that the prosecution had so little evidence to provide that their entire closing argument consisted of trying to poke holes in the defense's story rather than talking about the evidence they presented.
The moment where your client mentioned dancing with his wife and getting alcohol on him was powerful. The way he said it with such confidence really answered the question of how he likely smelled of Alcohol. Also the consistency of the defense witnesses would've been extremely difficult to overcome. In the end, the evidence just was not there for the prosecution...honestly a weak case and should have been dismissed. The police officer should have asked more questions before jumping to arrest.

I believe I would have placed a not guilty vote. I saw a innocent man accused of driving drunk with no evidence against him. The prosecutor sure twisted and weaved his way throughout the trial. He made me sick with his restating the testimony to make it fit the outcome he wanted.
This prosecutor like most prosecutors cares nothing about justice only about a conviction no matter if defendant is not guilty they don't care. This prosecutor is just out and out blatant about it. He thinks its a game and has no concern what so ever about real true justice.
No pictures. No evidence. No accident scene drawings. No EMS witness called. No beer or liquor at the accident scene. No experience in the officer. No blood or breathalizer. Alternative explanations for “intoxication”. No truth from the prosecution.
SHOCKED? I’m not shocked at all. Watched every clip of this case, and the state had zero evidence, besides a very, inexperience deputy with 9 weeks on the road. Knew he was not guilty early on.
I can't tell you how many times I have been cut off by a motorist passing me on the interstate. I do my best to have my foot covering the brake while on cruise control. The DA was way too condescending, way too arrogant. Was he a police officer before he became a lawyer? I don't see how he would ever win a case. I'm not impressed with his courtroom skills. All defence witnesses don’t have to prove the defendant didn’t have any alcoholic drinks. The burden is on the prosecutor to enter actual evidence that the defendant did drink alcohol drinks and was drunk while driving.

It's indirect evidence. Testimony, though, it to be evaluated based on the credibility of the witness and is by no means conclusive.

No matter what the evidence says, I would have never sided with uncle fester. He doesn’t seem to know how to be a lawyer. It would be like having a plumber come to your office and has no clue how to be a plumber.. His tone throughout the whole trial is childish and disgusting.

Earlier on in voir dire, one of the potential jurors said that your job was to "poke holes" in the version of events and the story posed by the prosecution. It's absolutely ridiculous that the prosecution had so little evidence to provide that their entire closing argument consisted of trying to poke holes in the defense's story rather than talking about the evidence they presented.

The moment where your client mentioned dancing with his wife and getting alcohol on him was powerful. The way he said it with such confidence really answered the question of how he likely smelled of Alcohol. Also the consistency of the defense witnesses would've been extremely difficult to overcome. In the end, the evidence just was not there for the prosecution...honestly a weak case and should have been dismissed. The police officer should have asked more questions before jumping to arrest.
Larry painted the inexperienced officer in the best possible light. Excellent strategy to avoid appearing anti-law enforcement.

Well, I actually thought they were going to say guiltily..then i would of had remarks and questions...but i knew the state didn't bring the EMS workers there for a reason and that being they wouldn't have been good witnesses for them...😊

I believe I would have placed a not guilty vote. I saw a innocent man accused of driving drunk with no evidence against him. The prosecutor sure twisted and weaved his way throughout the trial. He made me sick with his restating the testimony to make it fit the outcome he wanted.

This prosecutor like most prosecutors cares nothing about justice only about a conviction no matter if defendant is not guilty they don't care. This prosecutor is just out and out blatant about it. He thinks its a game and has no concern what so ever about real true justice.
No pictures. No evidence. No accident scene drawings. No EMS witness called. No beer or liquor at the accident scene. No experience in the officer. No blood or breathalizer. Alternative explanations for “intoxication”. No truth from the prosecution.

SHOCKED? I’m not shocked at all. Watched every clip of this case, and the state had zero evidence, besides a very, inexperience deputy with 9 weeks on the road. Knew he was not guilty early on.

I can't tell you how many times I have been cut off by a motorist passing me on the interstate. I do my best to have my foot covering the brake while on cruise control. The DA was way too condescending, way too arrogant. Was he a police officer before he became a lawyer? I don't see how he would ever win a case. I'm not impressed with his courtroom skills. I have more to say, but I better play nice. JMO

Even IF he said he had a beer two hours before. The adrenaline alone would make a person who is perfectly sober and not concussed be unable to be clear and concise when worrying about the health of their loved one.
Prosecutor winged the whole thing just to make victim take the whole unjustified judicial ride. The Judge should have made the cop stay for the hole thing, but I guess he didn't want to embarrass him, thinking the Jury was going to slap him in the FACE with a Not Guilty verdict for his lying ways.

How can this Prosecutor sleep at night over his actions during this trial. His total lack of evidence for this case, is such an injustice for Mr. Faulkner. If he were to have been found guilty guilty, he would have been thrown in jail for 30 days. Most like if lost his job and his Insurance rates would have skyrocketed like heck. Also the Charges would be on his record for life. Great job Mr. Forman, another job well done.

All defence witnesses don’t have to prove the defendant didn’t have any alcoholic drinks. The burden is on the prosecutor to enter actual evidence that the defendant did drink alcohol drinks and was drunk while driving.
