It seems that the judges are not trained to comprehension exercises in legal issues or legal writings ! Had they been rigorously trained in legal comprehension exercises, then there would be clarity and lucidity in their judgements ! I have my own doubts if learned judges of the High Court and the Supreme Court can condense the arguments in Hart's Book "The Concept of Law" and compare those with Ronald Dworkin's "Law's Empire" and explain them lucidly to the judges of the lower courts or to the students studying in law Institutions ! If they could do it then they could not / would not have been able to write those judgements referred to by Arun Shourie!! Scholarship is missing in their fraternity . Isolated cases of individual judges as a matter of exception may / can exist, but by and large the situation is critical.
after listening to the various hilarious judgements pointed out here by him in his book , I lost my hitherto held respects for our judiciary... One of the reasons could be that nowadays bright students are not opting for law preferring engg., Medicine etc..
