The officer clearly said that the public is welcome back there in lot when they have recyclable collections days and being”escorted”by staff and guided by cones. WTF wrong with you people? No wonder why our country so f up. Just bc a gate left open doesn’t mean you can just walk past a open gate. In this case, gate was broken otherwise I believe gate would of been closed/lock. Btw, I saw a sign that prohibited people coming in to office by a certain entrance, did you maybe think for one second that maybe that sign got moved accidentally or put in wrong place? My point is, idiot auditor James with a laugh/giggle doesn’t seem to take direction or instructions lightly. Everything with James is an argument and disagreement. If you disagree, go to office and speak with a supervisor. Don’t sit there and argue why this what that bs. Period!

    The lady in the office was amazing and knew what to do. She was so friendly!! A plus! Great job. Provided cards and was patient. She did amazing!! Did not care about the camera. Changes are happening!

    The sign "no employees past this point" proves that other people than employees must be allowed back there for them to need the sign. If ur not allowed through the gate then they wouldn't need the sign inside there. Aren't the signs at the gate giving instructions to the public where to go INSIDE?

      Or there has to be a proper barrier. Which the gate would be if it remained closed except for intended traffic. But no sign and intentionally left open barrier? Free game. Places do that all the time in order to be lazy and not use keycards which leaves them liable for people wandering in.

      @@TimoBlacks The word “Posted“ specifically means a sign on a post or attached to a fixed object. Innuendo has nothing to do with it. Assumption has nothing to do with it. The reason a sign has to be POSTED removes all assumption and doubt about what is allowed. The reason we have so many stickers, warnings, signs is because someone did something stupid and produced a lawsuit. Do not enter. Do not swallow. Do not stick this in your ear………….. all because someone did something stupid. And now we require signs to be posted.

    No signs or any other publication prohibiting public access, but sarge DREAMS UP arbitrary rules on the spot for a facility he's not even employed by. What LAW is he enforcing? Ridiculous... At best there are some facility policies about public access, which even themselves are probably not documented anywhere, existing only as invented on the spot by employees.
    Sarge needs to stay in his lane and get back to doing what taxpayers are paying him to do.

      Stop it; the problem today was the incompetence of the public employees at the facility - not the cop who was quite professional. He didn't dream up anything; he was just quite informed about the access requirements at the facility. He dialoged with James and even negotiated a solution to the gate being open without proper signage by having the facility close the gate manually. And if you were observant, you would have noticed that the sign restricting access "only to employees" was a movable sign and only had to be moved out to the gate line to solve the problem with public access - gate open or closed. Word: try to be fair, please. James' audit was still masterful; did you notice that his 1st Amendment Right to Record was not challenged even once by anyone - outside or in. QED

    That gate was key pad activated. Leaving it open is less hassle for the lazy workers. No expense was spared for the gate opener, key pad controlled and they by pass it or it is broken and they have not fixed it. Sgt needs to be trained and needs to stop gaslighting. Get a sign. That director absolutely knew what was going on, the cop talked to him!

    The Superior Court ruled that police are not safety officers in the case of Mr. Hemingway, where the court determined that the initial interaction between the police and the defendant was not a mere encounter. A mere encounter is a request for information and does not require the police to stop or respond. The court ruled that the interaction began when the officer commanded the defendant to remove his hands from his pockets.
    The Supreme Court has also ruled in several cases that police are not obligated to protect people, including: DeShaney vs. Winnebago, Town of Castle Rock vs. Gonzales, and South v. Maryland.
    In these cases, the government chose not to take action despite clear and repeated threats to the safety of children. The Supreme Court has also ruled that the government only has a duty to protect people who are in custody, which is a narrow definition that limits custody to situations where a person is unable to move freely or seek help

      Yada, yada, yada, of course, you are right technically and judiciously, but you are also hella wrong when it comes to common sense and logic. In this instance, there was no public access beyond the gate, but the gate was nonetheless wide open because it was temporarily broken, and the public personnel had failed to move their no access sign to the gate line to restrict general public access. For whatever reason, the Sgt was well aware that there was no public access beyond the gate, which is likely why he had easy access to whomever he was talking to in the office. He also talked with James and then had them manually close the gate; otherwise, hypothetically, if James were hit by a bulldozer while back there, do you think he would not have sued for millions? I would! So, to prevent you and I from having to pay for any potential injuries, the cop went beyond his call of duty - and should have - the Supreme Court notwithstanding. QED

    Obviously it's because they normally don't care if non employees are past the gate for things like their pumpkin drop off with an arrow pointing non employees past that gate.

    James, it was quite obvious that no one at the facility was smart enough - today - to move their movable sign restricting access out to the gate line to make it clear that only authorized personnel are allowed beyond the gate - open or closed. Yes, no? That is point one.
    Two, yes, you can say it, but it is certainly unfair to call the Director unprofessional, as you did, just because he exercised his 1st Amendment Right to only speak to you in passing and not engage in a full-throated conversation about some stupid gate that is supposed to restrict access to the general public. From his point of view, that was likely way beneath his preview of concerns. Obviously, that sign was movable for a reason . . . I think.
    Anyway, another "unpaid" security audit and another 1st Amendment check on our right to record in public, something that was not mentioned, let alone even challenged, in the entire video. Great job. QED

    9:24 The law says you can either 1.) "put up a sign", OR 2.) "just have a nervous employee run around saying that everything is restricted". Everyone knows that's the letter of the law, when it comes to designating and maintaining restricted or employee-only areas.
    "have someone running around saying everything is restricted" = and they definitely have that method in place

    Notice the sign at the gate entrance, 12:20 mark, that says "Pumkin Collection" which is obviously for the residents, so it's all public access whether some forklift driver likes it or not.

    No no no. Once they let ANY member of the public in to a “restricted” area, that area, by law, becomes open to the public and if they only let “certain” members in to that area, then they are discriminating by definition.

    It's sad that cops feel the need to talk to adults like we're little kids. These cops didn't do horrible but the Sargent was obvious to the law and copsplained only his views. I think cops should be forced to use Q Tips every day

    17:00 What is the point of having a sign stating authorized personnel or employees only beyond this point when only employees are allowed outside of that demarcation line? The only reason a sign would be needed is if non-employees would have access to the area where the sign is placed. 🤨

    If the public is allowed entry at any point (drop off), then the press is allowed to be in that area. When you went back out, the pumpkin sign was gone.

    Looks to me like it would be easier to put a sign up than open and close it. Especially if they need to do it by hand. It has an electrical drive motor on it. It must be broken.😮
