      Goodonyer from Australia for even raising the subject. In my (long) experience, 90% of blokes doing time are there because they couldn't keep their mouths shut. Even doing a few weeks ~ or even months ~ on remand is better than doing a few YEARS because YOU provided the prosecution with a case. (Despite my past, I was granted $100k bail by a (notorious!) magistrate. Funny story ~ even the local police Senior Sergeant ~ a real hardcase with whom I'd had many serious run-ins ~ offered to put up the bail money... along with four others... and I hadn't even been asking for bail. (Over here bail has to be put up by a 'reputable' individual with certified Bank-Chequel; I believe in the US bail can be acquired more easily from some sort of 'Bail-Bondsman' business??

      @@johnzillner1596 I would say "no" but a judge would probably say "yes." Generally to conduct a search there needs to be probable cause to believe there is [more open containers in the car]. Here the officer would likely testify that they suspected additional open containers were in the car.
      Another scenario would be: they arrest you for the open container, then conduct a "search incident to arrest" and an "inventory search" of the car. Obviously, this is just manipulating the rules (because officers have 100% discretion whether to arrest you or issue a citation) to put them into a "legally justified" (blank check) position to search your car.

      Could you do a video speaking to why so many defendants take plea deals, and why some choose to be tried by a judge instead of a jury? I am surprised at how the statistics have changed over time, and I would like to better understand it.

      @@vincentrivera1370 The question would remain:- How would they KNOW you had an open container in the car without thereby 'invading' your vehicle without cause? But here in Oz the APPLICATION of the law leaves LOTS lots of wriggle-room. eg. How do you fight (successfully) a main charge of: (Victoria 'CRIMES ACT 1958 - SECT 17'
      'Causing serious injury recklessly" (for which you can get 15 years) , after you've massaged a wanna-be with a jemmy-bar, in front of witnesses?

    There is a super simple low cost and uber easy way to defeat the police.. don't talk to them. That is all. You can never be a good enough actor ..they will see or hear a confession even if innocent.

      Must be polite and declare you are exercising the right to remain silent. So don't go mute and don't show any annoyance or anger when you declare you are exercising your right to remain silent. Question...can you remain silent if the police have not read you you're rights?

      @@gabesalem8132 you can remain silent if they had not read you your rights. Miranda rights are simply a reminder to the person under arrest of what their rights are, not a "permission" to remain silent.
      However, due to the stress involved, it was decided in courts in "Miranda" that the officers should alert the arrested person of their rights, and not doing so might be a violation of, IIRC. their 4th or 5th Ammendment rights.
      You can ask for a lawyer immediately if you wish. They can't force you to talk without one.

      @@gabesalem8132 before they arrest you ...to be and remain silent by choice...they say here that the says you need to tell the authorities that "I am now invoking my 5th ammendment constitutional rights" and then do no speak to them but if you do after then you have to repeat the phrase to make safely legal to stop speaking to them again...(you can add this part too) "...and will not answer qustions without legal counsel present thank you."

      Tell them NOTHING! Make yourself comfortable and go to sleep! Your 'rights' will surface if and when necessary. (and saying you'll rely on them makes you SOUND like you've something to hide!) Whether you're 'read your rights' is irrelevant. Remain silent~ you CAN'T get into trouble, ever, for just keeping your mouth shut.

      @@dabbbles this is not technically correct. There was a court case where someone was being questioned by the police, did not invoke his right to remain silent (or for an attorney), but an "extended pause" when asked a particular questions was deemed admissible in court. Do not just go mute, but clearly and unequivocally express that you are invoking your right to remain silent. As others noted, the Miranda warning is just an advisory about rights you already have, whether or not you are under arrest.

    Nice statement I saw an experienced detective make to an 18-yr old suspect in an interrogation room. "I have been questioning homicide suspects longer than you've been alive." That's your first time in that room, he's been doing this for 18 YEARS. You aren't going to win. Ask to leave, ask for a lawyer, remain silent.

    Assume the interrogators are nothing more than unethical criminal minded liars, because they are. They are wearing badges and uniforms and are encouraged and allowed to be every bit as dishonest as those they purport to protect us from.
    Never trust their word and always assume the worst behavior from them. People are people, no matter their role or status, especially when they have a nefarious agenda.

      @@alienlife7754 The point is that people in official positions of authority are supposed to be honest and ethical. Ordinary citizens who don't know any better, expect cops to be honest. So it's important to remind them that cops are *_not_* honest and ethical.

    Great advice! I'm sure Mr. Rivera implies this when he says, "Ask for an attorney and shut up": Be polite and don't act aggressive in any way. With the proliferation of cameras today, your behavior is going to be recorded. If you are cool, calm and collected (and shut up) you will appear to be a reasonable person. Don't give the police any ammunition they can use against you.

      ​@@seanwatts8342 PS... ooops! got off the track a bit. My only knowledge about bond-hearings come from American tv shows. We have a different approach here. Minor offences are heard by Magistrates' Courts (Think Judge Judy with formalities. If not heard there ~ and bail set ~ the matter can go to a higher Court (County or Supreme, and possibly the High Court = US Supreme Court) depending on the issues/severity of the charges. My experience is to ALWAYS push it to the highest level possible for lotsa reasons. Happy to discuss; a process dear to my heart.

    100% spot on. Add to not submit to a polygraph. They are only to nail you to a statement and confirm to the officers that you are guilty. Tell the officers you are not answering or submitting to anything without a lawyer. They might say it makes you look guilty, but it is your right.

    Time after time I see people who are arrested sit and be interrogated for hours and hours with these Detectives, instead of saying, "I choose my right to be silent"! If they have no reason to arrest you, they have to let you go home or maybe delay you based on another charge!

    As a person with Aspergers, this is very helpful! I’ve had communication difficulties in the past, and so far something like a police interrogation/interview as never happened to me, but I want to be prepared.

      Glad to hear. Hope you never need the advice. Just remember: once you ask for an attorney, you must stop engaging with them. If you ask for an attorney, then keep talking, it's the same as never asking for an attorney in the first place.

      You may want to search the case of MELISSA CALUSINSKI. She didn't have Asperger's but had a "low verbal IQ". Police pressured her until she gave a false confession. I believe she is still in jail even today.

      The problem is tv shows such as Law & Order and true crime shows make connections that invoking a lawyer and not “cooperating” with police is a sign of guilt. You are NOT obligated to speak to police. What the police view as signs of guilt can be arbitrary: if you are “overly upset”, for example, you are guilty, but if you are “not upset enough”, you are guilty. The cops show up at your door and tell you a neighbor got murdered-are you a suspect? Get a lawyer.

    Well sometimes they do it behind a fence. First they harass the shit out of you. Then they tell you what you allegedly did. It doesn’t have to be an intrrrogation room

    This presentation is absolutely correct. Never talk to the police or anyone else for that matter who is attempting to question you about something strange or that could get you into trouble. Employers also do this to attempt to create files on employees. The correct response in all cases is I know nothing and I have nothing further to say, until speaking to an attorney first
    All of these generalized psychological techniques used by the police only work in theory or across large numbers of experimental subjects. In reality, when it comes to individuals, there is no sure way to know if someone is guilty or innocent, lying or telling the truth. Lie detectors are only a bit more accurate than flipping a coin. There are many innocent people rotting in prison, or who have been executed, on false confessions and lying or mistaken witnesses.

    As a reserve officer I sat in on several interrogations of suspects for various crimes. If I was on a jury and one of those questioning a suspect testified that when asked a certain question the suspect's reply meant a certain thing----not guilty on the spot. Most of the officer's testimony was based on their personal beliefs---not real life. As usual the officers did not have the right life experience to be questioning people about anything.

    Invoke, invoke, invoke..........reserve your right to be silent. Don’t even say yes to a bottle of water, soda or mint. EVERY and ANY uttered word can and will construed by the court as a willingness to TALK. Do as the man says and ask for a lawyer. Once you do, all communication has to stop.

    I'm Autistic and live in mortal fear of being interrogated because 1) repeated questioning or 2) threats cause me to have a meltdown. A meltdown consists of me yelling, hitting myself and trying to hit my head on the nearest object hard enough to get black eyes and contusions. Threats of physical violence have caused me to faint in the past. I cannot guarantee that I would be able to say coherent words enough to ask for a lawyer to be present. There is a good chance the stress would just cause me to faint. Pictures of blood or gore or even descriptions have caused me to faint while taking 1st aid classes. I'm not sure how the police would handle it and what charges they would add on. As a general rule I'm a recluse and try to avoid any suspicious activity of any kind. I have faced false accusations in the past. What are the odds on them beating me into a coma if I'm interrogated?

      Yep. If they arrest you you'll be no worse off, but will get some useful information, because if they DO arrest you they need to justify the arrest.

    The detectives are very slick . They only care to get a confection . They don’t care if the person is guilty or not , as long as they can get an indictment and later a conviction. There are and have been people in Jail that are total innocent , but they have been trick by detectives

    That’s true. When I was interrogated by the FBI, they would use different words in sentences of the same questions. I noticed it because I would come out with the responses. That happens when you are truthful and not guilty.

    I saw a LAPD lady cop who was arrested for murder.
    She was saying as they were handcuffing her
    “I can’t believe this, this is crazy.”
    She wasn’t saying
    “I didn’t do it, u have the wrong person.”

    When they ask you to come to the police station tell them to come to you. You never want to be hemmed up by anyone especially police. I have heard of an investiagation going on for hours. It will wear you out and then you start making mistakes. You can't get away until they say so.

    The huge numbers of innocent people sent behind bars proves that the police aren't interested in truth or lies, but the close cases fast and easy.
    It doesn't matter for them you are innocent, so best way is to STFU and let them know you are taking your constitutional rights to not say anything and talk to legal council.

      The cops were assholes to him instead of public servants.

    When the say "Anything you say, can and will, be used against you, BELIEVE THEM! Say nothing! Additionally, if you have a court appointed lawyer, say NOTHING to him either. A court appointed attorney is NOT on your side and CANNOT be trusted with ANY information. If you cannot hire a real attorney. Just keep quite. A court appointed attorney will NOT help you or keep anything you say to them confidential. Remember who they get their paycheck from.

      As long as YOU STOP TALKING after asking for an attorney, they must stop questioning you. They will have to arrest you or let you go fairly quick. Many jurisdictions can still hold you for 48 hours.

      The SC has determined that cops may lie to a suspect in the course of an investigation. For example, suspect #2 Joe Blow rolled over on you and said you were the actual shooter. In reality Joe Blow lawyered up immediately... this is a legal interrogation tactic after you have been read Miranda.

      Whatever they can do to dig out a confession beforehand is good to go as evidence apparently.
      If a person confesses and makes a statement, they are not having a gun held to their head, they've just been conditioned to do it on their own accord.

    When they ask for a voluntary statement start off by telling them how much you love the United States. Make it so long and drawn out that they'll eventually ask you to shut up. At trial have your lawyer ask if there was a voluntary statement that you made and that it be read into the record. That really pisses the DA off. The judge gets pissed if the prosecution refuses to let any voluntary statement you made be released into the trial. Then your lawyer can use that refusal in his closing statement to the jury.

    Wish I had a good lawyer when I was just in court. I was walking in the road one day and cops stopped me. They pulled me to the side walk and said they wanted to make sure I was okay. I said I'm fine and was about to walk away. They said they wanted to talk, I told them I didn't want to talk and proceeded to walk away. They yelled stop and grabbed me and slapped a cuff on my wrist. I went to put my other arm behind my back, that's when the other cop grabbed me and they both drugged me 20 ft into the middle of the road. One jumped on my with their knees and before they ever said they were going to tase me they deployed their taser. Yelling at me to stop resisting, mind you I never resisted arrest. I was given 4 charges. Attempt to elude, resisting arrest, obstruction of government operations and disorderly conduct. They were all misdemeanors that could hold up to 6 months in jail each. Fast forward to court a month later I was only there to plead guilty or not guilty. I plead not guilty on all of them and got a lawyer. Two months later (just a few days ago) I was in court again with my lawyer. Previously she filed a motion of discovery to get the dash cams and body cam footage. While in court I asked her if she had the footage and she went back into the prosecutors room with all the other lawyers and cops were mind you. When she came back she said one of the body cans malfunctioned and the other one wasn't turned on. She wouldn't even mention the dash cam footage at all. She even read a statement by the cop that was back up, not the arresting cop who was let go and was facing jail time for something he did while on the force. The statement was all a lie and didn't even make sense. Staying I yelled, I'm not going back to jail. In which I've never been to jail ever prior to this interaction with the police. The lawyer had a plea deal for me which is two years I don't get in trouble, but if I do I face 30 days in jail and then proceeded from there. I begged her and told her I'm innocent and how could I be charged if they clearly got rid of all the evidence. She told me with no cameras that it would be my word against hers and the judge will side with her cops and I would then face 1 year for each charge I had and I would surely lose if I continued to fight for my innocence. Which scared me. So I took the plea deal. I later found that was a lie and misdemeanors would only hold up to 6 months for each charge. I was wronged and lied to, abducted by police and it has FUCKED me up for a half a year now dealing with it from the start. Starting December I have to pay 100$ and so on until I pay my fines. I feel like all the lawyers in the same room with the cops and the prosecutor is bullshit and honestly I'll never trust the police in my hometown and much less any other officer anywhere.

    Recite your Full name, social security number, driver license number and then ask for a lawyer. Do not believe anything they say, do not believe them if they say you can't get a lawyer. The longer they deny you the more money you'll get when you sue them. Repeat your identification like you are a POW and say absolutely nothing else

    Thanks for the advise. I hope I never need it. It seems if you answer one question, it would only lead to another and then another. It would probably be best to not answer any question. If you answer one they will see that as progress and continue to hammer on you. Small talk is dangerous. If they have enough to arrest you, their going to anyway. There is no benefit to talking.

    So, what if you're in a situation where the police have a pool of candidates (suspects or "persons of interest"), and they are trying to rule out candidates so they can get closer to the criminal. And suppose you're one of these candidates, but you're not guilty. Part of you would like to help them, especially if the victim is a close family member. But part of you is also worried you're going to get falsely accused since you're one of the candidates. What should you do? Should you talk to the police or insist on getting a lawyer? If you refuse to talk to them, won't this just make you look more guilty?

    I liked your video, and the presentation and quality are top notch. With regard to feedback, and with only the best intentions, I’d tell you not to hide behind the music as much. This information is new to a lot of people, and your words are enough to engage us.
    Secondly, I listened to this using headphones, and your voice only came through on the left one. It was a bit weird, but I thought you might be planning to use it for an effect once the audience got used to it. I ended up taking the right one out, though, and still felt distracted by the music after.
    Lastly, I’d say not to have such a rigid script! Not everyone (myself included) has the gift of the gab, but if you go a bit more vague in your video outline, you can try out a number of ways to explain the information as you would naturally with a conversation partner and thresh out the good stuff in a video editor. There’s a psychological effect called a parasocial interaction, in which an audience gets to feeling like they have an almost personal friendship with someone, although that person has specifically curated and limited these interactions to the point where we don’t really know much about the celebrity at all... lots of that on RUclips, and I’d suggest looking at a channel called Lindybeige. He goes on for an hour sometimes, no cut, no script. Just him talking about a World War II battle or something interesting that he knows a lot about... and the effect is remarkable. I feel like I’m visiting with him at his house and he’s telling me a story... and I’m rambling.
    As a postscript (since I already said lastly), I could always stand the videos being longer! Keep it up.

      @@madmax8620 liars tend to avoid the use of contractions (i.e. saying did not instead of didn’t) and tend be vague about what they’re accused of (“sexual relations with that woman” is vague and general but “an affair with Ms. Lewinsky is more specific and straightforward).

    Great video, but I think one thing should be clearer. Any request for an attorney must be clear and unequivocal. Hedging statements such as "maybe I should get a lawyer" or "do I need a lawyer now?" are insufficient. It's a natural reaction to show some deference in the face of police authority, but that can cost you. It must be a clear, direct request. Four words to remember: "I want a lawyer." Then shut up. (Lawyer up, shut up.)

      A subpoena cannot pierce your 5th amended right against self incrimination. You always have the right to consult an attorney. Even if you're subpoenaed, you should consult an attorney first.

      @@madmax8620 In Short no. A subpoena is a court ORDER to appear at a hearing or produce documents.
      When cops ask you to come in "voluntarily" for questioning, they're playing games. If you come in "voluntarily," then they don't have to Mirandize you, and it being a "voluntary" encounter/statement almost always makes the statement admissible against you / extremely difficult to suppress.
      Very often, they will tell you "come in for a 'voluntary' statement. Don't worry, we're not going to arrest you today." ... Again, this is a game, they wont arrest you today ... but they will tomorrow. By telling you they're not going to arrest you today, they're creating a foundation that this was "voluntary" statement, with no threats or coercion.

    I would like to see a video that guides about those who are ABSOLUTELY innocent. How should one respond to an interrogator lie and insinuation? Can we tell police straight up that they're lying and this interrogation is over?
    Being innocent, can we establish a ground rule with the Police not to fabricate lie before the meeting starts?

      Don't try and argue with them or call them out. 1) anything you say WILL be interpreted against you, and 2) you don't know what they're really trying to get you to say. For example: Imagine they're investigating you for illegally using someones credit card. They may ask you "did you have permission?" (they don't believe you had permission otherwise you wouldn't be there) ... and you say "Yes, I had permission to use the card.", in reality, they just got you to CONFESS to USING the credit card. Whereas before you said that, they couldn't even prove it was YOU who used the card.
      As always: ask for an attorney then shut up.

      The police are there to gather evidence that will build a case. They are not there to help defend you. Therefore, you don't have to help them at all. They don't know you're innocent and it's not their job to determine that. Also, making false claims is one of their tactics to get you to talk. Don't take the bait. They can say anything, false or true. More power to them to get the guilty to talk.

      Never talk to them freely without having a lawyer present even if you are not a prime person of interest in that case they call you in on. They might want to nab you for something indirectly.
      Basically keep your mouth shut, speak to a lawyer, don't no interfere or destroy evidence.
      Basically watch "48hours" and that should be a training lesson on who and why people are arrested and convicted. Their statement, alibi, actions, and "speaking to the detectives" , is what help to nail their confirm shut ;)
      This is why Jon Benet Ramsey family also didn't have a trial or even much less get arrested.
      They lawyered up ;) The police will also try to convince you that lawyering up is what a guilty person would do, but in fact it's what a "smart" person would do.
