Since the modern day standard for 2nd Amendment cases is the "Bruin Decision", the machine gun ban WOULD be unconstitutional. The 2nd Amendment applies to EVERY local, state, and circuit court throughout the country. All the ATF RULES are NOT laws, and should have no bearing on ANY Constitutional amendment activities.

The re naming of arms to firearms is the BAR Attorney trick. They create a new term to control it and bob’s your uncle, they control it with new regulations. Americans already gave up their liberties and freedoms when it was convenient to accept the benefits offered in exchange for privileges of the US Citizenship offered through the fourteenth amendment and Social Security along with all the licensing they get for what was once a right to do.

All gun laws are unconstitutional, ALL gun laws. The founding fathers reasons for the 2nd amendment was so the general public could protect itself from each other, foreign invaders and its own government! By that reasoning it would make all weapons fair game for public ownership. The same applies to permitting for purchase and carry permits, concealed or otherwise! Constitutional carry is the only legal option, all others are infringements!

Good video, but you omitted one key way machine guns can be legalized in the US. If the Legislature were to codify machine guns as unrestricted and uninfringed and the president were to sign that bill, effectively overturning the NFA of '34 and the GCA of '68. That is one other way the current restrictions on many 2A related devices and specifications could be overturned.

Ok, so, the judge overturned the conviction because the law is unconstitutional; the state appeals it; if the appeals court reinstates it, the defendant is still free, right? Is it unconstitutional to hold the defendant while the specific law he is supposed to have broken is batted back and forth in the courts?
