I have watched several of these type of presentations: "Don't talk to the police. Don't open the door. Don't say anything to the police because it can be distorted, twisted, taken out of context, etc." By the behavior and actions described, the police have themselves created an atmosphere of distrust against law enforcement, even among honest, law-abiding people, and this has now created an escalating cycle of cynicism. Many people assume law enforcement always has ulterior motives and can not be trusted in any way. All I can say is I will never talk to a cop again without representation. I am sure many others feel the same way. Sad that it has come to the point where the cops can't be trusted.

I understand the thinking behind that strategy. And if I could see (without answering the door) that it's the police, I would be inclined to agree. HOWEVER, if you believe it's NOT the police, then here's some unsolicited advice that I urge you/everyone to consider: The first thing a burglar or home intruder does before forcefully breaking into your home is knock on your front door-usually more than once. If there's no answer, they will look around, maybe even try to casually take a peek inside, etc.; they may even go around back to scope things out before their next move. And failing to get an answer, that next move will be to kick in the back door, the front door, or possibly break a window to gain entrance. This is the moment that you dreaded-especially if it's your child who is home all alone. Answering a "knock at the door" doesn't necessarily mean *opening* the door; it simply means *answering* the knock with something like, "Who is it? What do you want? Sorry, I can't help you." If they persist, that's the time to start dialing 9-1-1 as you, or your loved one, prepare to defend yourself/themselves. Think this through *before* the time comes. _Discuss possible scenarios with your family._ Yes, maybe even go outside and 'play the bad guy' as you role play with your children. _It could mean the difference between life and death._

Then they do the "wellness check". Fortunately the Supreme Court has limited that to some degree. Also you have to verbally assert your 5th amendment rights - silence is not sufficient and can be used to infer guilt. Also don't answer any questions because once you start, your later silence can be used to infer guilt.

@@jackburton37211 I get plenty of unexpected knocks on the door that are either benign or beneficial. One neighbor knocked to tell me that my daughter's chicken had escaped the yard so that I could capture the offending fowl and return her to the coop. Another knock was to warn me that the neighbor's house was on fire -- for some reason the FD had come without sirens and thus hadn't woken me up. A knock to let me know that the insurance inspectors had finished with the property next door and I was free to go take the fence panels I'd wanted. My neighbor telling me that my mail had been mis-delivered to his house. Another neighbor asking if his mail had been delivered by accident to my house. (Yes, it had.) A neighbor asking if I could move my car so a delivery truck would have room to back in. Twice the knock was the cops: once to ask about a murder in the neighborhood and if I had seen anything at the time the gunshots had rung out, and once to tell me that somebody was about to have my car towed if I didn't move it from in front of her vacant lot. (This actually led to me negotiating renting a parking spot on the vacant lot, six feet in front of my door. VERY convenient and if I hadn't gone to the door I'd have had to deal find out that my car had been towed off when I went to leave for work the next morning.) And that's not counting all the times that it's my daughter, son-in-law, or one of my grandchildren.

Do not joke around with law-enforcement. A friend of mine is a defense lawyer, and he says that is the one message he would like to send to everyone. His example is: a highway or traffic cop pulls Mr. Future-Client over, and tests him for DWI. The cop administers "test-A". Mr. Future-Client passes, but, he's been cracking jokes, in an effort to make the cop feel comfortable and friendly. After he passes, he says, without thinking: "Well, I'm glad you didn't make me go through [test-B]; I can't do that one even when I'm sober!" DING DING DING DING DING!!! Mr. Future-Client has just ADMITTED that he is NOT sober NOW. He's arrested and doesn't have a prayer of beating the rap. The prosecutor doesn't have to do a damm thing in order to convict, so, the defense lawyer's only bargaining chip for getting an easier plea-deal (give my client probation with no prison time and I'll have him plead guilty and save you the trouble of having to build a case for trail) is GONE.

      @Unborn-Lives-Matter 3 года назад +6

@Boz Scaggs I am a retired Engineer / Scientist. I have been in this field over 32 years. I follow scientific evidence and discovery. So here is what we know:
Scientists say that any probability less than 1 in 10^150th is an impossibility. That is one chance in 10 with 150 zeros after it. That is a HUGE number. We don't even have a name for it. We call that a googleplex. Thus Google.
After taking into account the intricate balance of all the constants and variables, all the things that must have been and are required for us to exist in this VAST universe, we (scientists) find that for all of this to just happen randomly is 1 chance in 10^450th. That is 10^300th smaller likelihood then the limit of possibility. It is so vanishing small a probability that it is impossible. A higher being, vastly more intelligent than us, outside of the universe, created ALL of this "stuff".
I can get into more detail if you want. Most people don’t understand probability that well. Most people don’t grasp how large these numbers are (10^150th is a number larger than the number of atoms in the universe). But I thought I would keep it simple for now.
Do you understand now why there MUST be God? A creator who exists outside of this universe? And why it’s impossible that we should be here let alone space aliens?

You just glossed over a very important aspect of this by just throwing it in at the last second when you said "and go about your business". A major mistake most people attempting to assert their rights in these situations make is that they don't just walk away and go about their business after they do it. They stay at the door and continue to engage with the police, screaming and arguing with them, and quite often answering all sorts of questions after getting frustrated. Part of the fishing expedition of a knock and talk is to do precisely that. Get the person frustrated and agitated so that they'll either eventually concede and allow questioning/entry, or they'll do or say something the police think they can plausibly claim established probable cause negating the need for a warrant.

One of the most frightening things I’ve ever seen was during the search for the Boston Marathon Bombers. Police officers from all over the Commonwealth and surrounding states were bussed in, and went door to door through neighborhoods in Cambridge, Somerville and Belmont knocking on doors and searching houses. There was no warrant. Just a lot of frightened residents who were told by the Governor to shelter in place. This was something reminiscent of Nazi Germany. I never thought something like this could have ever happened in the United states. Literally thousands of armed police rifling through peoples homes with no authorization whatsoever. And to this day, it hasn’t been challenged in court. Unbelievable! The irony was with all of that, they failed to catch the person they were looking for.
It was only after the search had been called off that a local resident went in his back yard and noticed the cover on his boat had been disturbed. He notified police. They came en mass and instead of searching the boat, opened fire and shot hundreds of rounds into the boat, not knowing who or what might be in it.
After the fact the man whose boat was destroyed by gunfire got a new boat. Not from the government. From the a boat manufacturer!

This attorney is giving great advice here, but as a former security specialist, I recommend adding a home security system that includes overt cameras. Overt cameras will help ease police officers in the right direction when they can see that they are being monitored. Video surveillance is super affordable these days and based on many police home invasion incidents that have occurred over the last couple of years, it's a smart choice. Many police officers have lied about incidents only to find out that video surveillance contradicts their version. These particular police officers only lied because they didn't know they were being monitored. However, if a cop knows that they're being watched right from the start, believe me, they're on their best behavior. It is better that police walk away in fear of surveillance than have them get caught in a lie after they already have done something to you or your family!

Lying police seems to be the problem then. If law enforcement actually enforced laws and were honest people then we wouldn't be having this problem. If an officer is caught lying they should lose their job. The kind of person who is to enforce laws or preside as over other passing judgement needs be practically superhuman when it comes to character and integrity or they are unfit for the job.

@@lexpox329 No, lying police is not the problem, sir. The problem is that people don't exercise their rights, and cops use everything they get, LEGALLY, against them. Case in point, several weeks ago when Alec Baldwin shot that woman on the Rust film set, he should have shut up immediately! He had zero obligation to speak with police, so he shouldn't have. The police got on the news and said everyone is cooperating, which seemed nice, and like the right thing to do, but look at where we are today. Those same people, all who thought they were doing the right thing by talking, are under the guise of a criminal investigation; and might go to jail. I'm sure the cops in that case are not lying or doing anything unscrupulous, they're just using the law to their advantage, which is what people must also do. Alec Baldwin's words in all likelihood, are going to come back to haunt him and place him in a precarious position. And for what, to save face? To appear as if he was doing the right thing? Let me tell you something, friend... Alec Baldwin was going to get sued anyway, he was going to fall under a criminal investigation anyway, so why speak and arm the police with the ammunition they're going to use against you? It's funny, the ones who knew not to speak in taht case were the heads of the film studio! They gave condolences, but beyond that, said nothing! Shut up and lawyer up! It's why lawyers exist! This is what I have always told my children....Shut up and lawyer up!

We once had a pesky neighbor who would call the cops, the city, etc., just to harass people. My turn was when "someone" called the city to report faeces in my alleyway between houses. True, I would let my dog out there to do his thing and come back, but it was always cleaned up the same day, usually within the hour.
Two inspectors rang the bell and I answered from behind a locked screen-door. "Can we come in to talk?" "Ummmm, no." The look of surprise on their faces was priceless. They did ultimately ask me to pull in the catfood I left out front for the strays, but that was the extent of it.
I was polite about it, said that as if asked if I wanted gravy on my mashies or something, but the answer was a clear no.

I never talk to police at my door. Example. 5 years ago, I was sitting on my front porch, which is enclosed. There is a custom built, reinforced steel frame with steel mesh screen door, it deadbolts automatically when it closes and needs a key to open from the outside. There are 3, 6 inch steel slide bolts, top, middle and bottom of door, so in the event the lock is picked, and these are engaged it cannot be forced open. The neighborhood I was in was not the best, lot of break ins, and lot of rapes. As I sat there, three detectives rolled up, and walked right up to the screen door and attempted to open it. I walked over, engaged the 3 slide bolts and sat back down, when they started their little spiel of lies, I just put my headphones back on and went back to my book and ignored them. They stood there banging on the screen door, until I put the book down, took off my headphones and grabbed my beer and walked inside. The second screen door is built the same, The only thing I said to them before I closed the front door was when he said "They were just looking to talk." I told him since there are three of you, talk to each other. Shut the door, and secured it, went downstairs to rumpus room and started playing Warcraft. On the CCTV, they stood outside another 5 minutes, tried walking into the backyard, couldn't get in there, and finally left. What it was about was the neighbors dog, a Husky, had been getting out and terrorizing another persons cats, winding up killing one of them. The neighbor filed a police report, and these "intelligent detectives" came to the wrong address. The second time was easier, I just told them I do not allow solicitors on my property, and shut the door in their faces.

And technically the current caselaw allows for them to lie only when they have an actual legitimate line of investigation they are following. I still think it massively empowers officers and that power can be abused by bad cops to the detriment of the public. I can't really think of a better way however given that criminals aren't going to cooperate with getting caught. If you are truly innocent of any crimes it seems like the best course of action is just to be silent and get a lawyer, so you can't misspeak and end up regretting it. Also if you are wrongfully arrested you really should just accept your going to jail for the night or whatever and fight the wrongful arrest in court. Resisting the police in the moment only gives them the right to use force.

When the student relayed this to the cops, they never spoke to that student again.
Hmmm... so much for cops' 'innocent witness statements'.

If you are going to talk to them, even through a closed door and to say you don’t talk to police without your lawyer, make sure the TV or radio is off. If they hear something, anything other than your voice, they can claim they believed there were exigent circumstances and break down your door.

Math: in any large group of people, the people range from heroes to villians. Police is a large group of people. Ergo, some police are going to be villians. Sometimes protecting yourself is going to include protecting yourself from the police.
Just ask my dad who was hospitalized by police because a) he answered his door and let them in, b) he refused to go with them for the simple reason that the name they gave for who they were looking for was not my dad, it was my neighbor. They didn't care, assumed he was lying, argument ensued, they took my elderly dad down to the floor, injuring him. Meanwhile their target was a guy nextdoor. Qualified immunity resulted in my dad paying his medical bills, fun fun.
*Note: yes, my dad probably could have solved it by showing his ID, but he was pissed off at how rude they were when they pushed inside his home, and refused to cooperate with them other than to say "I'm not that person" to them over and over.

Look up Mitchell v. City of Henderson. Henderson, Nevada police on 2011, forced their way into the home of Micheal and Linda Mitchell, to use the home as an "observation post" to watch a neighbor during an investigation of domestic violence. The police and city of Henderson are seeking for dismissal of the lawsuit.

Two ATF guys showed up at my door as I gun I sold was found at a crime scene. This being IL I had proof of a legitimate sale and I scrambled to find the receipt so I could give them what they wanted. I had zero problem doing this (even though if the ATF wanted to screw you over, they could). But, these guys were grateful for my cooperation and help. This tutorial works only in the land of leave it to beaver and you know it !! . The whole reason you tell people to grab their phone is to record what happens because you know cops lie and hurt people with impunity . I really hate this game lawyers , judges , cops and any member of the legal system plays where they pretend that they all follow the law at all times leading to this false air of non existent impropriety. You know very well the cops will pretend they can't hear you , pretend they hear something going on in the house , or my favorite claim they smell weed to make entry into your house . The best you can do is totally ignore the cock smugglers and wait for them to leave .

The ones that say they have arrest warrant for someone who doesn't live there and assert that they have a right to search the property for the person on the warrant. This sounds like great advice for departments that follow the rules, what are we supposed to do ( in the momment) when we know they are crooked and corrupt?

      - D) If they have a warrant, verify the address. If it's your address, let them in. Keep recording. (If they have a warrant for your arrest, you can't really keep recording because you'll be handcuffed. Fight it in court if you're innocent.)

Here's a good example. My ex and I were having a fight. She swatted me, I swatted her back. It was an ugly emotional fight, barely a spitwad fight physically, but I knew that's enough for a domestic violence charge. She had no idea of the seriousness of the situation, but I did. She called the cops, being the complete idiot that she is.
Cops show up, and my ex greets them in the driveway getting the first shot at telling her shitty story. Notably, she admits to hitting me first, confessing to her own crime. They didn't arrest her, handcuff her, and drag her off to jail.
Then they come to the door. Knock, Knock, Knock, and that's all they got. They knocked over and over, beating and damaging my expensive mahogany door. I never answered. Later my ex admitted to me that the cops told her that had I answered the door, they would have likely arrested me, handcuffed me, and dragged me off to jail. Not her. Just me.
I didn't have to lie to the cops about hitting her. I didn't have to admit we had had a fight. I didn't have to admit I'd hit her. They got nothing, zippo. That wasn't the end, of course. They mailed both of us a domestic violence complaint. My ex and I reconciled, and I had to hire a lawyer to represent both of us, and ultimately the case was dismissed against both of us. Who knows if that would have happened depending on what I said to them if I answered the door. Even if I'd answered the door, handled myself in an ideal way, I would have been arrested no matter what. Likely I'd spent the night in jail. So not answering the door, not answering a single question, that for sure saved me that. My lawyer validated I would have likely been arrested and also validated that his job would have been much worse if I had answered any questions. So, don't answer the door. Don't answer any questions.

The cops should be our friends and protectors, some of them are. The problem is that some of them are actively trying to get dirt on you, others try to push you into making a mistake. An interesting twist in Massachusetts. The state appellate court (Godfrey v. Wellesley) has held that exercising your 5th amendment right is just cause for revoking your right to own or possess any form of firearm or ammunition. Yes, really - the MA courts allow them to punish you if you choose to exercise your right remain silent.
Until a very recent federal court order, the police were getting felony convictions against persons who surreptitiously made audio recordings of encounters with policy. Add this to the "yes, really" file. See Commonwealth v. Hyde

Always remember: Cops are *legally allowed to lie* to ANY member of the public. I would be willing to bet money that *most or all* of the officers who said they wouldn't allow another officer to violate someone's rights either have done so themselves or *witnessed* another officer do so AND DID NOTHING.
The police use a "one bad apple" defense to say that the bad cops are few and far between... and yet *every* medium-sized or large department has them and *every* officer in those departments (or most of them) know about those officers' activities. Because the actual aphorism is "one bad apple *spoils the barrel*". As soon as you know there is ONE bad apple (a bad cop) in the barrel, ALL of the apples with it (the entire department) are suspect. Rot spreads.

Not to mention the fact that if at least a third or half of people plead not guilty everyday to every single ticket that was written out and wanted their day in court the system would be backed up so far that they would have to let all misdemeanors go
