@@kathiewool4292 no he did not lose any rights when he became a suspect. Just because law enforcement believes he did it, doesn't mean that they did not ignore or not explore all possible avenues or suspects. Just because the victims families believe he did it also doesn't make him guilty. His rights far exceed any victims rights until he is actually convicted in court, not in the press or on RUclips. So regardless of how you have formed your opinion of his guilt, he in fact has not been proven guilty. On top of that, we don't really even know what is true and what is not. The information that has been leaked or shown only show one sides point of view and is usually leaked for the purpose of ensuring a certain point of view is believed over another. People forget INNOCENT until PROVEN guilty in a court of law until something happens to them or someone they know by being accused and harassed for something that they did not do.

Being the sister of a murder victim who was 18 & had just graduated from high school, I'm glad to see the Goncalves has reached the next level in the path of grief. The anger level is tough & can break apart families. Happy to see they made it through. They have now reached acceptance & are on their journey to justice. They now think more about their daughter's life, & less about the way that life ended. I'm sure they are sleeping better now, & the nightmares come less often. The overwhelming sadness visits from time to time, but doesn't live there anymore! Seeing them in this interview makes me very happy tp see they didn't get "stuck" along the way! Still praying for all of those families, because that trial is going to be hard & trigger them in a real hard way! I hope they have a therapist to get them through. Im having nightmares alright!! They are about 4 students being unalived in a sick, horrendous way and the State is accusing a young man with a good future and smarter then a wip. They say he went into the a house with a bunch of people and a packed parking lot of vehicles by his self and took out 2 students at the top floor then went to second floor and took out 2 more with 1 being much stronger then him. He did this between 8 to 12 min with just a K-Bar knife. Then ran out the back door and drove off so fast that all the DNA went out the window. Now every court date they have showes him more and more innocent. No connection, no DNA in car, apartment or office and no stalking. Then an expert witness who is going to testify in hearing his car wasnt at the crime scene. Prosecutor stating the thing the police write up about there arrest ( Just went braindead and forgot what its called) but is irrelevant now that the LE were caught lieing. Procecution is hiding something and wont handover paperwork. So many secrets and lies. Then Kaylee father saying in a interview that prosecution is having problems putting Bryan in connection to any off the victims. He is from Pennsylvania only been out there for couple months before crime and didnt know them. So ya pretty much having a nightmare. How do you get justice when he is innocent and is either still in jail for his safety or is working with LE. So how they getting justice? Since crime scene is gone.

I think a lot of people dont understand how important the rights of a defendant are. Those rights are not just in place for the defendant but also for the victims. If you were a true fan of true crime you would know that every single time that someone is convicted and that conviction is overturned decades latter because of dna evidence or someone confessed later (and gave details only the killer would know) the families ALWAYS remain convinced that the person they thought was guilty because the police told them so is the "real killer" and they get offended that the conviction was overturned and the INNOCENT man was released and now they have to go through all that pain again.

Sometimes the wheels of justice run over the wrong people when they move too fast. I don't think the change of venue is really slowing anything down. What's slowing things down is exculpatory evidence that the state won't produce. This suggests to me that the investigation was not thorough or complete and the victims' families deserve better than that. The need for a change of venue is due to the action of LE and it didn't have to go this way.

The defense attorneys have made on the record, in-court statements to the judge attesting to their confidence in their client’s innocence. That is actually not common for attorneys to do. They want to maintain credibility with the judges and don’t generally make such direct in-court statements. If I were the victims’ parents, I would want to know that the defense attorneys have seen that make them this confident. Major issue #2 is that they didn’t glean any dna evidence from his car. It doesn’t matter how well he cleaned it - it should have been a treasure trove. Major issue #3 is that the hearings have opened the closet door to some of the evidence and it sounds like things are NOT as cut and dry as they were made to sound in the probable cause affidavits and warrants. I would have a lot of questions if I were family of the victim, but I think it would be hard to be objective. You desperately want to believe the police got the right person. Even if the families of the victims are not the primary consideration for change of venue (as some are insisting on this board), the fact remains that the presumption of a location is the county in question - and the burden is on Kohbeger to establish that he can't get a fair trial there.
Not only that, but from what I've read, the place to evaluate whether or not someone can get a fair trial, according to case law, is during the voir dire in that location. And you don't need an entire county to be unbiased. You just need 12 fair-minded jurors plus some alternates.
Also, in addition to impartiality, the defense argued on the basis of convenience for witnesses because Boise has an airport. Well they have 2 airports right there, so this is one more thing that the defense is absurdly arguing. In addition to what seems to be her own bias about the county in question..
She made this decision even before she hired this survey taker - and seemingly just to get the answer that she wanted, not to measure what was actually the case. And, allegedly, this survey taker even found the same results for the other locations under consideration.
I agree with the State - short of something astonishing being uncovered during a voir dire, I see no reason either, this guy can't face his peers in the community where he is alleged to have committed this horrendous crime - and as other defendants have to. And also - the State pointed out that, if they determine there's too much bias during the voir dire - they can always have jurors brought in from another county and sequestered in Moscow for the trial - which is going to be 3 months long.
What people also aren't getting here - this is the presumption - facing the community. And the families of the victims and the survivors are members of that community. Most of the witnesses around the circumstances of the immediate crimes are in that community too (police, neighbors, medical examiners, etc.) So, with a COV, you're actually inconveniencing the witnesses, quite the opposite of what the defense argued.
People should also consider the costs of the trial - which I would think additionally play into the presumption of having the trial held in the county in question. This trial in particular is already costing Latah County taxpayers in the millions, I read. If you move it hundreds of miles away to Boise, costs will grow considerably higher - and, without the "benefits" of any revenue coming back into the community that's paying for it.

Honestly, more than ever, I am behind Bryan Kohberger's rights to receive a fair trial. Much of that emotion is fueled by the bad behavior that the Goncalves family, Steve in particular, has shown throughout the early investigation and how inappropriately they've acted. They hired a lawyer, trying to twist the law's arm in handing over evidence they'd gather, because he felt his family was entitled to it. They WERE NOT. He criticized the investigators as doing nothing, and pressured them to release info they didn't want out there, for obvious reasons! He was critical of them not releasing the car info, bashing them for not trying hard enough to solve this case. Meanwhile, they were already tracking Kohberger and his father across country, and did not want that info all over the media because they did not want him alerted to the fact that they were trailing him. Goncalves has threatened to blow this whole case with his public nonsense, and I am beginning to believe they might be railroading Kohberger because they want him to pay. They don't care if it's THE right person, only that THIS person get convicted. So, I'm glad that Kohberger has a good attorney who is fighting for his rights because of the mob mentality that Goncalves is leading with his torch. And, to skywatchers everywhere, Kohberger's alibi makes perfect sense. To view nighttime events, with planets, comets, etc, the optimal time is in the wee hours of the morning, when there is the least amount of light interference in the skies. And the fact that he took pictures of the stars and the sky at that park? That is someone only the really dedicated astronomy nerds do. My friend is one of them.....he once slept in a South American desert to view the spectacular skies without giving a thought to the fact that rattlesnakes love to look for warm bodies and places to snuggle on a cold desert night. So, yes, his alibi makes perfect sense. That house was a 24/7 party place, with people coming and going and not even knowing who lived there. It's possible that Kohberger himself may have been there at some time, because we know he went to the pizza place they worked at. If he was trying to get to know them, it's very likely he could have wandered in at some point, which would explain evidence. So, people need to tread carefully here. This man is facing the death penalty, which means a fair trial is the most important factor, here. I wish the Goncalves' and their lawyer would shut up. Even the other families have distanced themselves from them and have shunned "joining" them in their very public mission.

Just like the prosecution in the Murtaugh trial didn't make sense, and to any person remotely familiar with guns the prosecution testimony that short barrel shotguns aren't a thing and don't exist only shotguns with 4ft barrels like the one they seized but wasn't the murder weapon...... and the judge saying that the defense couldn't bring up the death threats the dead kid got from family members of the girl he killed in the drunken boating accident... as if revenge killings aren't a thing..... and that Murtaugh killed his wife and one son to somehow cover up the financial crimes he was being investigated for? As if a lawyer wouldn't know that just because your a victim in crime B doesn't make the investigation of crime A go away? Murtaugh was convicted because he was unlikable and people wanted him in jail, they didn't care if he killed his wife and kid they just wanted him in jail so ignored all the evidence that either Murtaugh couldn't have done it (he cell moving up to the house at the same time the phone found on his wife's body was moved) or that if he was involved he couldn't have done it alone (prosecution claims he did it 100% alone)

Something about the way that second sentence is structured, combined with the lack of quotes separating "The only people that matter are the victims!" from "What a statement..." makes it easy to overlook the fact that you are talking about someone else's opinion. It reads as if "The only people that matter are the victims!" is your opinion. I'm not 100% sure why,¹ but I think it would be more clear what you meant if you used quotes like so:

I feel for thousands of Victims who Wait for Justice in our system... but a presumption of innocence applies until All Evidence is presented to a Jury or judge. Change of Venue can possibly tighten and Quicken a subsequent trial-- without a certain appeal, if convicted. Our legal system is being challenged on the fly these days, with Bits of information and lots of assumptions streaming ahead of Courts in media. Also, apparently there's Plenty of habitually reckless and deplorably biased police work, sometimes with prosecutorial and judicial misconduct-- which actually Delays Justice for survivors as well. I can only imagine how they feel about Kohberger, but rushing this will only Delay Justice further, imho.

It doesn't matter to me if he is found guilty or innocent.
What I want to see is a fair justice system (something I haven't seen in 99% of the cases I've watched in the past 4 years). I'm sick of seeing the obviously corrupt system violate peoples rights and seeing people cheer because they got to punish someone.
Any time I have to work alongside anyone from my local sheriff's office I tell them they better be on their best behavior and not fuck around because if they fuck up ill be the first defense witness to discredit their work (I tell them this to their faces) because I recently watched their ineptitude and corruption try to convict someone for a murder that he didn't commit.

As long as they have 12 fair minded jurors, I don't see how the Defense would have a basis for appeal on this matter. They don't have a solid argument on this issue as of yet - and the burden of proof is on their end. The presumption for a location is Latah County.

🙋‍♀ Thank you, Peter, for another informative episode. I don’t know how to put this where it doesn’t come across sounding harsh or cruel, but when it comes to change of venue, first and foremost should be the rights of the accused to get a fair trial.
No question, the opinion of family is important, and how it will cause hardship with traveling etc., however it’s a *much smaller* consideration compared to the rights of the accused. Based on your prior videos, and others I’ve heard, explaining the pros and cons of leaving it local, I’m not sure I’ve been convinced that he could *not* get a fair trial there with the jury pool available. All concerns could be worked out fairly easily during actual jury selection.

The commentary and questions by Vinnie I find frustrating and I so respect this channel with presumed innocence - asking about victim impact etc etc like this trial is just a mere hoop to get thru I just don’t like. I feel these parents and families need to be close but was not sure are all the parents effected by which county ?
I am so appreciative of gavel to gavel coverage but always get concerned w high profile cases where a verdict seems to precede a trial
Do not blame or judge these parents in any way - just to be absolutely clear their voices are free to speak however they choose.
