  • The differences between Judge and Magistrate becomes very important to know for students when they are dealing with the subject of Code of Civil Procedure and Code of Criminal Procedure.     Pls someday try to cover difference between writ, petition, appeal, suit, chamber summons etc. And also the various stages of court filing and where all the above written come into picture

    Mam, what's the difference between Judicial magistrate and executive magistrate?

      Magistrate are of two kinds:- (1) Judicial Magistrate (2) Executive Magistrate. Judicial Magistrate is a Judicial Officer Whereas Executive Magistrate is a Civil Officer. A candidate has to clear Judicial Service Exam to become a Judicial Magistrate, whereas to become an Executive Magistrate one has to clear Civil Service (Executive) exam. An IAS/IPS Officer can be termed as Executive Magistrate when they gets posted in the rank of Sub-Divisional Executive Magistrate/ Sub-Divisional Officer (SDEM/SDM/SDO). under the Provisions of CrPC Judicial Magistrates has wide scope of power as compare to Executive Magistrates. A Judicial Magistrate conducts trials & authorised to take evidence under the Indian Evidence Act, 1872. Whereas an Executive Magistrate can only pass an Order under CrPC Sections 107,144 etc. According to theory of Separation of Powers, we know there are 3 organs of Government :-
      (1) Legislative (2) Executive (3) Judiciary. The Magistrates which comes under the Executive organ are called as Executive Magistrate. For eg: IAS/IPS/DM/SDEM/SDM/SDO/BDO/Secretaries of Ministers etc. Whereas, The Magistrates which comes under the Judicial organ are called as Judicial Magistrate. For eg: Judicial Magistrate 1st Class, Judicial Magistrate 2nd Class, Chief Judicial Magistrate (CJM) etc.

      Executive magistrate is IAS officer... Who look after district administration "DM"... They have some judicial power also but they are not judge

    Mam according to sec 11 (3) of crpc it clearly state that ,when any person crack the judicial service exam he or she will be appointed as civil judge neither judicial magistrate becoz H.c will appoint member or civil judge when it appear to be expedient hence 'Jolly' will be appointed as civil judge
    I think so....

    One point more ie 'trial' ordinarily takes place only in lower Courts of Judge/Magistrate not before Justice should have been added. Thanks a lot..... Keep it up please🙏

    ADJ, DJ, ASJ, SJ, are part of HJS. a magistrate/ Civil Judge -I, II cannot be simply promoted to ADJ, ASJ, level. They have to appear in HJS exams.
