    India itself does not grant citizenship to children of foreign nationals born in India, so why should the United States?
    Here is an example: Children of foreign nationals (non-OCI holders) of Indian origin born in India don't get Indian citizenship even if foreign national parents or grandparents were Indians once upon a time. But we expect the US to dish out citizenship as it feels it's a birthright.

    Exactly! I was born in India to foreign parents being Hindu & Spoke one of India’s languages lived in India all my life until 25 ! India didn’t grant citizenship to me ! I chose to migrate somewhere else ! Why should US should give citizenship to temporary residents there

      Trump cannot go against the constitution of the USA. He takes an oath to uphold the constitution of the USA. Citizenship by birth is the right given in the US Constitution. Trump will be impeached on day 1 if he does that, and even if the law is passed, then all US citizens who are born in the US can be ripped off their citizenship, beginning with all of Elon Musk's children.

This historical context is crucial because there is a growing debate about immigration, especially in light of recent demographic shifts.
    For the first time in U.S. history, according to the 2020 census, the white population has started to decline. This trend isn’t isolated to the U.S.; it’s a global phenomenon, with lower birth rates among white populations across the world. Additionally, with the rapid rise of AI and machine learning, there is a push from some political leaders-like Trump-who feel the need to protect the interests of the white demographic. As someone who understands the dynamics of racial and social change, I can see how this is influencing current political discourse.
    On the other hand, Black Americans, like me, also face demographic shifts. The Black population in the U.S. has decreased from 13.9% to 12.1% in recent years. Why? A significant factor is the growing influence of feminism, birth control, and the legalization of abortion over the past 60 years, all of which have contributed to lower birth rates in our community.
    When it comes to immigration, it’s crucial to recognize that being born in the U.S. does not automatically grant citizenship to foreign nationals or their children. Those who are not U.S. citizens by birth have no inherent right to citizenship, and the idea of birthright citizenship should not apply to everyone who is born on U.S. soil. Foreigners, regardless of their background, are not entitled to the same privileges as native-born citizens.
    In sum, we need to be realistic about the way immigration and demographic shifts are affecting the U.S., and we must remember that not everyone is entitled to the same rights or benefits under the Constitution.

    There is a major difference. The US created the H1B and path to green card for their interest by a legislative act(India or the gulf countries have not). Therefore the US must make provisions for workers who are human beings and have a life to live. More importantly US is an immigrant nation, built by settlers.

      The US created the H1B but no path to green card. For example, if you obtain H1B and apply for visa stamp at the US embassy in New Delhi and if you say you are going to the US to permanently stay there your visa application will be denied. So, H1B never guarantees path to green card .

    This is how it is currently in the UK wherein one of the parents should be British Citizenship or PR status to make the child British Citizen by birth. This current rule in US is utter nonsense and obviously easy to exploit. Why was this law even allowed to continue for so long?

    Please check the policy in detail - it clearly says the children of non-citizens/illegal migrants will lose their status as citizens. If you start immigration illegally - you will be paying the price, which should not surprise anyone. Indians or any national became citizens through the legal process, and their kids born in the US have nothing to worry about. People are becoming citizens through student visas, H1-B... It is all good. Many people who fly to the USA on visitor visas in their second trimester to have their kids in the USA will have to face the consequences. New Zealand, Australia, and any European country do not allow illegal immigrants - they have skill-based immigration policies. President Trump is moving in that direction. It's a win-win for all.

    I have personal information of this: Teachers from University of Delhi try to get some fellowship, scholarships, studentship, scholarships etc. that were meant for technical stall, lab staff etc. when their (teachers’ wives) were pregnant or preparing for a child. Then they go to the US with their wives, stay or hang on there till the children were born and return. Those children apply for US citizenship at appropriate time and settle in the USA. I can provide names of a few of them who made use of this. I appreciate the move if such an issue is being considered.

    An executive order cannot override the US Constitution. Currently it is not illegal to come to the US to give birth or any other legal medical treatment as long as it is disclosed to US immigration. It is considered a medical procedure and you have to show that you have the funds to pay for it and leave by the expiration of your visa.

      Exactly, but new laws can be passed just like when they passed the Child Citizenship Act. Though it's a long shot, constitutional amendments with regards to citizenship are now also possible with a Republican controlled senate and their slight advantage in the house.

      Was an expat in Nigeria all Nigerians rich and poor were scamming. You say it is not against the law, without any experience. US Embassy in Lagos is never told about the pregnancies when applying for a tourist visa and have cancelled visas at Lagos airport as it was a racket. Heathrow airport termed this scam "Lagos Shuttle" which I used to travel on. World over million+ scams are used for legal/mostly illegal Western Christian citizenship.

      I think you are a Tamilian. Would you feel happy if the Sri Lankan government decided to revoke the citizenships of Tamilians living in Sri Lanka and deport them? They would lose everything they have and worked for. Would you still be ok with that since “every country has its own law”?? All I am saying is have some empathy for your fellow Indian brothers and sisters who would lose all their life’s hard work and dreams if Trump were to deport them back to India!     You guys talk so much about how Indians can settle in USA. Why don't you talk about how hard it is for non Indians to come, work and obtained citizenship in India. I'm sure that's way harder in fact there is no such way. Where as you want USA to keep their gates open- isn't it a double standard. USA also have the rights to protect itself. And do not think living, working and paying taxes - USA can survive without their taxes.

      Two things seem to be overlooked:
      There's a clear distinction between being "illegally in the country" and being legally in the country " F1 Visas, Greencards etc."
      The Supreme Court would have to overturn United States v. Wong Kim Ark, 169 U.S. 649.

    Tired of birth tourism for citizenship. For example, many wealthy Chinese travel to U.S. to give birth to children, then apply for Medicaid since U.S. government cannot verify their assets and income in the U.S., but they do show their assets and income when applying for visas. They take advantage of U.S. tax payers 😢😮

      Every country gives citizenship to the baby born in foreign country. Mostly Europe, most European countries allow citizenship by ancestry not by place of birth.

    Most countries don't issue people citizenship merely for being born there, including India. Whether Trump's executive order will be considered unconstitutional or not, his talking about it has probably gotten a lot of people questioning whether the US should continue to have birthright citizenship. This could very likely be the beginning of the end of it.

    Citizenship law cannot be changed by Executive order. It is a Constitutional law and requires a Constitutional amendment. The Constitutional provision has been upheld by US Supreme Court.

    There are women going to US for delivery on Visitors visa even for delivery, especially from some buisness community , besides some go on visiting visa and stay in US .Hope Mr Trump will clean up the Indian community who exploit US . 90% of products used in US should be US made, no more outsorcing Industrial products!
    I found US flags made in China in a Tourist place in 1978 when I visited US. In 2023 when I visited US I thought about the situation of US !
    Hope US will be "America" ! When ever I Visit US in particular New York,
    I remember visiting the top of World Trade Centre in 1978 and the People who died there in 2000.

    The US is entitled to pass laws which it determines is fair for "its own citizens" and not for temporary visa holders (whether they are here on temporary visas for study, work or business). Every country will obviously pass laws that favor its own citizens first. This is a loophole right now in the US for temporary visa holders. Illegal aliens also abuse this loophole. There are so many 'naturalized' citizens who have followed the laws and have earned their citizenship. Non-citizens shouldn't assume that they are entitled' to enjoy the benefits that citizens get. It's unfortunate for a lot of temporary visa holders or those who are on the verge of getting their green cards approved. Trump and his administration are pursuing right policy to close this loophole.

    There's nothing wrong. So many Indian expats have lived and worked in the Gulf / Middle East for more than 30 to 50 years children too are born to them grown n married. They all hold Indian Passports and are NRIs as their parents are NRIs. If an Indian is not a citizen of the US how can their child at birth become an US citizen. Why do Indians in the US feel that their child should get citizenship and it's their right. You have rights in your own country of birth for Indians ie India. US as a country is free to change laws for expats if they want.
