    If someone else designed my logo and gave me permission to use it, how does that dynamic work in regards to copyrighting? Does the logo designer copyright the logo or do I?

    • @ElizabethPW
      @ElizabethPW  2 года назад +2

      If someone else creates a logo or other creative work for you, if you want to own the copyrights on it then they need to "assign" them to you in a signed writing. Can be just part of a contract. Some designers don't do that -- then you have a license to use it, but they still have the copyright.

      If you're asking about trademark vs copyright, for your name & logo you'd look at trademarking

    If you make a design say a custom wall shelf can you copyright that design? Or do you have to design patent it?

    • @ElizabethPW
      @ElizabethPW  3 года назад

      You can copyright the design of something functional (like a shelf) as long as you are copyrighting the creative elements. Like you are not copyrighting the rectangle shelf aspects that hold up the books - you are copyrighting the original creative design of the carvings (or whatever decorative or original elements exist).

    A LLC gives no protection to your business name?

    • @ElizabethPW
      @ElizabethPW  3 года назад +3

      If you get the LLC called "Chicken Soup LLC" then no one in your state can get that exact name, but someone could get "Chicken Soup International LLC" or a variation. And, someone in another state could get the exact same name.

    I want to make a Catipiller (CAT) knit beanie hat for my husband but not sure if it's legal for personal use. I tried to read on it and got confused.
    I know I've used a few other brands and never thought anything about copy rights and trade marks. But I want to know what's legal vs what's not legal for me to create using brands or logos for personal use and not for sale.

    • @ElizabethPW

      The hard part is that the rules (of "Fair Use") are multi-factor and vague, so there are rarely bright lines. Here, you are not selling them, which is the most important factor. From a practical perspective, for something that is personal use and not on the internet, it is unlikely that anyone from the brand would ever find out. They do sell hats with their logo on them, so if you are worried that would be the safe bet.

    Is possible to use the trademark or copyright name on passport for change the name.

    • @ElizabethPW
      @ElizabethPW  9 месяцев назад

      For a passport, it needs to be the person's legal name. That has nothing to do with whether you have a trademark or copyright on the name. If you want to do a legal name change, that is usually in the local county court

    wish we learned this in school instead of freaking calculus.....

    • @ElizabethPW
      @ElizabethPW  2 года назад +1

      Agreed!! There should be a legal class in high school where we learn about how to do taxes, how to read a rental agreement, how to read a loan/debt agreement, what to do if the cops pull you over, etc.

    I still don’t understand if I should be copytighting or trademarking my logo

    • @ElizabethPW
      @ElizabethPW  3 года назад

      Copyrighting it is a good first step and is not expensive. Once you are settled on a logo (once you won't change it for a while) then you can trademark it, if you have the budget.
