This video explores the historical and ongoing territorial disputes over Sabah between the Philippines and Malaysia. Tracing back to the 15th century, the region was part of the Sultanate of Brunei, later ceded to the Sultanate of Sulu. In the 19th century, agreements with British figures such as Alexander Dalrymple and William Cowie formalized control over the area, eventually leading to the establishment of the British North Borneo Company. Despite becoming part of Malaysia in 1963, the Philippines continues to claim Sabah based on historical treaties. Recent arbitration has awarded $14.9 billion to the heirs of the Sultanate of Sulu, further complicating the dispute. This video delves into the legal, historical, and political aspects of the conflict, examining whether the incorporation of Sabah into Malaysia was legal and the implications of the 1878 treaty.

You can be Malaysians all you want and no one is forcing you to be Filipino. The fact that Malaysia won't face the Philippines in a legal arbitration to finally settle the Sabah Issue says all about your government. If Sabah will be returned to Sultanate of Sulu then you just have to packed your bags out to other place where you can feel more Malaysians.

There is a court case recorded in 2001 by ICJ (International Court of Justice, The Hague) about the Philippines' claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and is easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. Philippines which is not a party to the trial requested permission to intervene. To comply with Article 62 of the Statute of the Court, the Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve the Philippines' historical and legal rights (only found in the 1973 PH Constitution) over North Borneo and to inform the court of the effect or effect of the court outcomes of the trial on its claim to the territories. In that trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were present. On 23 October 2001, by a 14 to 1 vote, the court rejected the Philippine's request on the ground that there is “no interest of legal nature” (Section 93). (Meaning Sulu/PH claim on Sabah is null and void) Type the statement below and go to the official ICJ website (a 37-page report): INTIZRNATIONAL COURT OF JUSTICE REPORTS OF JUDGMENTS, ADVISORY OPINIONS AND ORDERS CASE CONCERNING SOVEREIGNTY OVER PULAU LIGITAN AND PULAU SIPADAN APPLICATION BY THE PHILIPPINES FOR PERMISSION TO INTERVENE JUDGMENT OF 23 OCTOBER 2001
Notice the PH objectives in the intervention, its primal reference, and the verdict by the court.

Does a tenant have the right to consent to the sale of a property or is that the right of the owner? This is the crux of the issue that Malaysia chooses to down play as a non issue because the truth of the matter is unfavorable to them. In fact the consent of the RESIDENTS of Sabah is a non issue because they do not hold the right to surrender territory that DOES NOT BELONG TO THEM. If that is the case then Tenancy agreements to houses and properties will be endangered but that is not the case in Malaysia because Land Law respects the rights of the land owner.

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

Indeed the Malaysian Government breached the 1878 (Lease or Rental) Agreement when they ceased to pay the annual rental to the heirs of the sultan of Sulu and Sabah. The award of the French Court is just and fair for the poor landowners who were receiving meager rental payments of a vast real estate considering the reality that it is now the 21st Century. The French Court must maintain and uphold the decision awarded to the heirs of the sultan of Sulu as real estate legal precedent that an ethnic group of people can not just migrate to a certain land and later on claim self-determination, otherwise the Middle Eastern Asians, South Asians , and other ethnic group of Asians in London can claim the right of self-determination as well as the hispanic majority in California.

The 1878 Agreement is an annual lease or rental beyond the lifetime of the sultan of Sulu. It means the death of the sultan will not abrogate the annual rental agreement. There is no such annual rental if the agreement is to cede. Squatters of Sabah who didn't even recognize the sultan of Sulu and Sabah as the owner of the land can not claim the right of self-determination otherwise it will be a precedent for any squatter to claim the right of self-determination with the landlord or land owner left without any legal protection.

    • @hopelope1703

How do you explain the existence of two agreements related to the ownership of North Borneo (Sabah) namely between Brunei Sultanate & BNBC (29/12/1877) and Sulu & BNBC (22/17/1878)? The only existing agreement involving the Sultanate of Brunei (original owner) is that agreement that Brunei granted and ceded North Borneo to BNBC on 29/12/1877. If the Brunei Sultanate had given North Borneo to Sulu much earlier, his majesty would not have signed that 1877 agreement. The signing confirms North Borneo belongs to Brunei and not Sulu. Why is there no protest from Sulu to Brunei for signing the 1877 agreement? Why was the Sulu & BNBC agreement not signed earlier in 1877 but 3 weeks later (1878) after the signing of the 1877 agreement. The original agreement in Tausug is missing during His Majesty's trip to Singapore, Thus, the validity of Sulu ownership of North Borneo is doubtful. How on earth can Sulu own North Borneo if there is no undisputable proof that the Brunei Sultanate gave it to them earlier? Unless there is a possibility the British had been scammed, deceived, or intimidated by Sulu into signing that 1878 agreement? The first agreement (1877) with the original owner is more valid in court.
The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878.

If you called it rent, where is the agreement between Sulu and Malaysia? If none, it is just like what pirates and mafia do for a living. Why in the 1878 agreement, was Malaysia not mentioned? Is there any clause in the 1878 agreement that Malaysia has the responsibility to continue paying Sulu? Why do the receipts in Sulu's possession not mention the money is for the rent? Why is the amount so small and not what has been stipulated in the agreement? One Mexican gold dollar (coins) in 1878 weighed 1.7 grams of gold. So, 5300 X 1.7/1000 = 9.01 kg of gold. Compare the value of 5300 Malaysian dollars to 9 kg of gold. Giving away money is not an offense. Can give or stop giving any time.

Sulu’s ownership of Sabah can be disputed. Because Brunei Sultanate (original owner) granted North Borneo (Sabah) to BNBC dated 29/12/1877. Much earlier than the 1878 agreement. How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid.

@@xdtrobowen3881 There is a court case recorded in 2001 by ICJ (International Court of Justice, The Hague) about the Philippines' claims on North Borneo.

For me it's up to Sabahan to choose and the choice is obvious here: No one want to join Philippines.
For Philippines, they definitely don't need another land and initiating this claimed just bring tension over already peaceful SEA region. It was a lost fight for Philippines. Sabah never part of Philippines and Sabahan never been Philippines. They probably want an easy money from Malaysia and try to find a loose end in historical record while they denied China claimed over South China Sea over historical record.
Even though Philippines get Sabah then what happen next? People probably move out from that, they can't develop Sabah as their own country already had more problem than it was already is. Tbh, Sabah is indeed rich in natural resources but still one of the poorest state in Malaysia compare to their neighbor Sarawak. And it currently struggle with million of stateless people. It is not even worth it in my opinion. Malaysia ofc will fight for it.
This will probably end with three things:
    1. Malaysia will win anyway. International court would find the claim a bit crazy.
    2. Referendum with Sabahan people will be made: they definitely don't want Philiphines.
    3. Philippines win? They will try to get payment from Malaysia, ofc Malaysia will not do it, they can't afford it in fact. War is possibilities but no one want that. But the chance are very low. No one in their right mind would give a large chunk of land that had been part of country for 60 years to another country overnight. People will get tired of this and eventually forget about thus. I have to say this, while Philippines have been steadily increasing its military strength through state of the art weaponry, Msia is plagued by scandals after scandals with billions lost. The recent AGs report is evident of this. Msia is now behind most of its neighbours. And Philippines is challenging Msia's sovereignty over Sabah😂😂😂Good luck to Msia!

      I agree to disagree.
Sabah _used_ to be the Philippines territory during Diosdado Macapagal's rule. However the UN did recognize the state as part of Malaysia now. So unless we want to be colonizers like Spain, Sabah will always be part of Malaysia.
Lemme know if I missed anything. I would love to hear about your insights.

doesnt work that way dude. it is up to the colonizer to give independence.. riau islands and large parts of sumatera originally belongs to malacca and johor sultanate, but later divided by the colonizer, some goes to british, some goes to dutch, so after independence, riau and sumatera goes to indonesia(dutch) instead of returned to johor/malacca

The original date for announcing the entry of Sarawak, North Borneo (Sabah) and Singapore was 31 August 1963 to match the date of independence in the Peninsula. However, due to some objections from the Philippines and Indonesia, the Chairman of the United Nations at the time, U-Thant had boarded a plane from New York to Sabah to personally ask the wishes of the leaders and people of Sabah. It must be understood that aircraft technology in the past was not the same as it is today where U-Thant aircraft had to stop and stop at several locations before reaching Sabah so when returning to New York to confirm Sabah's position in Malaysia. Because of that, the date of entry of Sarawak, North Borneo (Sabah) and Singapore was made public on 16 September 1963. In short, Sabah's independence and participation in Malaysia was recognized by the United Nations and it is no longer in doubt. If they don't agree, the Philippines can take the same action as Seokarno by taking Indonesia out of the United Nation and inviting China and Russia to invade Malaysia. But the war in 1963-65 ended with the defeat of Indonesia and the General of the Indonesian Army at that time Seoharto seized power and arrested Seokarno.

Historical Context: Sep 2nd 1945 the instrument of surrendered, Japanese occpational lands surrendered to china. After World War II, Japan's territories, including those in the South China Sea, were surrendered. The Republic of China (ROC) then claimed some of these territories based on historical rights. When the People's Republic of China (PRC) was established in 1949, it continued these claims.

There are four (4) agreements that exist between Brunei Sultanate grant and cede North Borneo to British North Borneo Company (BNBC) dated 29/12/1877. Below is just one of the examples.
Just type “Grant by the Sultan of Brunei of territories from Paitan to Sibuku River. These are…”. Go and check the Sabah State Government Website or UK Government Website (National Archives) for the details of the agreement.

    • @hopelope1703

    • @hopelope1703
