That's a bug with the water detection code in Sonic 06. The rushed code simply says that touching water starts the drowning counter while originally, it was meant to have the character completely underwater for the countdown to start. Edit: The same thing occured in Sonic 4: Episode 1. They patched it in Sonic 4: Episode 2.
