- Both Colorado and Maine have made efforts to remove Former President Donald Trump from their respective primary ballots, citing Section 3 of the 14th Amendment as cause for removal. Trump has been temporarily put back on the ballot in Colorado after a challenge by the state's GOP party was sent to the Supreme Court. What happens next in Maine, and potentially, the rest of the country?
Former Governor of Vermont Howard Dean and Semafor Founding Editor at Large Steve Clemons join Yahoo Finance to weigh in on these developments and give insight into what the next move could be for Trump, Biden, and the courts.
"It's going to end up at the Supreme Court. The problem is the Supreme Court is, essentially, corrupt. They have been appointed to fit certain criteria by a very influential group of gazillionaires called the Federalist Society," Dean says. "Two of them have actually taken money from people that sat in on cases. So while the court legally, probably, has the final jurisdiction, I think most of Americans no longer are confident in the Supreme Court's ability to carry out its role as a result of the shenanigans that's gone on."

Seriously, what happens next? That seems to be pretty obvious. The United States supreme Court will hear these cases in a few weeks and overturn them promptly. Once more, I strongly suspect that the court will issue a blanket ruling that stops other States from attempting these kinds of stunts.🤣

Insurrection is a federal crime. One has to have due process and be convicted of said crime.
Neither her, nor the Colorado SC, have jurisdiction to hear or decide anything about a federal law. They cannot decide someone is guilty and simply punish them without due process.
She violated federal law. So did the Colorado Supreme Court. 18 U.S. Code § 242 - Deprivation of rights under color of law.
The funny thing is, the same Amendment they tried to enforce is the same one they violated. 14A Section 1 - No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

No, he doesn't have to be convicted to be removed from the ballot. At no place does the Constitution say that. All 50 states have what are called ballot access laws and every candidate must meet the requirements under said laws to qualify for a state election ballot.

It's treason if one is removed from a ballot based on an indictment (aka charge with) but not convicted..any American constitution oath taker to protect the law of the land, knows this.
