    Imagine being a victim and having a pending u visa case for 5 to 10 years and you can’t travel - INHUMANE, outdated and confusing laws

    So I want to know if I can travel I receive my job permit social and my u visa today would u recommend me to wait the 3 years to become a resident or try to travel now

    Hello, Maam, Thank you for your video, it was really helpful and May i ask you some questions? I got u visa approval notice in December 2022, and the U visa placed in my passport. I entered USA with U visa in Feb 2023 and I am in USA right now and applying for EAD right now, but I plan to go back to my country for bring my son and go back to USA on May. So I wondering can i go to outside of USA or not? and may i need to apply something for traveling? or not.

      Hello, Eri Kanno,
      If a U visa holder already has the visa in the passport, they are able to travel without having to schedule a consular appointment to return. However, it will be important for the later residency application to prove that the U visa holder did not remain outside the USA for longer than 90 days during any trip, or more than 180 days in total during the years they had U visa status.     My wife and son have their valid U2 and U3 visa on their passport. They have applied for work permit but they haven't got it yet. Can they still travel outside usa?

      Hello, Ramit,
      Having the work permit application pending does not affect travel eligibility - if your wife and son have their visas already in their passport, they can travel while the work permit application is being processed. Please see other notes regarding limitations on the number of days outside the USA.

    Hello ma’am ! I filed in early’18 for U-visa. They approved I-192 waiver and granted deferred action status . I was deported too . I have been waiting for almost five years for anything I could hear from the uscis . Another thing , they deported me after I had filed my case but I was under supervision. They didn’t wait a second to deport me after they had papers straight ! I wonder if I can get a visa from a consulate since the waiver is already approved ?

      Hello, Mr. Gill,
      It is unlikely that a consulate will provide you with a parole document to enter the USA based on the approval of your bona fide determination or U visa waitlist status. However, perhaps it is worth a try if not too much trouble to visit a local consulate. The current presidential administration is not pursuing deportations against people who are waiting for U visas as the last one was. I would encourage you to try to schedule an appointment to talk to a consular officer and see if a parole might be possible.

      Must’ve been under trump. If it was during the Biden admin then a pending u visa would’ve kept you in the US

    I won my U Visa. My wife and son came on U2 and U3 visa. Can they both travel outside US and then come back to US within the visa time period?

      Congratulations on your visas and your family’s reunification. I am thrilled to hear about this for you. Your wife and son should be able to travel with their U visas, no problem. It is important to keep in mind that, for U visa holders who wish to apply for adjustment of status in the future, one requirement is that periods of travel with the U visa cannot exceed 180 days total and no more than 90 days in one trip.

      If the U visa is already in the passport, then the visa holder can use it for travel. It is important to note that, for individuals who wish to apply for resident status in three years, the maximum number of days they can remain outside the USA during the period of their U status is 180 days, and each trip must be less than 90 days.     Hi Madam, I applied U visa in Nov 2015 . Got approved 2020, got work authorization and Deferred action on 2022. Unfortunately Denied I-194 in 2022. Due to family sickness I went back Home in2018 . I got approval and work authorization during my stay in India. Is it possible can I apply for I-194 again .

      Hello,
      I am not sure which form you are referring to - do you mean I-192? If that form was denied, the rest of the U visa was also likely denied because the waiver of inadmissibility is required for USCIS to be able to approve the U visa.

      We have received bona fide determinations or waitlist approvals for our clients who filed in 2016, but the only U visa we have had approved from 2016 was filed in January of that year. We are not being provided clarity about how long the U visa approvals will take.

      Thanks for asking - I should do a quick update for the channel. We have seen that processing times are going down a bit - from 5 years to approximately 4.5 years for the bona fide determination. It’s not enough progress, but we’ll make any improvement!

      Hello, Mr. Barot,
      The BFD generally applies only to U visa petitioners who are awaiting their visas from inside the USA. However, it may be worth scheduling an appointment at a nearby U.S. consulate to ask if you may qualify to receive a humanitarian parole into the USA so that you can continue waiting for the visa. I cannot promise that this request would be approved or granted, but it may be worth trying if travelling to a U.S. consulate is not too much trouble for you.
