      Hello, Yes, this can be a little confusing. For military PIP, the service member can be any age to request the benefit for their parent by filing form I-131. However, for Form I-130, the U.S. citizen petitioner must be at least 21 years old if they are filing for a parent. I hope that helps. Feel free to reach out for additional information.

    Do I need to submit a birth certificate for my parents? I’m turning 21 - born in the states and will be filling the I-130 form in 12/24. My parents have been married for over 20 years, filled taxes jointly the entire time and have TPS for 23 years. Thank you so much for the advice

      Hello, In our experience, providing birth certificates is crucial in almost every kind of immigration-related filing.       Hi, Jesus, Different attorneys charge different amounts depending on where they work, how many years of experience they have, the size of their firm, the level of their service, and the complexity of the case they’re dealing with. Nonetheless, $10K is more than double what I have heard most colleagues are charging for a straightforward FPIP case. Clients are always allowed to seek new representation if they are not comfortable with their current attorney.

    Hi Mrs walker Gates, i got approval from Embassy after my interview, however when i check the USCIS case status change to RFE request, would consider this is error? because i have got approval notice I-797C from USCIS.

      Hello, In our experience, the online case status may be reflecting incorrect information, or it may be that there will be a Request for Evidence issued even after the receipt notice. One of our clients recently had this experience, and it turned out that the RFE was issued incorrectly, so the client’s resident card was approved and issued with no problem. We will simply respond to the RFE with a brief note that it appears to have been issued either to the wrong applicant or to our client by mistake.

      Hello, Noemi Galindo-Hernandez, In our experience, it is possible to correct this information at the interview before USCIS or the consular officer, depending on where the final processing of the application will take place.

      Hello, @elianac5696, If she is within 33 days of the denial letter, she can request that the case be re-opened. If that time frame has already passed, then she can reapply and can also request a medical waiver of the civics test requirement.       Hola, Cristian, Depende mucho del caso. A veces, la entrevista es igual a los demás - en la oficina con el oficial de inmigración, pero tal vez en el idioma nativo de quien aplica. A veces la entrevista se conduce en la casa del aplicante, si la persona tiene discapacidad profunda y no pueden viajar a la oficina de USCIS. También he visto entrevistas en hospitales. Pueden realmente ser muy flexibles cuando es necesario.

    Very informative on what documents the petitioner needs to submit in addition to the I-864, do you have a list of what documents that needed for the immigrant (Birth cert., Identification Card, passport, etc.) and I am assuming they must be translated in English prior to submitting? Thank you!

      Hello! I’m glad the video is helpful. For the I-864, each sponsor should provide proof of ID and immigration status - that could be a birth certificate, a passport, a copy of the resident card, etc. And yes, every document that is not in English must include a certified translation.       Hello! For children/step-children of U.S. citizens, they must be under age 21 and unmarried to qualify. If they meet those criteria, then they can file so long as the naturalization took place before June 17, 2024.

      Hello, I think this is good news! Legally, an I-485 cannot be approved without first having an approved I-130. I would expect that you should receive the approval of the petition shortly, and that the online status is just not properly updated.

      Hola, En nuestra experiencia, el perdón de la visa U sirve bien para perdonar agarradas, pero el tiempo que toma es mucho. Lo bueno de la visa U ahorra es que, en muchos casos, se puede recibir un permiso de trabajo y un estatus de acción diferida mientras esperar su visa y el perdón.

    Thanks for the video. Do we have any suggestions for people who will be renewing their Bonafide EAD's under C14 category, please? The waiting times at Vermont Service center for these EAD is around 13 months and at Nebraska Service center is around 7 months. Thanks again.

      Hello, @nsmohammed, It’s good that you’re paying attention to the processing times. Our suggestion for EADs that are not subject to automatic extension is to try to submit the renewal enough ahead of the expiration to avoid a lapse in your employment authorization. So, depending on where you live, you would need to submit your renewal application either 13 months or 7 months before the expiration date.

    Hi, I'm a TPS holder and traveled outside USA for an emergency to see my ailing mother. My three children fell ill, and one was hospitalized, preventing us from catching our flight back to the US. My advance parole expired on August 2nd. How can I extend my travel document to return home?

      Hello, @Ghassanlutf6258, In situations like this, it is typically necessary to request emergency advance parole so that you can return in a timely manner. It may be possible for you to request an appointment at the nearest U.S. consulate as receive assistance there, or you may need to file a request with Department of Homeland Security, along with documentation of your situation and a request to expedite the issuance of your parole. We recommend reaching out to a trusted immigration attorney for guidance and assistance.

      Hello, In our experience, it is permissible for a U.S. citizen to petition for their family members while living abroad. However, it will be important to demonstrate that your parents intend to live in the USA at least half the time, as doing so is required to maintain permanent resident status.

      Hi, @Cindygarcia8555, We believe it will be possible to file for PIP and adjustment of status even if your waiver is approved, and even if you decide not to attend the appointment in Ciudad Juarez. It is important to note that changing your strategy for achieving residency at this stage of your case may actually add significantly to the amount of time you’ll be waiting for your green card. However, for some people, the additional time and expense will be worth it if they do not have to travel outside the USA to finalize the process. This is a decision that each applicant and family will need to make depending on their individual circumstances.

      Hello, In our experience, 10 years of W-2s should be very helpful in proving physical presence for the required time. However, in addition, USCIS in our experience likes to see documentation showing presence on or very near the critical start date that they have set. For example, with DACA initial filings, they wanted evidence from on or near June 15, 2007. For this program, we expect they will want something dated on or near June 17, 2014. A Form W-2 typically does not issue outside of January, so we would recommend using some supplemental documents in addition to the W-2s if possible.

      @@Townbizz400z Hello, We are big proponents of the “less is more” approach - if an applicant can make their case with a few very clear and high quality bits of evidence, the officers reviewing the file will be grateful. Making the reviewing officers happy is a good strategy, in our experience.

    Nice Information. It would be very good of you to let us know regarding filing I-751, the USCIS mentioned to give federal and state tax return . Tax accountant gave the tax return client file which include all.Should we submit the client tax return file given by tax accountant or should we submit the tax return receipt from IRS ? Moreover IRS has not state tax return and how to get state tax return ? Lastly two Money orders separate for biometrics & form or one money order for togetherMaam ?

Regarding the tax filings, in our experience, USCIS likes to see transcripts from the IRS as proof that taxes were not only prepared, but actually filed. However, they will also accept copies of prepared tax documents, but may provide less weight than they would to a transcript. Regarding fees, it is important to verify how and what amount to submit to avoid rejected filings. We recommend looking them up using USCIS’s fee calculator, which you can find here: www.uscis.gov/feecalculator. Please note that separate biometrics fees are no longer required as of April 1, 2024.

      @@jlw.immigrationlaw Thank you so much and well noted, one last question we do have my wife opened the uscis account for me when I was abroad to file the case from USA and she didn't get USCIS online account number option despite reseting password and opening. Now while filing I-751 the option of USCIS online account number box should be left blank or N/A at this time. We would be obliged to get this answer ?

      @@samarpanacademy3813 Hello, In our experience, finding the USCIS account number can be very challenging. If a client has a USCIS account but does not know the number, we write “Unknown” in the field for that number. If they do not have an account, we write “N/A.” Hope that is helpful!

      Hello, @Miguelv546, At this time, we are not sure - though it is likely that the processing times will grow longer as more people apply for the program. If you are hoping for a shorter processing time, we recommend filing your application as early as possible.
