Right to Light - What are your Rights?
for advice on your right to light ask a legal expert at www.expertanswers.co.uk/
Is your neighbour thinking of building an extension and you’re concerned about the effect on your property, worried that it’s ‘gonna’ block you light out? Yes, people are very often concerned about that, particularly before the extension’s been built.
Assuming that the Rights to Light have not been excluded in your property, you could check the land registry deeds and if the extension does block out your light, you can actually do something about it.
You can get the extension stopped part-way through, or, you can actually get it stopped altogether. However, let me tell you, that before it’s actionable, your light has to be reduced by 50% and that is an awful lot of light to lose. Many people bring Right to Light Claims in actual fact, they haven’t actually lost enough light for it to actionable.
The other thing that they’re very often concerned about is that they’ll lose their view or they’ll lose their television signal because of next door’s extension.
There’s already Case Law of that I’m afraid.
If next door neighbour’s extension blocks your television signal or blocks your lovely view of the rolling countryside beyond your house, there’s nothing you can do.
