    Any settlement should include being able to depose the two officers and show those depositions to the public. Make it so those cops won't be cops anymore

      not without serious reform, 1.it should be against the law for cops to knowingly lie to the public about the law, it is perversion of justice. 2. police cannot be allowed to police the police, they have proven that the blue line code of silence will do anything to cover up bad cops. 3. body cameras on AT ALL TIMES, with the video streamed to a secure cloud server not in the possession of the cops. the conspiring to violate rights happens off camera because they are allowed to turn off the cameras or delete the video 4. no more policing for profit, no money from fines or confiscations should EVER make its way back to a police budget.

      But not the way you think. Arizona is fixing to make the filming of police a crime. The Supremes will refuse to hear the case and it will remain the law in Arizona. Then all the traitorous states will follow suit, as is now happening with clearly unconstitutional abortion restriction laws.

    Regardless, Qualified immunity needs to end. Police would be less likely to violate someone rights and even learn our rights if there was the possibility of consequences.

      It would end if fake auditors would not take the cash bribe (settlement check) that is paid for by tax payers, cops then do not have to ADMITT NO WRONG DOING. That hurts are cause so bad. If you take money from us you have no wright to take a bribe that helps dirty cops stay in power. If you are not able to afford the cost then stay home and quit begging for money.

      Damn right they would be. Soldiers have no such thing, we will be prosecuted under UCMJ and they tell us that constantly. I have seen 18 year olds behave way better than cops in even more dangerous situations because they know there are consequences. Cops lose their shit over the slightest pushback.

      The local Police Chief, DA and Judges become part of the damage limitation process for their city/county. Turner v Driver was only established after Battousai (Turner) went to an appeal court and had the corrupt system held to account.

      They will lose nothing. Allowed to resign so they can keep their pensions and rehired by the next town. And the lawsuit? All they have to do is say "I didn't know!" Hollywood elite and government officials are the only people allowed to publicly assault someone and face zero consequences.

    I'm so sick of thug cops avoiding accountability by resigning. They do this to stop the IA investigation. But that shouldn't stop it. If the IA investigation would have resulted in termination, they should be BARRED FROM EVER BEING AN OFFICER, ANYWHERE.

      It should be required that any IA Investigation must be completed before they can even apply for a position in another department, especially when they resign under such suspicious circumstances.

    These tyrant bullies should not be allowed to resign. If they try while under investigation, they should automatically loose police certification, and charged if warranted. A civil suit against the city should be pursued, and the officer should be prosecuted for assault causing bodily harm to the auditor. Three day suspension is not enough for the complicit officer. He has proven he is not fit to hold police powers. He should be fired and prosecuted as well. Only when these criminals suffer the indignity, pain and loss they inflict on others will police arrogance, criminality and tyranny be stopped.

      did you watch the video???, Cagle resigned before he could be terminated, so he will most likely relocate to another PD after the controversy dies off, Mendoza was 'suspended' and will get 'retraining' (whatever that is, SMFH)...while it should be a 'slam dunk' it is rarely that simple, qualified immunity, police unions and corrupt city officials will make sure of that...best thing LJ could do is admit the illegal arrest and offer the man $250K to settle, if they don't they are going to spend that and maybe more defending the case in court and still probably losing...time will tell

      Problem is some won't get a pension. That's a case more easily made for OLDER officers/managers.
      Some have another 20 years to work, pension does auditor no good for what happened in 2021 or 2022

    And remember: the officer with the bent finger got a ride to the hospital with professional medical personnel. The victim, who had a head injury, was taken to the hospital in the back of a cop car in handcuffs.

This officer deserves a medal and possibly even a promotion in rank and major pay raise for putting himself in between the camera and public.     It's good that the injured party has retained counsel and is proceeding with the case. We shall have to see how this plays out.
    I feel (just my opinion) that all that "I can't breathe" stuff from Cagle was for show. He sounded like he was high on adrenaline - you know, rather like just after you've hit someone and caused them to go to hospital.
    Thank you for the update. I too cannot understand why, maybe from a Federal level downwards, notice and clarification about public video recording of scenes (1st Amendment) has not been sent out to all forces and Sheriffs. This needs sorting out - before someone else has to go to hospital. Excellent video again sir.

      No cop should be allowed to resign *while* an investigation is underway, prior to its disciplinary outcome. Far, far too many times resigning is little more than a "Get Out of Jail Free" dodge around taking responsibility for their actions. Preserving their pension and licensure so they can simply go get hired at another law enforcement agency.

      There's no record of the cops failure and no finding of them being at fault...
      Cop moves over a jurisdiction or two and applies for work as a cop .

    These are basic laws and should be covered in the academy, roll call, field training and in the in service sessions. The violation of rights is caused by poor supervision and there is no excuse for it. Retired LEO.

    I hate the fact that the tax payer will pick up the cost for the actions of these tyrants. But it HAS to reach a conclusion, and as Battousai says why does the force just not educate their officers in citizens basic rights. This abuse has gone on long enough its just sickening!

    Have to ask ATA, but SCOTUS said license plates are in plain view of the public and not subject to privacy. For the cop to say "recording license plates are illegal" [sic] shows how ignorant he is of the law, or he lied.
    Like Battosai said, this will be interesting to see how the city defends this lawsuit. They have no leg to stand on.

    I don't understand why the IA investigation stops when the officer resigns. Didn't the incident occurred when he was employed by the department?
    Is like if you run a red light and cause an accident, the next day you sale your car and you're not longer liable for the accident.

    They will offer a settlement before it goes to court and it will probably be taken and they will not be forced to make sure all officers are made aware that people have a right to record in public.. the fact that officers and let me use the phrase they love to use.. IN THIS DAY AND AGE does not understand that the people have a right to record their public officials in the course of their duties is just unacceptable.. it shows both a lack of training to ensure officers do not violate this right and also the outright violence the police will use even knowing this right is well established.. they do not care.. and this is why every time it happens going forward, it should be an immediate firing of the officer.. every single time it happens.. an immediate firing of the officer..
