  • Constitutional carry and concealed carry is on the rise but there are some places you should never carry your gun. The penalties can be steep, gray areas exist and overall you have to know where you can and cannot carry your gun in your state. Some places might be obvious while others, not so much.

Man, I'm so glad to hear from a RUclipsr that's based in SC. With us still adjusting to the new constitutional carry law that went into effect, there's been some cloudiness with what's covered and what isn't. Spartanburg just had to release a statement telling businesses that if they don't want any concealed or open carry weapons, then the signs need to be that specific. When in doubt, they need to put up a "no weapons" sign up , otherwise no sign, then there's nothing to enforce. The asking if you can carry inside a private residence was something I didn't know about until it was clarified in the same article from Spartanburg SC.

The 1000 foot buffer zone around a school is only prohibited if you don't have a permit. This is one reason to get a permit in a Constitutional Carry State, because a permit is required there too if you are on public property within 1000 feet of the school property line.

In at least some states, for some of the areas mentioned, the "no firearms" policy is actually a "no weapons" policy and the definition of a "weapon" can be fairly broad. For example, for prison visitors and staff in NY, even an ordinary pocket knife with a 2" blade is considered a weapon. As for the Federal school zone restrictions, there is an exception for anyone who has a valid permit from the state in which the school is located carrying off school grounds but within the 1000' zone.

I carried a small backpack in Iraq as a go-bag in my aircraft with extra M4 and M9 mags. I was using the same bag for a carry on with just clothes and toiletries through TSA on a trip shortly after returning home. TSA checked it and the sniffer detected gun powder residue. It took a lot of explaining with my military ID that I had just returned from Iraq and that I had used the bag for ammo while I was over there. I didn't think anything about it until that happened because I was certain nothing but clothes and toiletries were in the bag. I feel stupid in hindsight.

I always carefully check to make sure I don't have any errant shell casings that fell down in the seams but I know there's powder residue everywhere. Until then the best I can do is shrug "It's also my range bag. Can I go?"

In Texas the law is over 51% alcohol sales, TABC determines this number based on the establishments sales. So some of the sketchy places trying to avoid the 51% red sign will avoid ringing up some drinks so it looks like they sell more food, that doesn't last long. Depends on the part of the state but seen it before. Flipside to this is when intoxicated you cant have a firearm on you so if you're caught carrying in a bar or even a Walmart while intoxicated you will be arrested.

In Mississippi we have constitutional carry but we also have firearms permits and enhanced firearms permits. If you are carrying without a permit or with the standard permit, you are prohibited from carrying in schools, courthouses, churches, polling places, private property thats posted, and several other places. however with the enhanced permit the only places you cannot carry are police stations, jails, and federal property. We're allowed to carry in schools, gov't offices that are open to the public, churches, polling places, even the courthouse. The only stipulation is that it is illegal to carry in a courtroom where court is in session. "No guns allowed" signs do not apply either but we can still be asked to leave and are required to do so if asked. Those extra privelages only apply to concealed carry.

Virginia has odds rules for drinking while carrying. It is illegal to consume alcohol if you are carrying concealed but if you openly carry you can.

I tried to visit a friend in prison and put my pistol in the trunk but upon approaching the gate where our vehicle was to be searched they asked if I had any weapons and I told them pistol in the trunk. They said it was an arrestable offense but he believed me when I told him I figured it would be ok in the trunk. We had to leave and could not come back that day. We simply abandoned the whole idea of visiting him at that specific facility. Interesting to see some differences between states.

Don’t forget the post office! As a government building firearms are banned there . Since it is a more “ordinary” location than a courthouse or military base, it’s easy to forget. I also live in SC, and it’s important to remember that places with “no concealable weapons” signs also are banned by law in SC ( if signs are posted correctly, etc.). I know that this can be a grey area, but I try to avoid these places when I can (like the mall), and not carry in these places when I have to go in them. I know that there is a very slim chance of getting “caught” if you are carrying correctly, but I support the rule of law, even when I may not agree with the law 😐.
