    Question- if I wanted to trademark a name but the name/ company is not active, can I still trademark it? Not active meaning in not doing anything with it right now.

      As long as you have a genuine intention of starting to sell products or services under the brand in the future (2-3 years from now), you can file your trademark based on an intent-to-use basis.

    If (OPI) Company would have filed a Local (State-Trademark™️) that could have increased their common law rights, Huh? 🤔 Before filing a Federal Trademark because some small businesses can’t afford a federal yet. “Correct Me If I’m Wrong”

      Not really. State trademarks are largely useless.

      @@trademarkfactory I don’t think it’s useless. It’s just not Federal, but it’s useful Locally State wise.
