    Just about everywhere in the UK is private property. Even the pavements are private property - they are owned by the council. That the council is elected by the public doesn't make the pavements public. What does makes make the "public" is the fact that someone can't be trespassed from the pavements or highways. So the whole argument that being on private property and therefore recording is not allowed is wrong. And because it's wrong, they approached you and accused you unnecessarily and it could be argued that they interfered with your human rights.
    Railway bylaws do not ban photography. What they do cover is harassment and disruption of other people using the station and trains. And a camera is immaterial to that.

    • @TheSadButMadLad
      @TheSadButMadLad 2 года назад

      @@kevinwright5081 Incorrect. Public footpaths are ones which the public can walk on them without restrictions. Any other footpath can be used by the public, but there might in very rare cases be some restrictions.
      Public footpaths is just a legal term to denote those paths that once defined can't be changed. A private footpath becomes a public footpath after 20 years of use by the public unless a sign indicating otherwise is put up and maintained for ever or until the private footpath is removed or moved.

    Its publicly accessible so public property during opening hours so you don't need permission or special permission and the threat of camera confiscation, try, you need the permission of a judge to confiscate a camera and that includes the police as well as jumped up nobody's with a hi viz vest. Then using the "we are told" so who is telling you and is what they telling you correct and they cannot remove you from a public space and they suddenly need an explanation, you don't need to explain a lawful activity and the Naziz said they were doing their job and they were all hung or shot.

  • @TheSadButMadLad
    @TheSadButMadLad 2 года назад +1

    5:20 Saying "Haven't you nought better to do" is very demeaning and rude and intrusive into your private life. If you want to pass your time filming that's your prerogative. He has no right or authority to make that statement. It's also very unprofessional and impacts on the image of the train station.

  • @forthfarean
    @forthfarean 2 года назад +1

    I don’t know what there is that they don’t want photographed, seems rather stupid. Private property can be a public place for as long as the owners permit it. The owner,or his agent can close it ,ban people,decide on the activities etc because although the public are allowed in at various times the property is still privately owned. The only place that people have absolute freedom re legal activities is in the public streets or their own home.

    • @budgetnuclearweapons7858
      @budgetnuclearweapons7858 2 года назад +1

      And if the owners don't want you filming they tell you to stop. And if you don't, they CAN chuck you out. That's not really "allowed" in my understanding.

    • @forthfarean
      @forthfarean 2 года назад +1

      @@budgetnuclearweapons7858 It is allowed for as long as the owner allows it. Although the public are allowed in,without any qualification, the owner has the right to set his own rules . If you break those rules then the owner can ask you to stop doing it or leave. If you don’t leave he can use reasonable force to eject you. If you resist you could commit an offence. That’s why it is advisable to ask a Constable to attend to prevent a breach of the peace. It is not a Constables duty to actually eject a trespasser in normal circumstances.

    • @budgetnuclearweapons7858
      @budgetnuclearweapons7858 2 года назад +1

      @@forthfarean The public are not "allowed in without qualification" that's just nonsense. Its called "permissive access". It means there is no legal right to enter but the owners of the property give you permission.

      Can you please give us the correct information

    • @zampa4ever
      @zampa4ever 2 года назад

      @@SocietyXUK thanks for your question. Section 33 as it is written, forms part of the criminal justice act as you know.
      But if you read it further in depth you realise the the Definition of a public place was put in the revised form 33 Extension of definition of " public place " in Public Order Act 1936
      For the definition of " Public place " in section 9(1) of the [1936 c. 6 (1 Edw. 8 & 1 Geo. 6).] Public Order Act 1936 there shall be substituted-
      “" Public place " includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise”.
      For the definition of "Public place" insection9(1)ofExtension of the Public OrderAct 1936 there shall be substituted -
      So reading public order act 1936 you will see:
      Interpretation, &c.
      (1)In this Act the following expressions have the meanings hereby respectively assigned to them, that is to say:-
      . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . F14
      “Meeting” means a meeting held for the purpose of the discussion of matters of public interest or for the purpose of the expression of views on such matters;
      “Private premises” means premises to which the public have access (whether on payment or otherwise) only by permission of the owner, occupier, or lessee of the premises;
      “Public meeting” includes any meeting in a public place and any meeting which the public or any section thereof are permitted to attend, whether on payment or otherwise;
      [F15“Public place” includes any highway [F16, or in Scotland any road within the meaning of the Roads (Scotland) Act 1984] and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise.]
      So you will notice
      “Private premises” means premises to which the public have access (whether on payment or otherwise) only by permission of the owner, occupier, or lessee of the premises; note only by permission.
      Going on to private land without permission you have no right to be there.
      The “public place” part of the act it to enable the police to use the public order act on private property.
      If you were in a private place (other then a residents (yours or someone else’s)) and you were swearing and meeting all the grounds to be arrested under the said act. You can’t use it was a “private place” defence.
      When it’s is quoted in so many videos all that’s happening is they are reminding the police of the part of the act to use against them.
      Granted not many officers are aware of the full wording and subsections and it’s power and are a bit taken aback by acts being quoted at them.
      One day some one will meet an officer that is aware.
      please don’t rely on the fact others are spouting section 33 and believe they know the whole act.
