- In this video, I walk you through how to access EAMS with Step-By-Step instructions and demonstration. In addition, I explain where you can find case information and give you pointers on what you should look for and what you should double check is correct.
EAMS is the California Workers' Compensation Case Management website. EAMS stands for Electronic Adjudication Management System. It is pretty user friendly compared to some other states.
Please note this information will only be relevant for injuries that are under the jurisdiction of California WCAB.

Question : Should the anxiety and stress show up on the page or its only body part ? Also what if my attorney didn't specify which side of the body was injured ?

The EAMS system does not specify side. He may have in the application specified.
Anxiety should be Psych body part and stress is a code to. Under nervous system

You may not be able to collect twice. Let me know if you want to meet with a vocational counselor for direction on that
Hi Naomi it’s me CC again I have a question for you if your Work Comp case has 3ADJ numbers and 12 years later another body part is added, is there a form you need to sign to add on that injury I don’t know if I’m saying it correctly or have it amended to your case?

If you are adding it to an existing date of injury, then you need to file an amended application.
If a new date of injury, then you need to file a brand new Application for Adjudication of claim.

Somehow , another body part got added to my case with no ADJ number ,and me finding out I don’t even know how long it was added to my case meanwhile I’ve been paying for doctors visits and co-pays for MRIs it’s unbelievable what your lawyer doesn’t let you know I don’t even think she knows how it was added I looked in FEMA and there’s no a DJ number for that new body part so now the doctor retired and the new doctor they gave me does not give out meds and they want me to heal myself with breathing techniques I don’t think they understand the concept of pain I wouldn’t be on medication for six years from Pain Management as strict as they have gotten to give out medication‘s Work Comp denies everything can’t get no kind of treatment as far as chiropractic acupuncture physical therapy because of the new laws of the years of utilization teams say no she doesn’t need it meanwhile it was added to my case without my knowledge and finding out I’ve got torn discs three dissected discs but I’m not supposed to be in no pain Workmans Comp is a joke but I think God I met Naomi to clarify so much for me and I hope a lot of people reading this can agree my name is Cici and I want to say thank you to Naomi for helping me with what information I gave her I’ve been waiting 17 years to be told I’m not getting no award so sad

Why is my case not on the site yet? I filed seven months ago. Does it take longer than that to show on there?
No, should be a matter of maybe a week. Is it California workers comp? Try looking up by name and date of birth. Maybe you have wrong case number.

It means your attorney may not have moved on your case right away. They may have just let it sit for whatever amount of time it took in between your intake meeting and the application being filed. Not a good start to your case. Could be an indication of the service you will receive the whole time.
BUT there may be other reasons why it took so long. We have had on occasion applications bounce back or have other technical issues that delayed filing. So there may be a reasonable explanation too. So only possibly a red flag.

What if I don’t have an Eams # or a wcab # but I have received the SJDV?
Thank you for your question. You can only look up your case with the wcab if you or your attorney filed it with them. If your case is litigated, then you wouldn't normal file it. Maybe at settlement.
Hi! Thanks so much for your video. I finally obtained a lawyer in February, it is now almost May and I can't tell how far along my case really is and lawyer isn't great on answering my questions of status, and the answers he begrudgingly gives me feel like fluff lines a little bit. I figured if he is overwhelmed with other cases, I was wondering if there is a way to see every action in process (subpoenas, requests, etc..) so I can check that and not depend on him or his intern for status? I only see one thing under one of my claims that was done in very beginning. Thanks!

If you have an attorney for two months and you can't find your case, there could be a few reasons.
1) your attorney just has not filed it. Could be a red flag since it's been 2 months. Should check with them. Maybe there was a misunderstanding. You thought you hired them but they thought you were only consulting. You can change attorneys at this point usually.
2) They made an error in your name spelling so when you look it up, you can't find it.
3) they filed but the application was rejected. They would have to fix the problem and try again
4) it is in there but you are making a mistake in the search criteria entry.

@Gonzalez Law Empower - CA Work Comp Attorneys I found it after trying again and I guess i hadtyped something wrong. I edited my comment after I found it, but i guess it didn't update. I'm sorry. My question now is I only see one activity and he's told me he's done a couple things...but I feel like I'm getting push off answers. and I wondered if there is another site that lists the subpoenas,etc and other little actions so that I can not have to drag status info out of him.
@@tiffanywalker713 No, the public eams will only show big stuff like Hearings, when settlement finalized etc. Your attorney can access the non public eams for documents filed and orders etc.
You can ask him for a copy of the subpoena. If you don't trust them though, there are deeper issues especially this early on. You should have a meeting to make sure you are on the same page with communication and expectations.
@Gonzalez Law Empower - CA Work Comp Attorneys ok, thank you. My dilemma is because I dealt with my case for a year and a half with Kaiser-Sedgwick being a nightmare of ridiculous human error. So, my gut says something is off, but i also might be extra sensitive and dont want to be a back seat lawyer. and just was hoping there was a way to track it all. The subpoena specific thing came up when I saw how his assistant just sent this email to my corp. to not contact me. it was all backwards and I asked why it hadn't been done when we last talked 3 weeks ago when it happened, and he said he was to send. he told me how he couldn't send it until he put in this subpoena to something else. Which doesn't exactly make sense how that would affect sending an email of representation to the worker comp person at the corporation....I just had this weird feeling like it was a dog ate my homework answer as to why he forgot to send. and his Assistant/intern didn't accurately describe the situation of contact.
aagh. I've already dealt with such crap. hate this feeling. I did have a talk with him RE communication, but his excuses on that and couple of other things is still giving me knots
If there is 2 ADJ #’s, which is the correct one to use for applying for the RTWSP?
Check out which adj it was issued under or claim number.

In your past experience, how soon does a c&r settlement case gets approved once it's assigned to a judge? how often does eams get updated to reflect any changes/updates? my case finally got assigned a judge after 3 months from the time of signing and am now waiting to hear back or see an update on eams regarding the approval.
Usually you'll get an order approving in about a week. Or an order set aside if there is a problem. Hopefully won't happen but you seem to have been having bad luck.
@@GonzalezLawEmpower It's been almost a month since being assigned a judge that I have yet to see an update. I'm assuming there's no way to find more info? Communicating with my attorney and case handler(s) always ends with silence. Thinking the reason I finally got assigned a judge after constant emails/calls to them to expedite the filing.

Before the settlement, if a injured worker was placed on time off , would he/she still receive monthly salary compensation besides settlement ?

@@weiperez5360 Oh, yes you can apply for EDD during your decision period. Once your case is accepted and you start getting TTD, you will need to inform EDD to stop so you won't have a duplication of benefits.

That is an interesting one. Although I have never seen a $0 C&R (happens in Stip sometimes). There just would not be a motivation to settle via C&R if it is $0.
However, it can be the case where at the point you settle, there is no what is called "new money". This would be where you have already been paid out what is owed you and none is left or credits add up to more than your settlement. It is not a usual case, but can happen in certain circumstances.
Example, You settle for $5,000. you previously received a PD advance of $3,000. But there was a EDD/ TTD duplication of $1,250 (i.e. you double dipped benefits that must be settled when you close the case). Your breakdown would look like this:
Total settlement: 5,000
5,000
-750 (attorney fees)
= 4250 (Your prelim subtotal - what you would normally have gotten)
- 3000 (PDA)
= 1,250 (should have been your take after PDA if nothing else happened.
- 1,250 (TTD/EDD duplication)
= $0 (New money)
In that crazy example, you would not get a check after your C&R.

Absolutely Marc, I would call or email them. Tell them you want to settle and ask to set up a settlement meeting. Depending on where you are in your case, they may tell you that it is better to wait but it does not hurt to explore your options. They might just give a settlement demand

Who's responsible for EDD lien does it come out of your settlement award.

EDD liens can be resolved several ways. The defense negotiating and settling the lien is the most common. If the case is denied, EDD might take nothing. If there is a duplication of benefits or fraud, the applicant pays from their settlement.

Hello, I already signed my settlement, is there any way I can confirm it was submitted? I keep on calling my lawyer and he doesn’t give me straight answers! He says yes but it’s been a little over a month I signed and I’m still waiting! I’m just hoping this comes to an end soon

@@GonzalezLawEmpowermy settlement got approved on 4/8 it’s 5/21 and no check! Lawyers assistant is telling me I need to wait before filing for penalties because there are two different things! When they issue and when they send! At this point I’m so disappointed by who I chose! Is there a timeframe insurance has to send? Does it matter when they send,as long as check is dated before the 30 days are due? Or can I filed for penalties already? This lawyers assistant isn’t being helpful!
@@jessgo187 I would file now. You may not win but just filing might hurry them up. If the reason you did not receive is your fault, they won't be liable most likely. Like if you put the wrong address for example.
