    Depending upon what state this lawsuit was filed, Atozy can file an anti-SLAPP counter claim. Also, bitboy's attorney could face sanctions if the initial claim was meritless.

    The fact that he dropped only when he realized he would be the only party losing money with lawyers and legal fees only shows that he acted 100% in bad faith and that lawsuit served only to bully and scare Atozy.       They do, that’s the purpose of Anti-SLAPP laws. The trouble is not all states have anti-Slapp laws and not all lawsuits meet the criteria of the statutes that do exist

      They don’t all, it’s state dependent. In some states it is just a dismissal, in some states you have something called a SLAPP-Back lawsuit to recover fees, and some states have fees rolled into the anti-SLAPP statute.

    The fact that he withdrew the lawsuit as soon as he realized Atozy now had money to defend himself proves beyond reasonable doubt that this was just intimidation. He was willing to take his “meritful” case to court when he thought Atozy couldn’t afford it but the instant he learned he could he backed out? Did his case lose all merit once the defendant could actually afford a lawyer?

      Most everyone knows that lawsuits most typical function these days is intimidation but that wasn’t and isn’t their intended function, which is why everyone is salty despite already knowing that. Even if they didn’t know that, shouldn’t you be happy they’re discovering the truth of how our legal system works? Everyone has to learn such truths eventually, there was a day or a video or class where you learned this once and where I learned that once, so no need to be snarky even if the person really didn’t know.
      Knowing doesn’t mean we should stop complaining in comments or private about those who file frivolous lawsuits and drop them just because that’s what’s typical…it actively wastes our Justice system’s time and money (which comes from taxpayer pockets). People should continue to complain about cases filed as an intimidation tactic and other bad faith lawsuits even if they understand that’s the unfortunate majority of them these days because we live on a Monopoly board where money = power. The banker who doles out money to the rest of us is being robbed by all the monopolies across the board, leaving those of us with only one property with money scraps and also only scraps of power.
      Maybe one day America can stop being so partisan and we can actually fix our legal system issues, definitely no way trying to fix our legal system now muddled in intimidation, politics, and hedge fund money via the same broken legal system could go badly. /S 🙄

    One big thing about the whole "behind closed doors" the courts are public, the dockets are public, the opinions of the court are public. Transparency is a big part of the point of the courts so people can see that justice is done. and done fairly. The moment one files a lawsuit, by definition it is public, some details can be sealed, but the proceeding existing at the very least is public.

    I think the most dangerous thing is the fact that in that video where he said he dropped the lawsuit, he mentioned that he had done it before, and got someone to back down behind closed doors... i don't know who that was, but whoever that other lawsuit is, i would like to know who that person is, if they exist, and get them a platform as well... there seems to be another filing under bitboy, maybe looking into that could uncover something interesting...

    He pulled a Slap Suit over on Atozy and only backed off when Atozy had a ton of support, donations, and "it went public" ( slap suits are lawsuits to make people stop talking about someone or some thing)
    That drags into the 2nd layer of uncomfy where he brags about his last slap suit going well because it didn't get public. Bro is GLOATING that he scared someone into silence and that it should've worked this time with Atozy.

    What Bitboy was doing is referred to as a Strategic Lawsuit Against Public Participation, and most courts don't like it. He wanted to shut Atozy up and get the video taken down, period.

    A Plaintiff who files a frivolous defamation lawsuit in an Anti-SLAPP jurisdiction is a fool. The lawsuit was dropped because not only would the plaintiff was going to lose, but would also likely be hit with an Order to pay the Defendant’s legal fees.

If a private court case were just to silence someone, so without any ground, the accused party can sue the other party, demanding reparations (usually around double the initial party requested) and the accusers lawyer usually forever loses the lawyers licence. That is why that guy didn't let it come to a court case, but instead retracted. Now we just need laws to prohibit sending letters to threaten a court case

    The issue with calling this "a win" is that Bit Boy can just refile the same lawsuit after the legal defense money has been refunded. What should be done is to countersue and get an injunctive ruling barring Bit Boy from filing the same frivolous lawsuit in the future, or, if the suit isn't actually dropped and is only being communicated that way as a ploy, to get it dismissed with prejudice. Any further lawfare harassment would then be in violation of a court order and a case of contempt of court.

The problem is when the tantrum gets dragged out, like Atozy said. That's where money is lost because the fees of court, judge, and your lawyer - because you have to have a follow up invoice when everything is said and done, and closing the case.
