Its not per se - There is no case law on the issue. The George Floyd case is likely to end very badly for the government because they're going to have to make a showing under Graham v. Connor before they otherwise proceed with proffering the elements of homicide. The case could very well end up being removed to federal court because of that issue. (This is because interpretation of law arising under the U.S. constitution falls under federal question jurisdiction which belongs to Article-III courts.) There's also a chance the FBI might be called to testify against the state in that case as well.
It’s not illegal. What Chauvin did was stupid. You can put your knee down on them for as long as necessary to effect the arrest. After he’s cuffed, it’s over. He just didn’t know when to stop.
@@Rokaize the proper technique is to have your left foot a little further back from the head and shoulder area so when you kneel down your knee is on the shoulder not on the back and that way the person can still breathe. You also have the option of just having your knee on the ground beside the head you just have to make sure that your right knee is as close to the elbow area of the arm that is being controlled so it helps make it easier to control by pinning it in place.

An arrest isn’t supposed to be pleasant or comfortable so why not just totally dominate the guy you’re arresting? Either way.
